Calif. man arrested, accused of threatening Pelosi over health care

Updated 6:44 p.m.
By Spencer S. Hsu and Ben Pershing
The FBI arrested a California man Wednesday for threatening House Speaker Nancy Pelosi (D-Calif.) over her support of health care legislation in a series of phone calls, a senior law enforcement official and Pelosi's office said.

Charges against the man are set to be unsealed Thursday, when he was to be brought before the U.S. District Court in the Northern District of California, the official said, speaking on condition of anonymity because the charges are not yet public.

The suspect allegedly made dozens of calls to Pelosi's homes and her husband's office, saying that if she wanted to see her home again, she would not support health-care overhaul legislation, the official said.

The arrest took place in San Francisco, Pelosi spokesman Brendan Daly said in a statement. Pelosi "thanks the FBI, the Capitol Hill Police, House Sergeant at Arms, and other law enforcement officials for their professionalism in this matter," Daly said. "She will have no further comment at this time."

In September, Pelosi was asked by reporters whether she worried the anti-government rhetoric from opponents of health-care reform might lead to violence. She responded by invoking -- without specifically referencing it -- the infamous 1978 murders of City Supervisor Harvey Milk and Mayor George Moscone at San Francisco's city hall.

"I have concerns about some of the language that is being used because I saw this, myself, in the late '70s in San Francisco," Pelosi said. "This kind of rhetoric was very frightening, and it created a climate in which violence took place. So I wish that we would all, again, curb our enthusiasm in some of the statements that are made, so that understanding that some of the people -- the ears that it is falling on are not as balanced as the person making the statement might assume."

Pelosi warned again in March that "words have power" and that members of Congress should make clear threats of violence do not belong in the health-care debate. But she also defended the right of protesters to speak out and said threats wouldn't frighten supporters of the reform bill.

"Our members are undaunted,'' Pelosi said. "They are proud of their vote. They understand what it's about.''

If this guy is found guilty he should be put in maximum security jail for at least 10 years, with no parole, together with any and all tea party folks who threatened anyone with violence. This kind of behavior is NOT protected by free speech, whether it is coming from tea party organizers or Limbaugh, or Glen beck, or O'Riely or Palin.

This loser lives in government housing in San Francisco. He will probably lose that very soon and he will be living where he will not have to pay rent but will have to wear orange clothing. This is the typical case of low achievers wanting to act like they have the power to make things happen. Oh well, typical republican!

Arresting a few of these wingnuts will start to sort out which ones are serious and which ones are just talking about being serious. Once the process culls the actors from the talkers, the few remaining actors will be able to decide what to do next.

This looks to me much like the fracturing of the "New Left" in the early 70s. Most of those attacking the Establishment then gave up the effort after Kent State. A few splintered into violent fragments. The violent fragments either blew themselves up or ended up in jail or exile, or dead.

Go for it, radical right. May you have greater success in taking down the Establishment than the New Left had.

This guy's mother did an interview with the local ABC station - she blames Fox.

"She does not think he would be capable of carrying out the threat; he has never owned a gun, and she blames Fox News for getting her son worked up."

Interesting that he has not problem with some of those other "socialist" programs. He lives in public housing. I wouldn't be surprised if he's also on MediCal - a "socialized" health care program.

The Right in this country has lost their mind. They have allowed Fox, hate radio, and nutty elected officials like Michelle Bachmann and Steve King to fill them with so much misinformation and conspiracy theories that they can no longer process facts.

Now why would someone threaten this nice lady. After all, she insisted that the health-care bill be passed, so as we could find out what is in it. She denied she knew about CIA enhancesd interrogation techniques, even though she was in the room when they were discussed. She play-acted about the divisiveness in this country, tearing up, and equated what is going on today to the Californis race riots. She walked arm in arm with black leaders through the halls of congress during the health-care debacle, with her ever ready gavel, imitating the segregation marches in Alabama. She took joy rides all over the world, with her entourage of hanger-ons, using not only military aircraft, but commercial planes, and stayed at top of the line hotels, dining at the best restaurants. I think a statue should be deicated to her in the House of Representatives. To think someone would threaten her; shame on you.

Peolosi is a disgusting human, who twisted arms to pass something Americans didn't want. No amount of threatening would ever get her to change her and the lefts agenda. Those who feel extreme frustration react inappropriately- on both sides of the aisle. But liberal media only portrays one side as usual!

Anyone doing threatening calls should be arrested. I read at another site this morning that this man also has a long history of confrontation against members of his church, has been arrested for welfare fraud, and has caused problems with a transportation person over a fare dispute. This is anther man who appears to need serious psychiatric help over a history of confrontations with numerous people he has encountered over the years.

People are divided into thinkers/leaders and listeners/followers. Guess which group begins the week driving to and from work tuned into hate speech from conservative talk radio? Guess which group stays glued to Fox "News" before retiring to bed? By week's end, guess which group is ready to pop an artery AND ready to endorse violence against supporters of President Obama's agenda...specifically health care legislation?

Big business supports Rush, Sean, Glenn, etc. It doesn't take an idiot to know why Right-wing media is anti-Obama.

And yet...

When times are tough, both leaders and followers experience fear. Smart, self-serving people prefer followers. Followers are easy targets for channeling fear into hatred and rage...the old mob- mentality principle, mind you. (A properly trained mob of followers will believe ANYTHING and THAT can be good for business.)

Hatred and rage will continue as long as people continue to follow.

The democrat's Health Care plan: Provide doctors and treatment to most people. Long and expensive, but it saves lives.
The Republican's Health Care plan: Defeat Bill Clinton's Health Care initiative. Kill then of thousands of American every year who lacked basic Helath Care. Very cheap. In fact, they'll work with the NRA to make hand guns readily available to the sick. They'll even offer a great deal on bullets. Buy one and get one free.

And yet, it is those who attempt to save lives who see their's threaten today, while those who killed innocent people by denying them basic care go about their lives in total immunity.

This is truly an upside down world we live in. Hopefully, we'll give enough time to Obama to put things right side up again.

Several federal officials said the man made dozens of calls to Pelosi's homes in California and Washington, as well as to her husband's business office. They said he recited her home address and said if she wanted to see it again, she would not support the health care overhaul bill that since has been enacted.

I support the Health Care bill, I voted for Obama and will vote for him again, and I think the things some conservatives are saying are over the top and incendiary (not to mention false).

Still, I wouldn't draw a line between this guy's actions and the right wing's blowing off steam.

You can argue that hearing that sort of thing said publicly could make a nut case think he has some sort of endorsement, but even if you could prove that it did in this case (and I don't think you can) you can't advocate suppressing every public statement that a deranged mind might take too literally. That would rule out some of the best satire.

[q]Pelosi is an evil evil person and should be impeached as well as her boss and Reid. She did this overhaul unconstitutionally and sneakily behind closed doors. [/q]

How on earth do you propose to call the 14 months spent on the health care debate unconstitutional? I guess by this you are hoping that the activist conservative judges on the supreme court throw out a law passed by the majority in congress. I think thats what a lot of right wingers used to accuse the liberals of doing...

Obama was ELECTED by 54% of the people in this country. His campaign laid out exactly what he would do in terms of health care, and basically, the health care legislation fulfilled that promise.

I am sorry that you regret living in a democracy.

Each and every call made threatening to murder Congresswoman Pelosi for doing her duty as a Congresswoman is a serious Federal felony. If convicted and sentenced consecutively for many calls this person would never be eligible for parole. If found guilty I think he should be made a highly public example and locked away for the rest of his life and good riddance.

Furthermore each and every Tea Partier who threatens to murder Federal officials to block legislation, is attempting to subvert and overthrow the US Constitution and is guilty of Treason. They should fear being locked away for the rest of their life. We have ample prison space for them all.

In all seriousness, if Mr. Giusti is married and/or has children then I'd be deeply afraid for their safety. Mr. Giusti sounds as though he has the requisite personality to be someone who physically and/or emotionally abuses others. He seems like someone who might present a danger to everyone.

Though I am totally against acts of violence, it was strange for me to be informed by the FBI that crimes such as

threats to murder and/or rape children and women “Do not rise to the level that requires an investigation”. If true, feel free to do just that and threaten anyone as you please. The statement by the FBI can be made available to anyone threatened with sanctions for making these kinds of threats.

Should we charge Obama with assault for telling Americans to get in the faces of neighbors and those who didn't support his candidacy back in the Fall?

So the man threatened one of Pelosi's many houses. Big deal. Slap him on the wrist and tell him not to do it again. Clearly, these idiot ring wing nut jobs are nothing more than empty rhetoric.... kind of like the Congress and President they abhor.

Neither side should threaten those in authority with bodily harm; however, Pelosi is an evil evil person and should be impeached as well as her boss and Reid. She did this overhaul unconstitutionally and sneakily behind closed doors. This is not Europe, not a Third World Country, nor is it Hitler's Germany, but if these people continue to be in office... it will be a sad sad day for America, leading as it is now, to socialism and Marxism... All who support them, will see it is so.

Good to hear! Anyone threatening violence needs to be jailed and that includes the leaders on stage at these rallies too. Palin for example has crosshairs on the locations of Democrats running for office! Palin's use of the words "reload", "aim" and "fire" conjures up violence, she should be arrested and charged. Anyone threatening violence should be incarcerated for their terrorist threats.

Yup. Those "commies" that control the US House need to be taught a lesson. Just because they are the majority, they can't go around forcing 'them'--the minority into accepting socialist goals. No sir re. The right talks about left wing nuts, but what about right wing nuts that believe that they have a right to over rule majority law with a gun? I know, I know. This person doesn't represent conservatives, most of whom are law-biding citizens, but hasn't the rhetoric from the right been incendiary enough to make some of the more radical ones think that their behavior is acceptable, and they have a right to personally overrule and destroy legislation, just because it is unacceptable to THEM?
