Boxer: Climate bill markup will go forward Tuesday, with or without GOP

Senate Environment and Public Works Committee Chairman Barbara Boxer (D-Calif.) will go ahead and mark up climate legislation in her committee Tuesday, she announced Monday morning, even if the Republicans try to block her.

Under committee rules and precedent, two members of the minority are customarily required in order to provide a quorum for a markup. But Boxer and her aides will rely on a provision in the rules that will allow the Democrats to proceed as long as a majority of committee members are present, and can report out the bill if a majority is present and votes in favor of the bill. Democrats outnumber Republicans on the panel by a ratio of 12 to 7.

While committee Republicans have objected that the Environmental Protection Agency has not performed a full economic impact analysis of the bill authored by Boxer and Senate Foreign Relations Committee Chairman John Kerry (D-Mass.), Boxer rejected this complaint in a statement.

"This bill has had comprehensive legislative hearings, with 54 expert witnesses in nine panels. Committee rules provide that the Chairman's Mark be circulated three days before a business meeting, and we released it, along with the EPA's economic analysis, ten days before the markup," she said. "No climate bill has ever had this level of review and the Obama administration stands behind the EPA's analysis."

"We urge Ranking Member Inhofe, with the utmost respect, to bring the committee Republicans back to work on this issue. We will give them the opportunity, as we proceed this week, to reconsider their decision," she added. "We look forward to working with them if they decide to participate, but if they do not, we will move forward in accordance with the rules of the Senate and of this committee."

Matt Dempsey, spokesman for the committee Republicans, said the minority was united in its opposition to moving forward.

"The EPW Republicans would like a markup of the Kerry-Boxer bill, but are disappointed that the majority seems intent on moving forward with a markup before receiving a full analysis from the EPA," he said. "Given the sheer size and significant economic impacts of the bill on the American people, we feel it is our duty to insist on having the analysis before members are to vote on the bill."

Tuesday's markup will begin with opening statements and will break for German Chancellor Angela Merkel's address to a joint session of Congress, so that will allow time for negotiations between committee Democrats and Republicans to proceed.

In an interview Friday, Sen. Tom Udall (D-N.M), said he hoped the two sides could work something out. "I'd like to try to work with them and see what they want," Udall said, adding he would defer to Boxer on the matter.

On Monday afternoon, all six ranking Republicans on committees with jurisdiction over climate change legislation sent a letter to Boxer (PDF) asking her to delay consideration of the bill until a full economic analysis is performed. Two of the GOP senators Democrats have been eyeing as possible backers of a cap-and-trade bill -- Lisa Murkowski (Alaska) and Richard Lugar (Ind.) both signed the missive, which states, these sort of "analyses are worth the time and resources not only to get them done, but to get them done right."

The senators added if Boxer presses ahead with a markup over the Republicans' objections, "such an approach would severely damage, rather than help, the chances of enacting changes to our nation's climate and energy policies."

Boxer is a tenacious fighter for the environment. Her battles with Inhofe, and with prior EPA Administrator Johnson are a high watermark of integrity and straight-out courage.

They believe if you de-regulate the Banking and Securities Industry everyone will prosper (even Greenspan is out of that camp). They believe that guns make you safe even though all the data says you're more likely to hurt yourself and your family than anyone else.

350 ppm atmospheric CO2. Higher than that and we're in big trouble. Or, you can just pray.

Climate change has been occurring since the beginning, since creation, since the big bang. The climate will continue to change until the end of time, when the sun burn's out.
We have had ice ages followed by periods of warming over and over one ice age after another.
This is not about the planet it is about the redistribution of money. AlGore is just sitting himself up to make millions of dollars.
Senator Barbra Boxer has allowed the San Joaquin Valley, the bread basket of America in her state of California return to its desert state, thanks to Boxer nothing grows their now.
Global warming is a total fraud, perpetrated to take tax money from the hard working people that earned it and give it to someone else. Why do you think they now call it climate change?

Funny how this newspaper does not mention the "Pink Slip" campaign where nearly 3 million pink slips have been sent to congress. Boxer, I'm sure, got hers or will get hers. Rush is right about the revolution, it's coming and the losers in the congress and this president will be hard pressed to know what is going on. If this idiotic bill is signed, it will give foreign nations some say over our country. If no one gets that, then go back to school and learn how to read and reason.

Remember Boxer is up for re-election in 2010. We need to get rid of her and her buddy Waxman. California is already over 20% unemployment and is only getting worse. The highest price per gallon of gas in California. The green initiative is only green because of taxpayers’ dollars. As soon as the government subsidies end so will the green initiative.

Cap and tax will be the largest tax increase in our history. Boxer wants this to pass now so Obama can further sell out the US taxpayer and place us under a foreign taxing authority since the Revolutionary War. Obama and these idiots want to send TRILLIONS of our tax dollars to Third World Country war lords. It is a scam and the only thing that may save us is that a treaty, at least now, still requires a 2/3's vote of the Senate. It is doubtful if Obama and Boxer can find that many Senators that want to end their careers.

Boxer, like Pelosi and Reid, is not interested in bipartisanship but will ram through this bill just as Pelosi and Reid are doing with the health bill. Since approximately half the country voted Republican, she intends ignoring that half. Sad and sickening.

Prof. Richard Lindzen of MIT, a world known climate expert, has shown 20 years of actual atmospheric observations not bogus computer predictions, prove that the premise of global warming is false!!!! CO2 has not trapped solar radiation and increased temperatures. In fact, most of the CO2 escapes the earth's atmosphere thereby causing little if any warming.

Remember, these are real observations over the last 20 years.

I'm not a Boxer fan, and certainly no supporter of the climate bill, but Fiorina? C'mon, she almost ruined HP before they booted her out.
Meg Whitman should be running for senator not governor. She doesn't stand a chance against against Jerry Brown, the likely Democratic nominee.

Inhofe (the fool who still considers measurable manmade effects on the climate to be fiction) walks out like a petulant third grader. Oklahoma's really getting their money's worth outta this guy.
However, perhaps Inhofe is just catching up with the public.

RepubliKKKans are fast disappearing and fortunately not being replaced by the terrorist wing of their party, the Konservatives. What's really seems to be happening is the spreading of national recognition that their hate-filled torture approving party is totally nnecessary for the effective functioning of the United States (they want it to fail anyway)/ Maybe Inhofe is just playing Moses and leading his sickos to what he thinks is 'lobbyland in the sky'. There are natural cycles to the Earth.

The writting is on the wall for the Democrats. They realize that they have a limited time to pass their pet-projects, like enriching Al Gore and his reactionary climate change buddies. Anything that they want to pass has to be done this year, because next year is an election year. After that, they won't be the majority party in the House or the Senate.

Looks like the republican minority is taking a play from the Sarah Palin gameplan, quit while you're behind.

I don't attack the GOP, they have lost all their power and now must try and influence the political climate by not participating.

For all the treason and folly of the Bush war crimes, it never stops amazing me how the GOP and their mind-numbed followers claim the USA is going the way of the USSR while at the same time we are actually invading and occupying oil reserves just as if Putin were puttin on the hits.

The GOP is gone. They used to stand for things, and Ron Paul is the last dinosaur of the era. I loved Ron Paul.

Too bad the GOP couldn't recognize he was their only hope.

Barbara Boxer and the Democrats are going to triple the electric bills, and double the food bills of the American people whether they like it or not. Trillions of extra costs that will destroy millions of jobs and keep UNEMPLOYMENT in the 15-20% range for a generation, but that won't stop her. CA will reelect her next year regardless of how much pain she inflicts. Her fellow Democrats may want to note that the voters of VA and NJ tonight are not as insane as those in CA, and they may well be without a job in 2010 if they follow the good Senators lead!!!

Once and for all THERE IS NO SUCH THING AS GLOBAL WARMING. How can 4/100 of 1% of the atmospheric makeup cause it? That is what carbon dioxide amounts to in the atmosphere.

Global Warming is something for the Global Liberals to hang onto in an attempt to spread the wealth within a county and between the countries and to control the people of a country or the earth.

Another attempt to ram something down the throats of the American CITIZENS. There is NOTHING positive about this bill for "WEE THE PEOPLE". The ONLY positive affects are not positive to the people they are positive to make Al Gore RICHER thru the lies, make Goldman Sachs RICHER.
