Is Sotomayor Fight Over Before it Begins?

Is Sonia Sotomayor's confirmation to the Supreme Court a foregone conclusion? Consider:

• She is a known quantity. Sotomayor has been seen as a potential court pick for months, giving friends and foes alike ample time to pore over her record. The proliferation of blogs and the wealth of information available online, including all of her legal opinions, mean that on some level Sotomayor has already been vetted (though her body of work includes "no major decisions concerning abortion, the death penalty, gay rights or national security.") Critics have seized on a few of her past remarks, but if there is a true smoking gun anywhere in her professional record, it hasn't been found. Her personal life is a different story, but we can only assume that Team Obama knows for sure that she has paid all her taxes. Can't we?

• The fact that Sotomayor -- or, as Mike Huckabee called her, "Maria" -- is Latina presents the GOP with a special set of problems. Republicans can certainly criticize her record and judicial philosophy, but may be hesitant to adopt the kind of scorched-Earth tactics that have been deployed in some past Supreme Court fights. Doing so could represent a "suicide mission" for the party.

• Mathematically, Democrats have a near-stranglehold on the Senate. With 59 seats -- 60 if and when Al Franken is seated -- the majority barely needs to reach across the aisle in order to accrue the support necessary to put Sotomayor on the court. Centrist Democrats have so far given no indication that they would oppose her nomination, and some key Republicans, particularly Olympia Snowe and Susan Collins, are already sounding positive notes about Sotomayor.

Not only is Sonia Sotomayor an excellent choice for the Supreme Court. In choosing her, President Obama has demonstrated his BRILLIANCE in balancing so many different factors. These include the judicial, the intellectual, the historical, the racial AND the political. Nothing short of fantastic!

Pundits always want to see a fight and try to convey the sense that there is going to be one even when there is not going to be one for the reasons that the author stated.

I would add one more reason: Republicans are more likely to defer to a Democratic president's judicial appointments than are Democrats to Republican appointees. Even if they did not, the Republicans don't have the votes and the only Democrat I can think of that might vote against her is Ben Nelson (D-NE?) depending on when he is up for re-election.

The President could have done worse. He could have picked Jennifer Granholm or Janet Napolitano. (Note: The President seemed to only consider women for this opening on the court) Both Granholm and Napolitano would have been over their heads intellectually on the Supreme Court. Sotomayor can go toe to toe with Scalia, Thomas, Alito, and Roberts even though I would disagree with her judicial philosophy.

It is a foregone conclusion. We could just skip the Senate Judiciary Committee hearings and vote tomorrow and the result would be pretty much the same as it will be a few months from now.

Hopefully, Sotomayor will take Scrivener50's comments seriously as well as the Post. I published a book about a woman tortured by directed energy weapons, stalked and raped by a former FBI agent. Obviously, the battle is over in a special way: Ben Pershing and the WaPo will do about as much delving into her background as it did of Obama. Every "news" story from the WaPo was practically an FEC violation of campaign advertisement rules, so expect the WaPo to continue that with their "news" reporting on Sotomayor.

Unfortunately, the GOP leadership is too dumb and too corrupt to effectively oppose her. That means it's up to us. This would be a great time for citizen journalists in the NYC area to make visits to school libraries and the like looking for speeches she's made and similar.

Anything the Republican Party can do to continue committing political suicide -- such as waging a "Scorched Earth" battle against Judge Sotomayor's Supreme Court confirmation -- would be extremely welcome by most Americans. To the Ramparts, GOP!
