House Will Investigate CIA's Handling of Canceled Program

The House intelligence committee decided today to launch an investigation into allegations that the CIA broke the law by not informing Congress about a program launched in late 2001 to capture or assassinate al-Qaeda leadership.

"The committee must be kept fully and currently informed of significant intelligence activities as required by law," Rep. Silvestre Reyes (D-Tex.), chairman of the House Permanent Select Committee on Intelligence, said in a statement.

CIA Director Leon Panetta first learned about the secret program on June 23, as agency officials were considering an effort to relaunch the program. It has been described by officials as an on-again, off-again attempt that has never been fully operational.

Panetta immediately canceled the program, which involved attempting to form small teams of operatives and move them into the mountain terrain of Afghanistan and Pakistan, as opposed to the agency's main weapon of choice against the terrorist group's leaders, drone planes.

Panetta appeared on Capitol Hill the next day to inform the House and Senate intelligence committees about the program and his decision to cancel it. Current and former administration officials, as well as sources on Capitol Hill, have said that shortly after the Sept. 11, 2001, terrorist attacks then-Vice President Cheney gave the order to not inform the committees of the secret program.

Republicans have rejected the need for an investigation, saying that the program was necessary in the effort to go after terrorists. Since the program was never operational, there was no need to inform Congress about it, they contend.

Democrats, however, decided to launch the probe, some of which will be handled by the panel's investigative subcommittee, chaired by Rep. Jan Schakowsky (D-Ill.). Reyes indicated that the probe would explore the full issue of how and when Congress needs to be briefed on intelligence matters.

"This investigation will focus on the core issue of how the congressional intelligence committees and Congress are kept fully and currently informed," he said.

CIA spokesman Paul Gimigliano said the agency would "work closely with the committee on this review." He added, "Like Chairman Reyes, the agency's goal is that this new investigation not become a distraction to the men and women of CIA, who have the vital mission of protecting the United States from foreign threats."

For decades Congress and the CIA have battled over the 1947 law that formed the agency and what it requires in terms of congressional briefings. It included a provision mandating that the committees be kept "fully and currently informed" of intelligence issues. Even for covert actions, lawmakers on the committees generally must be notified.

But the law also says such briefings should be done "to the extent consistent with due regard for the protection from unauthorized disclosure of classified information relating to sensitive intelligence sources and methods or other exceptionally sensitive matters."

C.I.A. Morale is great, (but thats a SECRET).

Why would trouble for Dick Cheney have any effect on C.I.A. morale? Dick Cheney the INSTANT intelligence expert, (just add fertilizer), is who made the C.I.A. look like idiots for Iraq and for the failure to capture or kill Osama Bin Laden.

Dick Cheney is also the one who tightened down on whistle-blowers. So if you had a bad streak of integrity you either left the agency or you shut up and let it eat at your guts. Congress wants oversight, (they say), but they can only get their information from the people who have the most to hide. The people who give the reports are masters of psychology who can make the most intelligent question seem totally ignorant. Without whistle-blowers they don't stand much of a chance. Dick Cheney also has made it lot easier to put C.I.A. employees under surveillance without oversight.

Panetta didn't find out for so long because the C.I.A employees had been intimidated by Dick Cheney for 8 years. Until they could poke his political corpse in the eye with a stick, they were not going to speak up. And as far as I can tell the National Security Act of 1947 doesn't have any teeth. The penalties appear to be administrative.

I have an extraordinary assumption that the imagineers linked dire and grave consequences with each reckless and illegal act they committed thus creating the dynamic that any attempt to scratch at the truth would create an automatic threat to national security. Some of the most perverted and criminal crimes might have happened here in the US, where everyone assumes the rule of law is absolute and our terror fighters can thrive outside what a reasonable person would ever expect possible or tolerate. Sound silly; what do you think Dick Cheney meant when he said the government has the inherent ability to break the law in order to take every and any action to ensure national security. Among other things, it probably means the FBI derailed the lives of a lot of innocent people who had the hypothetical potential to be threats and many of them never realized the FBI and operators of the TSP were driving the process with conveyor belts of informants under their feet. Will you ever know the truth, if the terror fighters did their job probably not. The "dedicated" part is to link dire and gave to every illegal act and the "professional' part is to start jumping up and down screaming national security and safety when any one dares questions these illegal acts because they kept you safe without much principle at all.

im sickof hearing how the bush/cheney WH kept us safe when they took over we had a balanced budget and the WTC'S were standing.5000+american s where living.they have some people actually believing this crap.i have a brother in law that has heard this crap for so long he actually believes bush was in office only days and not 9 mos. before 9/11.they did not keep us safe.

Bush/Cheney did not keep us safe. 9/11 happened on their watch after they were warned by the Clinton Administration. Their own ideological deafness kept them from listening. They then used the fear they help generate to pave the way for the biggest expansion of Federal Power and intrusion into the civil liberties of American citizens in a century.

The CIA has nothing to fear. Cheney, on the other hand, conspired o prevent Congress from undertaking it's constitutional obligations. Give him a fair trial, then hang him for treason.

Now that the sky is moving, somewhat, or a semblance of real conscience and intellect is now necessary to truly compete, for some, it must be hell to wake up, if you ever sleep, knowing you ordered or aided those who ordered or performed torture on an innocent human, or on any human.

This program would not have been objected to when it was first initiated at the agency. For crying out loud it was right after 9/11, the flying monkeys from the Wizard of OZ would have gotten a big thumbs up from Congress, if the CIA wanted them. In 2003 Bush proposed going to war with a country that had nothing to do with 9/11, and Congress approved. Why did the CIA fail to brief Congress? Perhaps it was ineptitude, fear that it was so badly designed it would never work, so keep it on the drawing board.

Well I support the kill or capture program, I expected it. But I believe Congress should have been notified and not doing so was a violation of law. Bottom line is that terrorist must have expected as much. They are probably laughing at us that a program to wipe them out has never left the launch pad since 9/11/01.

Princess Pelosi and Studs Steny Hoyer are trying to deflect their own inherent problems within their own lives.

When charged with the protection of this nation, the difference in the use of a drone and feet on the ground is simple: Minimalize collateral damage and take out the target(s).

Republicans using Pelosi as the reason why this is being investigated is a hoot. Republicans don't want an investigation because it will make them look worse then they already are. Republicans don't want the public option health care bill because they will look like idiots for not doing anything about for the last 8 years and also they know with 40 million Americans now covered under this bill that will be 40 more votes for the democrats. Republicans do not want the economy to recover, they want America to enter a depression and get attacked again...all to win the next election. I'm beginning to realize that there are few, if any, democracies left in this world. Certainly the government of the US has not been 'by the people and for the people' for a very long time, if ever. This post raises two main points: WHY wasn't Congress to be informed, if the program was what it is claimed to have been; and WHY did it take the CIA eight years to finally decide to make the program operational, if it was what it was claimed to be?

Sounds to me as if there's something more in that murky matter that isn't being disclosed....

If, as one poster has said, flying monkeys would have been approved after the panic associated with 9/11, Congress should have been told about them (aren't that pretty much what the drones are?). Some folks don't seem to want to live in a democracy with checks and balances. If they want rulers who simply decide for them without any input, go to the many countries where that happens. Many of the remarks by Rush (wanting the president to fail, etc.) and his ilk have stepped over into treason (there has even been talk about secession - look what happened last time). Maybe it is time for those who want an unfettered leader to go where they do that, and those calling for the failure and the breakup of the US to go in exile with them. If you don't want to abide by the law, go. And don't let the bar at the border hit you on the backside on the way out.

So Congress wants to interpret the law to mean that they must be FULLY BRIEFED on every idea or Plan the DOD, CIA has that is not being considered to be brought to the "Select 8" to change it into active status where Congress does have a role?

Every idea, every brainstorm now on file at CIA, the Pentagon that is shelved or has too many problems to bring it to active status? Or working plans that will only be brought to Congress on contingency? Like our war plans to free the Cayman Islands should Cuba ever invade? Or plans on how we would respond to America citizens endangered in a violent revolution in Albania.

If San Fran Nan and her cabal really want that, then each year, they will need to devote 180-260 hours while Congress is in session getting briefed on every military and intel plan on the drafting boards or plans that would only be activated with Congressional consultation.

Or perhaps, they only want to damage efforts to capture or kill Islamic terrorists and Taliban now killing US and allied troops, and safeguard the bad guy's "Precious Rights". And they don't really want full briefings on contingency war plans, or to damage "the troops" - just CIA.

It does appear the fight by Hard Left Dems railing against people looking into ways of capturing or killing AQ and not briefing Congress on each and every "great idea" that has gone nowhere - is a fight that conservatives, moderates, and blue dog Dems supporting Steny Hoyer over Pelosi welcome.

They automatically accept the premise that this program never went operational, that they spent 7 years in a so-called "development" phase only.
Yeah?
Right.
They need to read a good, independent, well-researched history of the CIA.
But their minds are so closed, they probably wouldn't be able to concentrate long enough to see that this ultra-secretive behavior, coddling supporters within administrations and major private contractors, etc., without disclosing their activities has been a hallmark of the CIA throughout its history.
There are a lot more shoes to drop here.
I despaired that anyone in Congress would ever develop the spine to begin the cleanup from the Bush cabal.
This may get the ball rolling, hopefully.
Something tells me when they turn over the rocks, some other "programs" may well come to light.
This is most likely the tip of a gigantic iceberg that will take years to turn over.

Under all this Fluff of "National Security" - Cheney Hijacked the ENTIRE US Government, SH!T on the Congress, Courts and Justice Department , Initiated a War Conspiracy and LOOTED the Defense and Intelligence Budget BLIND.

Obama is a Pushover as is Holder who sit by and DO NOTHING.

The Founding Fathers idea of seperate but equal branches of government as well as distribution of power between the The Federal and State governments was envisioned as much to ensure sustainability in the event of impairment or disfunction of one branch or other as it was about preventing the accumulation of inordinate power in the Executive Branch. Unfortunately we live in a time when all branches are filled with corrupt partisan toadies and opportunists. The rise of Cheney and an Oligarchy that we see with the Corporate Defense, Oil, and Banking Barons was made possible by the mediocre incumbents IN Congress.

There is no honesty let alone Statesmanship left in this dying Republic .
I for one am learning to speak Chinese, beginning with that essential phrase, "Brother can you spare a dime?"

Problem is that as long as the Repugnants can gerrymander those southern states (and Utah of course), we will have a significant group of members of Congress safely lobbing dissent without offering solutions. I guess we just have to put up with it, act like adults, and try as best we can to deal with the immense problems that were inherited. I used to think hypocricy would be rejected at the polls, but it doesn't seem to work that way with the GOP faithful - few but furious. They could run Sarah Palin and Joe the Plummer and the Limbaughs, Colters, etc. would buy it and cheer. To bad, used to be a decent party.

This Democratic Congress is out of control! Not only do they want to spend us into bankruptcy but they want to control everything. Not only do they want to have unbridled control over the government but they also want to control private banks and auto manufacturers. This effort to discredit the CIA is a further example of this abuse of power.

I have no problems with the CIA protecting privileged information to insure our countries safety. If they need to target the leader of a known terrorist group to protect us from future threats then I'm all for it. Congress on the other hand is well known for NOT being able to handle confidential information without leaking it out to the media. Or in the case of Nanci Pelosi forgetting what she's been told and then hiding the records. This abuse of power is a threat to our country and we need to get these kooks out of office.

I think Nanci Pelosi needs to be taken to the wood shed over her undisciplined remarks about the CIA and her repeated slanderous remarks about the Bush administration. This woman is looney!

This whole thing boils down to 2 easy questions that have nothing to do with Partisan Politics.

1) Is the US the honorable, law and order country it says it is?

We all seem to be in concert that the assassination of those responsible for 9/11 is acceptable. I sense bipartisanship on this.

What the fundamental problem is Dick Cheney's egregious treatment of the Constitution Of The United States. He has essentially decided that since it did not fit his morally corrupt view of strategy. Piss on it.

Unfortunately, as has been noted here, there is not a defined punishment for this slimy deed. My hope is that after the committee has reviewed this it can present additional evidence to a special prosecutor and further a war crimes trial that names Bush and Cheney et.al.

I don't blame the CIA for keeping things from Congress. Congress has more leaks than a kitchen colander. They don't give a damn about national security, they just want to kiss the butt of the press and will feed it everything they can. Of course it's always under "promise of their name being kept confidential because the person speaking isn't authorized to speak on the subject" what a load of manure.

Why would anyone want the CIA going covertly into other countries to kill supposed AlQaeda? Is not our country based on checks and balances? 7 years and nothing was done by this group? Then why did Panetta run to the Congress and tell them about it? It seems there is more to this then just a program that did not get off the ground. I do not want MY country run by a military group, that is more of a dictatorship. Where does it end when will our country get transparency back as Obama promised? Why are we still NOT getting the Anti-trust laws back, so we can separate the banks, insurance and investment groups so we don't have another stock market crash? When will our Congress start protecting us, so we will NOT be underwriting banks etc., with our tax dollars?Congress is supposed to protect us from these things. We hired them. They are in our employ. They need to enact laws that keep the CIA under control, and our economy from going down again. This Congress NEEDS to get their backbone stiffened. We need our Healthcare to come first also. Our taxes are going to other countries and more war, when will health and education that can and will promote more peace be started? or does the Congress follow all the Lobbyists for big insurances, big pharma, big oil?

Why would anyone want the CIA going covertly into other countries to kill supposed AlQaeda? Is not our country based on checks and balances? 7 years and nothing was done by this group? Then why did Panetta run to the Congress and tell them about it? It seems there is more to this then just a program that did not get off the ground. When you have the CIA deciding who, where and when to hit, without oversite, you are authorizing a dictatorship. We do not need a separate group running the spy and assassination group, without control. Who are they to decide, and who are we to go into other countries and kill indiscriminately. Panetta was right to run to Congress, but that only tells me one thing. They may NOT have been idle and he may have been afraid of the consequences with no control.
We are a country of checks and balances. We have a Constitution that had been shredded and defiled by Bush and Cheney. We have never allowed torture. The Neuremberg trials were there for all the world to witness, so we could hold our morality high. Now it seems are Constitution is going down the drain, even Obama wants the "underlings" NOT to be prosecuted since they were told by "higher-ups" that it was OK, but the underlings knew that was NOT the American way, so why NOT take the investigation to the top - Cheney and Bush. The ones that spewed out the "We do NOT torture" and proceeded with torture, by twisting words given to them by their lawyers, to shred our constitution and Congress was terrified by them to go against them. But are they now terrified with the Dems in charge, or do we have demicans and republicrats, all looking out for themselves and NOT for we the people. How about these Congress people and their spouting that they believed in family values, Christian believers, living in a church house on C-Street and taking their mistresses there. In this house of Christians, they were told they were the ones chosen by God, so their crimes or indiscretions would be overlooked and they could still be the ones to run our country. If their values are immoral, how can they be ones to make laws to govern us? Will the laws NOT cover them too? Doesn't seem to.

Depending upon the targeted state and operation it may take a short-term or long-term solution to accomplish the objective. Policy makers tend to view covert operations to be effective offering a short-term solution. The most senior policy makers tend to think in blocks of time no longer than four years which is their tenure in office. The intelligence community tends to think in long-term solutions. Covert action is a policy tool, which should be conceived as a long-term solution. To influence the climate of a targeted country may take years.
