Darrell Issa issues first subpoenas of Obama administration

House Oversight and Government Reform Committee Chairman Darrell Issa (R-Calif.) issued his first subpoenas of the Obama administration this week.

The subpoenas, issued Tuesday, would require Department of Homeland Security employees to testify about the department's Freedom of Information Act policies and practices.

They came less than a week after Issa sent a separate subpoena to Bank of America requesting documents and information related to Countrywide Financial's "Friends of Angelo" VIP Program. That subpoena, issued last Wednesday, was Issa's first since becoming chairman of the Oversight Committee last month.

A spokesperson for the Department of Homeland Security said Thursday that the agency is working to accommodate Issa's request.

"DHS respects the oversight authority of the U.S. Congress and has been cooperating with the committee on this inquiry," DHS press secretary Matt Chandler said. "We are working to expeditiously accommodate their requests and will continue to cooperate."

Maryland Rep. Elijah Cummings, the top-ranking Democrat on the oversight panel, penned a letter to Issa on Thursday criticizing what Cummings's office charged were "three unilateral subpoenas issued abruptly over the past eight days without adequate consultation with Committee Members."

"Based on your public statements and the underlying facts, all three subpoenas appear unnecessary at this time and could have been avoided if you had adequately consulted with me and other Members of the Committee," Cummings wrote in the letter.

Cummings also said that he was "dismayed" that Issa had signed deposition subpoenas for the Department of Homeland Security employees last Thursday, one day before Issa met with Cummings and spoke by phone with Homeland Security Secretary Janet Napolitano.

"Your actions create the impression that your decision had already been made," Cummings wrote, adding that Issa's record on consulting with committee members prior to issuing subpoenas "is now 0 for 3, and this has resulted in confused, rushed, and unnecessary subpoenas."

Issa spokesman Kurt Bardella brushed off the Cummings letter.

"Another day, another complaint and more righteous indignation, what else is new?" he said.

Asked about Cummings' claim that Issa had signed the subpoenas before speaking with Napolitano or himself late last week, Bardella did not respond specifically to the charge but instead took broader aim at Cummings.

"At some point, you come to realize that Mr. Cummings was put here to obstruct and that's exactly what he is going to do," Bardella said. "It's disappointing, somewhat annoying but ultimately makes him irrelevant."

Bardella also provided a timeline that shows that Issa and Cummings, as well as their staffers, consulted on the subpoenas several times over the past week, painting the issue as somewhat more complicated.

According to the timeline, Issa's staffers began conversations with Cummings's aides on the DHS subpoenas last Wednesday. At that time, Issa aides advised Cummings's staff that the chairman intended to issue subpoenas for six employee interviews and documents.

Later Wednesday, Issa's staff reached an agreement with DHS to consider not issuing the document subpoena in lieu of the department's willingness to schedule interviews with the employees.

The next day, according to the Issa timeline, DHS notified the committee that it would not cooperate with the employee interviews. Democratic and Republican members of the committee staff met to discuss a way forward, and Friday, after several more e-mail interactions with DHS on which the committee's Democratic staff was consulted and copied, Issa decided to sit down with Cummings to consult further.

Later Friday, Issa spoke by phone with Napolitano and urged DHS to participate in voluntary interviews. Napolitano relayed to Issa that the department had been having difficulty complying with the committee's request for documents, and Issa agreed to work with DHS to narrow the document request.

Then, this Tuesday, according to the Issa timeline, DHS refused to proceed with transcribed interviews and would only agree to a joint briefing. Issa authorized the issuance of subpoenas, spoke by phone with Cummings, and the subpoenas were sent Tuesday afternoon.

Bardella confirmed Thursday that the subpoenas were sent to the two DHS employees and said that Issa is "expecting DHS to fully cooperate with the Committee."

Asked for comment on the timeline, Cummings's office said that it did not have a formal response beyond what Cummings stated in his letter Thursday.

Unbelievable! The Crazy Republicans in Congress have time for this - and time to take a week long vacation, but can't get it together enough to prevent the federal government from being shut down? They blame the budget on the Dems but are too terrified of their billionaire supporters to make a rational decision and increase the tax rates on the filthy rich! I'm just amazed that people buy stuff.

That’s how Republicans operate. They either pick the dumbest bum in the bunch, or whoever is the biggest crook. Almost every Republican that was sent to office in California has had a criminal record either before or after he took office, which is no doubt why most Republicans just don’t get elected in California.

I think Darryl Issa is probably the only Republican who got elected in California last November out of everybody who was running.

99% of our winners are all Democrats.

So, what exactly is Cummings lying about? Is he lying that Issa never talked to him or the other committee members? And how the heck would you know. Issa has a rather seedy background, how do we know he isn't lying?

Just like Clinton, bog the President down with going after everyone around him. 80 million dollars and eight years and they couldn't destroy Bill Clinton. They won't be able to destroy President Obama either.

I see another GOPer doing his damnedest to obstruct what little of our government they are allowing to function at all.

Most of our government ceased functioning during the last administration. Now Issa and other anarchists are trying to bring the rest of it to a halt.

Time for some patriotism trials. Let's start with 43, Cheney, Rumsfeld, and the rest of that mob. Move on to Gingrich, Frist and the already discredited clowns. No, maybe we should start with the disruptors currently hobbling government functions across the country - Boehner, McConnell, Cantor, Issa, Bachmann. And for good measure round up the propagandists - Limbaugh, O'Reilly, Hannity, Palin...

We can all go down to the National Mall - a park the GOP refused to budget enough money for to keep the grass cut - and watch the sentences carried out publicly. Should make for a good picnic day, watching our nation being returned to sanity and cleaning out the rabble sabotaging our society.

Now now like any career criminal Issa is doing what he's told for the money of course. Issa didn't dare order or even thing of ordering any of the Bush people while they were committing crimes. Cheney would have put his assassination hit squad out for Issa. Karl Rove makes people disappear or have unexplained deaths. This is a show and waste of taxpayers money as having Issa investigate is like making Bernie Madoff US Treasury Secretary. While Issa's friend Wilkes in sitting in jail for the crimes both committed one might think Wilkes is wondering where that friendship went. The other part of that crime team Rep. Jerry Lewis is staying low key in hope people forget this crimes for money. Will I gave Cunningham a party when he's released from jail. No word from Issa on the illegal firings of the US Attorneys.

Congress has a responsibility to conduct oversight. How much oversight did the dems do the last years? If you tell Congress we can't supply the documents you need, and then say we also won't allow the employee to be voluntarily interviewed, you can expect to be compelled. It's all a stalling tactic to avoid accountability.

Elijah Cummings is one of the most honorable men in Congress and he is a member of the committee that Issa is corrupting. Cummings should have our President's back and so should you. He has done nothing wrong except get his black behind elected President and that has set the rightwingnuts back sixty years.
Issa is a corrupt man and always has been but you cannot be a Republican unless you show a proclivity for corruption. They like their criminal members. They spent millions trying to overthrow Clinton using his BJ for an excuse because they never got over Nixon's resignation. Nixon had no choice because he would have gone to trial and shown for the corrupt leader he was.
And then there was Irangate for Reaaaaagan and WMD and yellowcake for Bushie.

Enjoy your final 23 months in office, Tea Fascists. Everybody knows now, including the elderly, that "Obamacare" doesn't threaten Social Security and Medicare; RepuliTeas want to wipe that out ALONG WITH Obamacare.

Issa is an idiot. Always has been. You use subpoena power if people aren't working with you. But Issa is a "fire, ready, aim" sort. It'll catch up with him.

As for Issa's staffer, calling a relatively senior representative "irrelevant" is just classless. Which is the essence of Issa.

See this is why the citizens of this country continue and will continue to suffer. This is what our tax money go towards, a bunch of rubbish. You want to know why the government is broke, because of soap operas like this. And this one got press time, I can only imagine similar ones that happen day in and day out that are too boring for the media report about. I hope the government does shut down, the American public needs a reboot. Get all of these clowns, Republicans and Democrats out of here and start over again with folks who really want to help their fellow Americans.

The US nation's Demublican government, in collusion with the Big Banks, perpetrated this particular series of thefts. Michael Moore dumbed it all down for US citizens, showing how Baby Bush's administration, in partnership with Congress, were accomplices, and how the Obama administration, in partnership with Congress, continues the crime. But no, the ignorant and fickle citizens of the US nation would rather believe their government's propaganda than the truth, and then they accuse their government of being corrupt and vote the corrupt democrats and republicons right back into office again.

I have to agree with you on this one. Issa is unbelieveable. He's already on a witch hunt. Why doesn't Issa come clean about the subsidized rent he recieved from "The Family" at C Street in Washington before he continues his bid to bring down the Obama administration. Issa broke laws when he accepted this rent so how can he ask for something when he himself is quilty of a federal crime.

Since the beginning of the new administration back in Jan.
These turd balls have done absolutely nothing at all to get the economy rolling again, to start creating jobs for the 18 million that lost their jobs because of crooked wall street.
They have not even put a reasonable dent in the federeal deficit or the budget deficit.
They have not done any kind of work worth noting, especially soemthing for the good of the American people.
Well we put these turds back in power and we can remove these same turds from power in 2012, which is exactly what is going to happen unless they start getting their heads out of their butts.

Issa already broke his PROMISE to investigate Obama as the most corrupt president in the history of the USA.

So he goes after the cheney/bush homeland security department.

They were elected to govern, why don't/can't they?..Are they so blinded and ruled by their hatred of our President?..the repugblicans will do everything they can to undermine this administration and not work to better our country....Unbelievable how some think this is good for the nation!

Where were the DHS subpoenas when the Bush administration was violating constitutional rights to privacy with illegal wire taps. Congress has real problems to deal with Issa. Using you seat in Congress as a platform for partisan legal attacks is pretty pathetic.
