House ethics panel announces Waters trial

Rep. Maxine Waters (D-Calif.) will face a trial for her role in steering federal funds to a bank to which she is personally connected, the House ethics committee announced Monday, setting the stage for a September that will be dominated by news of House Democrats' legal travails.

With an initial investigatory subcommittee having completed its work, the ethics panel said it had created an adjudicatory subcommittee to "determine whether any counts in the Statement of Alleged Violation [against Waters] have been proved by clear and convincing evidence and to make findings of fact." A similar subcommittee launched its trial last week of Rep. Charles Rangel (D-N.Y.), with work in that case scheduled to resume in September. The ethics panel did not specify when it would hold its first public hearing in the Waters case, though September is the likeliest time for that proceeding to start as well.

Reps. Zoe Lofgren (D-Calif.) and Jo Bonner (R-Ala.) -- the chair and ranking member, respectively, of the full ethics committee -- will hold the same titles on the adjudicatory subcommittee examining the charges against Waters. Lofgren is also the head of the Rangel subcommittee.

Waters is being investigated for her role in arranging meetings between Treasury Department officials and representatives of minority-owned banks, including OneUnited Bank. Waters' husband, Sidney Williams, formerly served on the board of directors of OneUnited and continues to own stock in the company. OneUnited got $12.1 million in TARP funds after meetings that Waters helped to arrange, and Treasury officials have alleged that they never knew of her personal ties to the bank.

The ethics committee Monday released an 80-page report on Waters produced last year by the Office of Congressional Ethics, the quasi-independent body charged with vetting allegations of wrongdoing against members. The OCE referred the case to the ethics committee last August, with its bipartisan board of former members and congressional officials voting unanimously in finding Waters might have violated House rules governing conflicts of interest and that her actions merited further scrutiny.

Waters' office issued a lengthy statement Monday denying any wrongdoing.

"I have not violated any House rules," Waters said. "Therefore, I simply will not be forced to admit to something I did not do and instead have chosen to respond to charges made by the House Committee on Standards of Official Conduct in a public hearing."

"Starting with the Office of Congressional Ethics (OCE) report released today, the record will clearly show that in advocating on behalf of minority banks neither my office nor I benefited in any way, engaged in improper action or influenced anyone," Waters added.

Waters, the chair of the Financial Services subcommittee on housing and community opportunity, has long been a champion of minority-owned banks, many of which are represented by the National Bankers Association. In her defense, Waters said she did not seek to arrange a Treasury meeting just with OneUnited.

"It is important to clarify that this meeting was requested and scheduled on behalf of the NBA, not on behalf of OneUnited Bank as has been suggested.," Waters said.

She also maintained that her actions did not directly result in OneUnited or anyone else receiving federal money, and that she received no personal benefit. "No benefit, no improper action, no failure to disclose, no one influenced: no case," she said.

But the OCE report paints a different picture.

The OCE found that "there is a substantial reason to believe" that Waters violated House rules when she arranged the September 2008 meeting. And while the meeting was technically called for the full trade association, "the discussion at the meeting centered on a single bank-- OneUnited."

The outside office's probe appears to have delved deep into Waters' role in lobbying Treasury. The OCE interviewed current Treasury Secretary Timothy Geithner and his predecessor, Henry Paulson, according to the report made public Monday. The office also spoke to Rep. Barney Frank (D-Mass.), who is identified as "Representative A, chairman of the financial services committee."

OneUnited suffered during the collapse of the mortgage industry because it had invested heavily in shares of federal mortgage giants Fannie Mae and Freddie Mac. At one point, according to the OCE report, Waters spoke to Frank about OneUnited's problems and seemed aware that she was in a difficult position.

"Representative Waters told Representative A that she was in a predicament because her husband had been involved in the bank, but 'OneUnited people' were coming to her for help," the report states. "According to Representative A, she knew she should say no, but it bothered her. It was clear to Representative A that this was a 'conflict of interest problem.'"

Frank's advice to Waters "was to ''stay out if it' -- OneUnited was a Boston bank and he had a commitment to minority banks. He would address the problem. Representative A then asked his staff to take over the OneUnited issue from Representative Waters."

The report adds: "Representative A had at least two conversations with Representative Waters in which he told her to not get involved in the OneUnited matter."

At the end of her statement Monday, Waters said she was "not convinced that the process for investigating and examining House ethics cases is fair."

Members of the Congressional Black Caucus have complained in recent months that the House ethics process has unfairly targeted them for scrutiny, as the vast majority of lawmakers who have been investigated by the full ethics panel this Congress are black. Several members have also complained that the OCE's methods are overly public and unfair to the accused.

In May, Rep. Marcia Fudge (D-Ohio) - whose top aide was chastised by the ethics committee in February in a separate case -- introduced a bill that would make more of the OCE's work secret and clarify the "standard of proof" used by the office in recommending further investigation. Waters was one of 19 co-sponsors of the measure, all of them CBC members.

If they underwrite WRONG among their colleagues by using ‘POWDER PUFF’ discipline, each and everyone of them should be ousted in November because they will have proven that they do not possess the integrity or backbone to adhere to laws they write for citizens to follow. Going to be watching on Rangel and Waters. Some of their actions are tantamount to THEFT of taxpayer money!!

White history of tea party people has no history of black people who were kept as slaves.

I am more than a little disgusted by the attempts to paint the allegations of ethical lapses by Reps. Rangel and Waters as racist...The fact that there may be disparate treatment between white members of Congress and non-whites with regard to ethicial issues is no reason to spare Rangel and Waters from punishment-investigate the disparate treatment AND punish the wrongdoers!... I am also disguested with the CBC for defending these two individuals. One thing is certain, irrespective of color, it looks like our elected share one common trait and that is that they continue to look after their own self-interests, their constituents be d@maned!

Maxine Waters is the most racist black person I know - and I know her personally. I'm also black. Maxine hates White People. She has said, in my presence, that she will do anything to get even with White People. She has said, in my presence, that if any White Person dared accuse her of any wrongdoing, she would brand them as a racist, and that would be that - everyone would back off. Of course, dear Maxine didn't count on Obama and Holder polarizing the races in this country. Now, Whites don't care if blacks call them racists, they're pushing back, and they're pushing back hard. I told Maxine she should accept her light slap on the wrist punishment and move on, but no, she said, "I'm going to show those Honky Crackers who Maxine Waters really is. I'm afraid she'll end up in prison, because she really is guilty of more things than most people are aware of.

Apparently, to you, facts are pesky annoyances. To some of us, they matter. These politicians are not accused of "crimes" and they do not face "trials." They are accused of ethics violations and face "hearings." Words matter. There's a difference, and Fox news either knows that and chooses to make the situation sound worse than it really is, or, they don't know and don't care since it's Democrats in the cross hairs. In any case, I prefer to get my "news" from non-partisan sources - which used to mean the Post.

Like I said before, WaPo is not Fox news for you who are too illiterate to figure that out. And as I stated before, trial vs hearing, does not negate the fact that Waters may be guilty, or may not be guilty of ethics violations. However, I could truly care less what you call it. I'm more concerned with the finding of facts and that the truth will be forthcoming for the American people, as you should be as well. Maxine Waters is the most racist black person I know - and I know her personally. I'm also black. Maxine hates White People. She has said, in my presence, that she will do anything to get even with White People. She has said, in my presence, that if any White Person dared accuse her of any wrongdoing, she would brand them as a racist, and that would be that - everyone would back off. Of course, dear Maxine didn't count on Obama and Holder polarizing the races in this country. Now, Whites don't care if blacks call them racists, they're pushing back, and they're pushing back hard. I told Maxine she should accept her light slap on the wrist punishment and move on, but no, she said, "I'm going to show those Honky Crackers who Maxine Waters really is. Clearly the House Democrats have decided to throw their best legislator overboard because she is African American to please the racist Republican smear machine and its tea party allies. This type of racism should stop. President Obama needs to cancel the midterm elections to prevent this smear machine from destroying the Congress and should rule through decree until members of Congress get serious about change.

The best measure of corruption among the political establishment is the extent to which a politician who has no product other than his or her vote or voice manages to accumulate wealth during a career. Speaking up for a friend or relative who receives some benefit from a relationship, an act of common decency, has to be balanced against the wink and a nod associated with a politician becoming one of the wealthiest individuals in the nation. Using a rent controlled apartment for political activities is in contrast to accepting a below market rate lease or purchase from a business or individual operating in the circumspection of legislation, or vying for poltical contracts. Trying to cajole businesses into contributing to support a facility for underprivileged students at a public college by writing a solicitation letter on Congressional letterhead is almost cute. The fact that such minor transgressions by community leaders like those of the black caucus, who find themselves in elected positions entirely based on their community activism, is being presented as the very first business on the agenda of a new congressional watchdog over ethics, looks so much like selective prosecution that it must in fact be that. Most notably however is that it amounts to an effort to control who leads a disaffected community. Who is trying to select our leaders for us. It is remarkable how much of that seems to be happening lately. It's probably more a matter of style than racism because it has been rather widespread. Whoever is trying to fix the outcome of these future political selections by controlling who the voters have to select from ought to show his or her face. The jig is up. We know you're out there. And already enough of these puppets who have no roots in a community.

It's sad to read all the race comments which clearly expose the dysfunctional mentalities that walk among us who have such disdain over our current administration for various reasons. Based on the majority of comments where color or race are mentioned they are resentful a person of mixed color sits in the White House and they just cannot get over it.

Other's expected Pres. Obama to perform miracles that no human-being could do in the first place...like dig us out of the hole many irresponsible American's, Wall Street and our government allowed to take place. There is so much blame to be shared, it misses no one in Congress, Wall Street and many on Main Street are tagged as well.

To say because a person is black they expect special treatment is an assumption on the part of the writer who obviously has issues with minorities as he/she views them as people looking to get one over on Whitey as they put it (their words not mine). Wow...to have that in the forefront of your mind is disturbing to you on a very deep level which then blinds you from the truth...all congressional leaders in DC are bought and sold as we have learned over the past two years. That did not all happen recently, this is a practice decades old.

We American citizens serve ourselves better by holding everyone accountable and responsible regardless of race, color, creed, political affiliaton, etc. otherwise we serv no one and the cycle continues. Then we own the problem as we provided no sustainable solutions either.

They have taken an oath to defend our constitution and violated that trust.

If a member of the military lied and cheated, they would be dishonorably discharged and lose any benefits.

Letting them retire is an insult to those who have gone by the book and lost their retirement savings while these dishonest people get full benefits and medical for life?

I had expected a higher level of professionalism, but we all make mistakes. I made one the other day that someone picked up and ran with...it took some catching up to correct it and set it right, but I did. It may not have been as eloquent a fix as someone else might have performed, but it worked. Whatever works to stop the insanity is fine by me, if no one gets hurt in the process. I have learned from my recent flub and hope our President is learning or has learned from his trial and errors.

It is when we do not learn from our errors that we do ourselves a disservice as a nation and as people.

It is indeed a shame that we see reverse racism in the Obamanation Administration. The African-Americans in this country have suffered from racial prejudice, merely because of the pigmentation of their skin and by white men (and others) who claimed that they were "Christians" (thats laughable if it wasn't so pathetic).

Yet, now we see those who suffer from racial prejudice, that which they hate, now become racist themselves. We see this in the Sherrod Case (the pigford settlement 1.25 Billion dollars appropriated in a secret military allocation which was for black minority farmers only). The incident of voter intimidation by the New Black Panther Party whrein the Obama Justice Dept refused to prosecute those responsible.

While I understand that this is only two obvious examples of reverse-discrimination coming from the Obamanation white house, it certainly demonstrates the fundamental attitude of a racist administration.

I am not a "racist". I have NEVER discriminated against any man or woman because of the pigmentation of their skin, not even Obamanation! My issue is solely with the "dumbed down" stupidity of this adminstrations errant policies and philosophies. I strongly resent those who are political "dupes" who call evil good and good evil. They have no moral compass! They have become blinded by blind leaders who serve the desires of their own bellies and have no love for this country or its' people. Obamanation is a master deceiver and a curse to this nation!

He promised "transparency" and now "his" minions are working hard to make secret any investigation by the ethics committee! He promised to heal bi-partisan rifts in Congress, but has done more to increase that rift! He promised to allow the American people ready access to ALL bills being considered or voted on by Congress before it was voted on, which was a bald faced lie and has not been done. To the contrary: Both Obamacare and the Financial Reform Act was not made available to the American voters until after it was signed into law. That's just a small portion of the lies of Obama!

Notice the second thing out of Waters mouth is that the Ethics Committee investigation of HER is unfair. The first thing that she is crying is THIS IS RACIST.

This from a Congresswoman that continues to benefit from her district that has been constructed to insure that she is re-elected time after time from her majority of Black Voters.

Woman is a liar, crook and a Racist herself. She and Rangel were two members of the CBC that went to Pelosi declaring that the Ethics Committee had too much power and needed to be CHANGED. This change was to insure that the CBC was 'protected' for hearings against their own that were and are crooks.

I didn't know that the WaPo is another Fox subsidiary. When did that happen? You seem to be content to "split hairs" as to whether this is a "trial" or "hearing". The obvious issue here is was there a violation of ethic on the part of Waters.

So what is your issue here? Do you decry the revelation of the truth as a result of an investigation or perhaps you would only offer your support of such an investigation as long as the accused is not black or democrat. I think that both are true. Your pathetic partisan politics merely reveals your own stupidity.

It's sad to read all the race comments which clearly expose the dysfunctional mentalities that walk among us who have such disdain over our current administration for various reasons. Based on the majority of comments where color or race are mentioned they are resentful a person of mixed color sits in the White House and they just cannot get over it.

Other's expected Pres. Obama to perform miracles that no human-being could do in the first place...like dig us out of the hole many irresponsible American's, Wall Street and our government allowed to take place. There is so much blame to be shared, it misses no one in Congress, Wall Street and many on Main Street are tagged as well.

To say because a person is black they expect special treatment is an assumption on the part of the writer who obviously has issues with minorities as he/she views them as people looking to get one over on Whitey as they put it (their words not mine). Wow...to have that in the forefront of your mind is disturbing to you on a very deep level which then blinds you from the truth...all congressional leaders in DC are bought and sold as we have learned over the past two years. That did not all happen recently, this is a practice decades old.

We American citizens serve ourselves better by holding everyone accountable and responsible regardless of race, color, creed, political affiliaton, etc. otherwise we serv no one and the cycle continues. Then we own the problem as we provided no sustainable solutions either.

Ben, I have news for you. The ethics committee does not hold "trials." They hold "hearings." This procedure has NEVER been called a "trial" until now Fox news found yet another way to try to tar Democrats with a highly charged word. It doesn't bother them that the word is incorrect - BUT IT OUGHT TO BOTHER YOU. Why don't you know this? You only have to go back through a few of these hearings to see I'm right. Was that too much trouble for you? The most reported one of the last 30 years was the Keating 5 - FIVE sitting senators. You'd think that got lots of ink, and it did, but no one called it a "trial." And, for someone else who commented, the charges are not "crimes." They are ethics violations. I know, I know, that's not nearly red meat enough for some on the right, but do we have to let them lead the way?

Waters is innocent of doing anything bad. Ahe is an African-American woman and that makes her innocent of all allegations of impropriety. After all, if she was white, she wouldn't even be accused. Her husband owns substantial stocks in OneUnited Bank and without the help of the Treasury he could have lost a bundle.

Can you blame her for trying to save her husbands bank role? Just give her a pass people. She's been a disadvantaged black woman and its only right that she gets her share of the big money that all you whiteys already got.

So what, if she maneuvers big money her husbands way, which she will get through him. We should only presecute the whiteys in Congress if we are going to be "politically correct". Isn't it relative that her great grand daddy was a slave brought here from Africa by the British? I think Waters should get whats hers and a little bit of everybody elses too.

As a struggling American Family we don't care what side of the isle you sit or the color of your skin, if you broke rules you must be held accountable. The unfortunate truth is most all our congressional leaders have dirty hands and thus they will not really go after each other, (only in appearance) because they are all involved and would have to include themselves in the indictments. It matters not if they are Anglo, Black, Latino, Asian, Republican or Democratic Members, they all have skeletons they don't want made public or put under scrutiney. They do these kind of ethic committee investigations to rile the masses and distract from further dirty deeds in play while these so called indictments are handed down. It's all a ruse and dispicable of congressional leaders in either house.

Wow, when even Barney Frank is telling you to stay out of something because it will get you sent up on conflict of interest charges, you ought to listen.

Instead, Waters heard from her colleague that getting involved was wrong, and she knew herself that it was wrong, but she did it anyway.

Waters' justification seems to be that because minority-owned banks are a good thing, her conflict of interest is not an issue. This is a cause she has advocated before, and therefore to help a specific bank now isn't a problem in her mind, even if her husband was on the board and still owns stock. Somehow, too, Waters is now claiming that she didn't influence the Treasury at all. Ummm...right. The bank couldn't get in the door until Waters forced the door open by arranging a meeting for them. If that's not peddling influence, I don't know what is.

If we are going to look back and examine where the TARP funds went and whether there was any undue influence exerted by government officials, this is just the beginning of a very long story.

I'm surprised anyone knows anything, since Paulson wrote the TARP legislation to specify NO ACCOUNTING of the distribution of the funds required.

I wonder if we'll be tracking the TARP monies that flowed through BofA, Wells Fargo, Wachovia, etc. and into the drug cartels in Mexico fueling a wave of violence resulting in over 20,000 deaths 200 decapitations, and all other sorts of products of prudent banking.

Nancy Pelosi missed a few alligators when she claimed that the 'swamp' had been drained.

I agree with the Congressional Democratic Black Caucus. These charges are clearly racially motivated. The congressional leadership seems to be acting purely on the color of the members' skin, Waters and Rangel.
I can't believe that the tea party, the only racist party certified by liberals, convinced Democrats to bring the charges. How did Foxnews and the tea party get the 'swamp drainers' to bring the charges?

Could it be that the Democratic leadership did this without the tea party's consent? WHoa, that would make the leadership racist, can't be. Fox and the tea party had to have something to do with it.

What a coincidence – bet she did not know one thing about her husband’s ventures until money was delivered!!

AND WE ARE SUPPOSED TO ENTRUST OUR FUTURES TO THE ETHICS CHALLENGED “GREED HOARDERS”???? They are nothing more than government sanctioned crooks bleeding our country dry under the guise of ‘government’!

As an African-American, let me speak to the issue of Congress women Maxine Waters. Until all of the facts come in, it is hard to render judgment. If this small bank benefited from TARP money knowing that Congress woman Waters' husband was a board member then this is a conflict of interest and would be consider a violation. The question I have is who made the decision to assist this bank and how was the congress woman involved? Personally for me, I cannot render judgment until these questions are answered. If she is found guilty, she should resign!!!!

Wonder when the investigation of Eric Cantor will begin? His wife is an executive at the Emigrant Bank, a subsidiary of New York Private Bank & Trust, which received TARP funds as well. Did he direct the bank executives to discuss with Treasury? Did he steer TARP funds to this private bank? Is his wife a shareholder in this bank?

Inquiring minds would like to know.

Ms. Waters just doesn't get it. If you 'help' your constituents, or help a company, industry, factory, store in your district....hey, you are just doing your job supporting your district.

But when you 'help' your husband and by definition your own financial situation via guiding government assistance to a bank where your husband is employed..... hey, that's corruption.

Hmmmmmm.......maybe she does get it. But figures since she's old, arrogant, and a minority she can get away with it.

Probably can.

But, the Democrats will take a fall in the elections because of the arrogance and greed of Rangel and Waters. Of course these two could care less.

The Maxine Waters case is another example of a a Soviet Style ( or Medieval one if you like) show trial to show the world how ethical these bozos are.

From what I see, not withstanding her husband's financial interest ) Waters acted in the public interest of her community.
Again we have as with Rangel the mortal sin of media appearance.
What measurable financial gain accrued ?

What gain was intended?

As I a voter I seem more reason to hold these politicians in contempt.
Why the Rangel trial is going forward is not clear at all. It appears that they settled on a reprimand or did the Clinton's block this?
The voters of these two districts should rise up in protest.

Wonder when the investigation of Eric Cantor will begin? His wife is an executive at the Emigrant Bank, a subsidiary of New York Private Bank & Trust, which received TARP funds as well. Did he direct the bank executives to discuss with Treasury? Did he steer TARP funds to this private bank? Is his wife a shareholder in this bank?

Inquiring minds would like to know.

Hey, Queen Nancy. How's that swamp draining coming along? Is BP in charge of this clean up? As for Maxine, she's black, she's female, she's a dedicated liberal, she's a member of the congressional black caucus. The likelihood of her being held accountable for her unethical behavior is about as likely as me flying to Mars this afternoon. Congress does not have the guts to effectively deal with Maxine or Charlie.

Seems odd that Maxine Waters is being charged with doing what government does everyday via legislation, regulations, etc., ie. give subsidies, favors, preferences, affirmative action and handouts to minorities. If the bank had "affirmative action" or "diversity first" on its letterhead, the liberal media and her socialistic peers would be applauding or even worse, throwing taxpayers monies at it. Maybe the real quesion is: what has Maxine Waters "actually done" to p...off her fellow liberals? Something tells me the race-card will shortly come out. History says The Washington Post will support any socialist, any government official or bureacrat who has harmed or will be harmful to taxpayers. So why has The Wash Post sold Maxine down-the-river?

A new law should be forced by the people to have each and every perk given to a politician, first be approved by a two thirds majority referendum. As long as we allow crooks to vote themselves perks, they will not think twice of the cost to you and me!!

Waters and Rangel will escape with the current make up of the congress.

I recall another crooked congresswoman in a SAFE district here in central Florida who escaped any punishment for her transgressions. She just gets reelected for term after term. A perfect reason for term limits.
