DC9 owner, employees charged in beating death

Officials at the Medical Examiner's Officer say they have not ruled Mohammed's death a homicide. They would not elaborate. Police had called a press conference for 3:45 p.m. Friday to possibly amend the charges, according to sources. But that news conference was canceled.

"We don't have cause of death yet," Police Chief Cathy Lanier said in an email. The autopsy was not yet complete, she said.

The owner and four employees of a popular nightclub off U Street chased and then fatally beat and stomped a man after he threw a rock through a window of the club, police said.

Ali Ahmed Mohammed, 27, of Silver Spring was killed outside the DC9 Nightclub in an act of "vigilante justice," Police Chief Cathy L. Lanier said.

One of the club's owners, Bill Spieler, 46, and four employees have each been charged with second-degree murder in Mohammed's "savage beating," the chief said.

The attack occurred about 2:30 a.m. about a block away from the club at 1940 Ninth St. NW, Lanier said, after Mohammed was denied entry to the club at closing time and threw a rock through the window.

The five men came out of the club, chased Mohammed for a block before all five tackled, punched, kicked and stomped him, Lanier said in an interview outside police headquarters. Mohammed, of the 11100 block of Norlee Drive, was barely conscious when police arrived, Lanier said.

"In my opinion," the chief said, "when you talk about a beating like this as a result of property damage, a loss of life from a savage beating that appears to be vigilante justice, it's just ridiculous."

Lanier said she will close down the club Friday: "It will happen today."

There was no evidence, Lanier said, that the attack was a hate crime. "It appears that the assault was precipitated by the fact that he threw a rock through the window." She said there was no indication that any of the suspects knew Mohammed before the attack.

Police arrested another bar patron about 1:30 a.m. after the clubgoer scuffled with employees inside the club and was ejected, Lanier said. But police "have nothing to suggest" that incident and Mohammed's beating "are connected in any way," Lanier said.

Besides Spieler, the employees arrested were: Darryl Carter, 20, of the 600 block of Morton Place NE; Reginald Phillips, 22, of the 2000 block of Fifth Street NW; Evan Preller, 28, of the 2500 block of Mozart Place NW; and Arthur Zaloca of the12500 block of Epping Court in Silver Spring.

Joe Englert, who owns the club with Spieler, said in a telephone interview that "at least two and maybe three" of his employees had placed a 911 call to police after the window was broken "and were awaiting their arrival."

Citing the police investigation, he declined to say whether the employees were detaining Mohammed "but we are confident, very confident in the honesty and integrity of the staff. They have been well trained," said Englert. He said the handling of the earlier incident at the nightclub in which an unruly patron was ejected and later arrested "shows you our people are trained right."

Mohammed's death, said Englert is "tragedy and it is sickening that it happened but we are really confident that once everything is know it will all be fine for our people." He said the club "will help Chief Lanier and work with police however we can."

SMH @A spokesman for Joe Englert, a DC 9 co-owner, issued a statement from Englert saying "we are saddened by the events of last night. Our staff, families, and friends look forward to our day in court to prove the innocence of our long-time staff."...So Joe none of your staff participated in the beating?

Holy hell!

I used to go there all of the time when I was living in DC. My band played there often as well. Can't imagine that the staff would do something like that. They all seemed pretty nice to me.

Maybe things have changed in the past three years.

I guess hipsters are more dangerous that you think... especially drunk ones.

Either one of the suspects gave the police false info, or the writer erred. There is no 200 block of Fifth St. NW; Fifth St. NW starts at Indiana Ave./D St, in front of the (Moultrie) DC Courthouse.

There's more to this story than meets the eye.
Ask yourself, why did these 5 guys wait at the scene until police arrived?
Why are witnesses saying the guy was loaded into the back of a police car alive?
Why are other witnesses saying the guy was tackled but never hit or kicked?

Something is not right here -- more to the story. I know one of the accused well, and not a chance he would or could savagely beat someone. Didn't happen. Couldn't.

Everyone needs to just calm it down, at this point no one, including Lanier has any clue what happened, neither does WaPo. The coroner will tell you how he died, anything else is pure speculation and unfair to everyone involved. Yes it's established, throwing bricks and killing people is very, very, super duper bad. Understood. But accusing people of things such as "murder" or "severe beating" when you don't know what happened, also bad bad for humans to do.

Here is what is valid:

There are security cameras that will let you know exactly what happened. Nelly's camera and those of 930 club. The tape review will explain how these scrawny passive guys, who I know personally, beat this guy to his death. Maybe they ate their Wheaties yesterday? Regardless, I'm completely confident this will clear all things up, including any comments by that gem of a Chief we have. Until then, my advice is to shut your face.

It's well-established fact that otherwise decent people who would never individually do such heinous things WILL participate in a mob, once the adreneline is high and there are others doing it, too. Nice guys will jump in and put the boot in even if they would never think of doing such a thing previously.

People, read between the lines. This situation didn't occur because of a broken window. The dialogue that took place while this young man was still inside was NOT brought out! This has a serious bearing on why the owner and the workers chased this guy down after he broke the window and this needs to come to light.

As far as killing someone for doing that, no excuse! No one deserves death for a break going through your establishment's window. That's what the creeps have insurance for.

This is a sad situation. True: the management and staff should not have beat him to death....they could have just scared him a little...just a punch or two. But: Mr. Mohammed shouldn't have thrown a brick through their window. This definitely goes on the "1000 ways to die" list. Losing your life for throwing a brick. Yeah...they shouldn't have beat him, but alcoholics need to take charge of their life...before it gets taken away for something stupid like this. I hope that this article serves as a message to alcoholics that no one is accountable for your actions but you....YOU ARE NOT INVINCIBLE...so stop acting like it!!!

2nd degree is a stretch, unless they went to kill him. Which I doubt, they just got a little over enthusiastic unless they had weapons. It's manslaughter, tops. "We didn't mean to kill him, just beat him up a little." "Plus he assaulted us!" Personally, I wouldn't give them anything. If the guy hadn't been f***ing with them he wouldn't have gotten hurt. It's high time we let people face the consequences of their actions and not screw around with people then go running crying to John Law to save their butts.

Though a fatal beating is beyond what anybody deserves...the dude threw a rock just because he couldn't get in. the rock could have hit someone and injured or killed them. Stupid drunk people always think they can do whatever they want with out consequences. They should go easy on the employees and a little harder on the manager.

Saying someone you know couldn't do something like that because you know them is not going to be evidence.

Excessive fore is what is: Over kill, and unless you have spent every hour of everyday with that person, then you might be in position to make a dumb statement similar saying that you know the person couldn't have done it.

Furthermore, one never really knows what's in the other person heart or blood system. May be drugs and alcohol are involved, huh?

It really doesn't take much force to kill someone... last year some teen in Waldorf killed another teen by punching him once or twice... the kid fell awkwardly, hit his head and subsequently died.

The group may not have used excessive force... but it really doesn't take excessive force.

Ok, so what would have happened if Mohammed's rock or broken glass had hurt someone inside. I applaud the actions by the bar owner and the employees. Who the heck throws a rock through a bar window??? I would say the savage is the rock thrower.

they could have punched him a couple of times and then held him for the police. They decided to prove how tough they were, 5 to 1, and peer pressure made them succumb to pack behavior. 5 to 10 years apiece in prison will teach them.

Why was the Mohammed put into the back of a cop car, and not an ambulance? If he was hurt, DCPD should've been concerned for his health and called for backup. How long did it take them to get him to the hospital?

Beating death for throwing a rock and shattering the glass (no one was injured)?! Five men beating one?! Men ending the guy's life and seriously damaging their own? Come on, you can't be serious that this death is justified. Would you be saying the same if it was your friend, brother, etc.? We have some really sick people walking this earth amongst us when some of you think this is okay. No wonder teens and even younger kids think some of the crap they do is okay or even funny. They hear about these responses from adults, I presume, and their actions are just fine... no problem... just beat up or kill someone for whatever reason. What a sickness!

Bravery when it's 5 to 1 is actually cowardice. Bravery when you are drunk is drunken stupidity and you aren't as liable for your actions. In this case it seems to have turned into a mess for everyone involved. IF they killed him they deserve jail time. Lanier said the club is closed. That may be forever, so the owner/employees just shot themselves in the foot, whatever the cause.

Turns out it was in Crofton, not Waldorf:

The size/strength of the aggressor(s), any weapon(s) employed, any nearby surface(s)/object(s) used, the number of attackers, the type/severity of injuries inflicted, and other factors are very relevant in these assaults.

Otherwise you have perpetrators using diffusion-of-responsibility kinds of defenses/excuses and the like.

I know I shouldn't continue to repsond to trolls but I need to lay some info out there:
1. DC9 does not employ bouncers. The employees involved are scrawny, indie/hipster guys who do not make confronting unruly patrons a habit.
2. After going to DC9 for six years and not having a single problem, I can honestly say it is a safe place and the typical voilence associated with clubs does not go on there.
3. Ahmed did not deserve to die. He may have been drunk and violent, but he did not deserve to die from it regardless of the situation or what was said. There was no intent to kill him. And it is my belief that there was no intent to harm him at all. The only reason they chased him was to restain him until police arrived.

I hope the cameras stationed all over the place there weren't "facing the wrong direction" or "not working properly that night." I'd hate to see some good guys get sent up the river for something they didn't do. And if the cameras show a beating, then I will stand up and acknowlege that they were in the wrong and deserved to be punished to the fullest.
But knowing them, it just doesn't add up.

I'm a lawyer, I have cop cell phone numbers, I've been to DC9 many times. Some of the alleged facts in this case just don't ring true. Somebody is lying. Most clubs are too scared of lawsuits to touch anybody. If the allegations are true, this is an astonishing case.

It sounds, from the description above, that the guy wanted into the club, it was after hours and he was denied entry, so he got ticked off and vandalized the property. I find it difficult to believe that 5 guys, among them a club co-owner and several employees (i.e., people with a strong incentive to live outside of prison) had any intention of doing anything more than roughing the guy up.

The deceased, Ali Ahmed Mohammed, doesn't sound like the average Columbia Heights "hipster". More likely one of the Somalis that lives around there.

I agree with the lawyer ("Dave115") and others who say that something doesn't add up here. It sounds like the atmosphere was very charged last night (to say the least) in and around this club.

In addition to the physical violence, I'm very curious about what verbal exchange(s) may have taken place between the DC9 employees and this club-goer that may have escalated the level of tension and violence.

I'm basing my comment on replies before mine and I was saying that to say you can't always go by the details in a news article as stated fact. Can you agree or not? That was my point. There is something to this story that is missing.

Me having clubbed for many years I know exactly how this works. They probably talked to this guy several times before this event took place and the guy may have been talking trash to them before he left the establishment. They were possibly just waiting for him to do something so they would have an excuse to retaliate...against their better judgement in this case.

I can not tell you exactly what was said, but it's already been noted some of the details of the story are wrong. Go back through all the articles pertaining to this account and you'll see what I mean.

Once again, I wasn't there so don't know. I'm just filling in what the article is leaving out for my own reasoning purposes.

How do you know they didn't do exactly that? The human body is typically pretty resilient, but freak accidents can happen, especially when the victim is so drunk they can't brace themselves during a fall.

I think, by far, the most likely scenario is that Ahmed was tackled by one of the employees while running away, fell awkwardly, and was critically injured.

I would say this scenario is many times more likely than some kind of fantastical "Oz"-type mob beating everyone seems to be imagining.

D.C. establishments are looking VERY closely at ANY patron even REMOTELY resembling a Middle Eastern type.

They BETTER be. ONE suicide vest can DESTROY an entire club and is CHILD'S PLAY to get into the U.S.

Maybe he sat back there for 30-40 minutes handcuffed and choked on vomit then was taken to get medical care. Howard is right there. No one really knows, the autopsy will tell. I am maintaining that until evidence is presented - either camera footage of the beating or bloody knuckles or clothes consistent with a savage beating - I am presuming these defendents are innocent.

I grew up in east Baltimore, 1970s. While I was earning the scholarship to Hopkins, the local guys were smoking PCP. One guy beat up 3 cops while high on PCP. Toxicology tests on all participants would be invaluable. I went to law school at GWU and wound up staying in DC.

Didn't the police execute one of their prisoners in PG County last year? And didn't they get off scot-free? I don't know who the guilty party is here, but ALL POLICE are guilty for not demanding that heads role in that instance. Who's to say they didn't just execute another prisoner this time around? Also if this guy was so badly beaten, why didn't they transport him via ambulance? Either way, the police response is suspect.

They are presumed innocent, and the only people required to presume they are innocent are the citizens that make up the jury of their peers when their trials start. Amazing how people jump to the defense of these bar employees for KILLING a man. He didn't just drop dead in the middle of the street and he did not leave a horrific trail of blood up and down U street because these bar employees were "just holding him down and waitinf ofr the police." I watched the video of one of their employees Damon Dixon and he's lying his butt off to save his own butt and that of his boss and his job. These employees were hopping mad becuase this drunk guy threw a brick through that window TWICE. They let things get out of hand and now everyone involved has suffered a huge loss.

I agree with the lawyer ("Dave115") and others who say that something doesn't add up here. It sounds like the atmosphere was very charged last night (to say the least) in and around this club.

In addition to the physical violence, I'm very curious about what verbal exchange(s) may have taken place between the DC9 employees and this club-goer that may have escalated the level of tension and violence.

It sounds like another case of over-zealous bouncers getting carried away. I have never been to DC9 but I have been in clubs where the bouncers are causing more problems than the patrons. The time chasing somebody for a block was long enough to consider what actions to take when the person was caught. It doesn't sound like the guy was armed with a dangerous weapon. Well-trained bouncers could have handled the situation correctly.

I was at the show and and it was violent as a lot of hardcore shows are. I saw a few people get escorted out for stage diving but it was handled professionally and without any real problems.

I'm not here to defend what may of happend but its a shame that somebody has died and all anyone can talk about is locking these 5 gentlemen up without due process.

Seems like Lanier and the press are trying to write the story by filling in a lot of gaps. Lanier said straight up that they stomped him and the press is putting it out there the same way. Do you have a witness to the alleged beating? The witness interview I saw said they only caught him and restrained him (check it out on tbd.com). Who called the police in the first place? Why would they wait around for them to show up if they were intent on murder? The guy was conscious when the police put him in the back of the patrol car, no ambulance. Could this drunk guy have been beaten up before he tossed the brick through the window? C'mon Lanier, are you going to investigate the case impartially? Doesn't sound like it. Sounds like some serious railroading to me.

I guy came up to my door one night actually 4:00 in the morning) asking for money to get home. I could tell he was trashed out of his mind. I had a dollar in my pocket and gave it to him. he wanted more, but I told him to get lost. he started banging on my door loudly. i thought he was going to break the glass. I got my rifle and came back to the door. i did not show him the gun but told him to leave now. i am so glad he left (ans was waving cars down on the street). i did not want to use the gun, believe me i did not, and it was the only time in my life i was came close to using it.

Look on a map where 1940 9th St. is.

Stagy, maybe. Staged, unlikely.

I'm far from a scientist but cold weather would slow down the evaporation rate of blood, or any other typical liquid for that matter. The presence of shade and the absence of strong wind currents would also retard evaporation. Relatively large droplet sizes (leading to lower surface-to-volume ratios) could also prevent blood spatter from drying quickly.

However, I doubt that the presence of any potential ingested substances (e.g. alcohol) in the blood would play much of a significant role. (If your BAC is high enough to noticeably affect the evaporation properties of your blood, it would also likely be more than enough to kill you very fast.)

Lastly, it's hard to determine from the web-optimized image, but the photographer might have taken that photo very early in the morning, just a few short hours after the unfortunate incident.

Deceased did not deserve to be beaten to death but should not have provoked the fight throwing brick throgh the door. You dont want to mess with small business owners in DC area in this bad economy. Many of them not doing well on the verge of losing all their lifes worth, business, home etc are suicidal. Then this dude had the nerve to cause thousand dollar damage ruining all days hard earned money. People can get very emotional losing money especially these days and there is no knowing what limit they will get carried away when provoked.

Having not been there, it's totally plausible the guy was punched, but there's no way he was beaten like this by these people. I know the staff too well. I have seen them handle far worse circumstances in a professional manner. There is way more to the story.

Everybody on here seems to enjoy being outraged more than they seem interested in know what actually happened.

That guy could have been anyone of us any of us could have decided to go out and have fun at a club one night and beaten by thugs while we are tipsy and vulnerable.

Interesting comments that have nothing to do with the facts. Much as I like Chief Lanier, it's not unusual for her to say something without all the facts. From http://www.tbd.com:
"But late this afternoon, police said the charges might be changing. Police called a press conference for this afternoon that was canceled, and another police source later said the medical examiner's office was "leaning away" from deeming the man's death a homicide, according to ABC 7.

The medical examiner's chief of staff Beverly Fields said the cause of death is still pending. And she said she's not expecting a ruling over the weekend.

DC9 co-owner Bill Spieler was one of those arrested. The four others have been identified as 20-year-old Darryl Carter, 22-year-old Reginald Phillips, 28-year-old Evan Preller and 25-year-old Arthur Zaloga.

Police Chief Cathy Lanier identified the victim as 27-year-old Ali Ahmed Mohammed, of the 11000 block of Norlee Drive in Silver Spring. His father, Ahmed Goltchu Mohammed, told reporters late this afternoon that police weren't telling the family anything."

The police aren't telling the family anything because they don't know anything. Something happened, but it doesn't sound like murder.

I'm with DCBartender and Merzydoats. Something fishy is going on - Chief Lanier (and an awful lot of people on this board) are quick to jump to the "savage beating that appears to be vigilante justice" conclusion pretty fast. So why does the medical examiner not call it a homicide? Why did the DC Police cancel the press conference this afternoon? The ME deals with facts, not politics and PR.

I am getting the feeling that the DCPD is either going to circle the wagons and stonewall, or they are going to come out of this looking really, really, bad.

Some things make me suspicious..

Doesn't say if the man was put in the police car or if Ambulance was called, since Howard university is only 2-3 blocks from there.

This 'drunk' victim could have been hit once or twice and hit his head, or he could have had a medical condition.

Everyone judging and speculating about what happened are just throwing hay.

I would place some of the blame on the Police if they put this man in their police car without calling the Ambulance.

its an outrage that the MPD would come out and use such harsh language describing a horrible incident, without all the facts. I am a full supporter of Chief Lanier, but I believe the facts (and evidence) will show they had tunnel vision. For those who have been to DC9, give them your full support. We have stood by them for years, and now is no different. This is a place that not only accepts, but welcomes diversity--- shame on you that think otherwise.

people on here are judging these guys based on what the news reports. nobody here leaving a comment knows what actually happened. they also failed to mention that the cops did not call an ambulance for the guy who was "beaten" and he was immediately put into the cop car. If he had been brutally beaten, then why was he sitting in the car for about 45 minutes before even starting to go to the hospital that's right around the corner?

He died in custody, and they didn't take the guy away in an ambulance either. How did that part happen?

I'm not trying to justify what the club people did, I don't know what happened yet. However, blamecasting by DCPD seems pretty hasty to me.

I don't understand why people are upset about the Post's picture. A newspaper's job is to depict what happened with a reasonable amount of sensitivity -- I don't think that excludes showing a bloody sidewalk.

If it turns out this man wasn't beaten to death, and it's not his blood, then that's another story. But if you just want to be treated with kid gloves, then don't read the newspaper.

Five career, trained professionals that have overseen the safety of literally tens of thousands of people during their combined careers, are distilled to criminals by the press and the uniformed quick to hate. One individual, out of his mind, on God knows what, attacks people REPEATEDLY, with an object that could blind, maim or kill them, and HE is the "victim"? Every criminal profile would indicated escalation in intent and activity. He was out of his mind, if he would have had access to a gun, chances are he would have used it. Then what would the head lines read? Was he running to get a gun? It is a tragedy that this man lost his life, but what would be an even greater tragedy is to destroy the lives of good, decent, family men. I can proudly say I have known Bill for 20 years and had the privilege of working with for some of the best of those years. Numbers never lie, tens of thousands to one.... If this man died due to being properly restrained by trained professionals then a pre-existing medical condition and/or excess of drugs and alcohol together with underlying psychotic tendencies are most likely the cause.

I am kind of torn right now. As a business owner in DC, I have had my share of many unruly customers, once, I chased a guy with a hammer who stole something out of my store. Once, I hit a guy with a bat when he attacked my employee, both times I went to jail, but the charges were dropped (the guys were not killed). These incidents happened 5 years ago or longer, before I got married and I had kids. i have come to realize that this way of reacting is not the way to go. You don't know if that guy is packing or could come back with their crew and shoot up the place. I have learned to let things go and let the law deal with these problems, even if I lose out a little. I feel for the owners and employees of the club, that they probably acted in the heat of the moment, but I also believe that the guy shouldn't have died from breaking a window. My feeling is that the 5 guys will get charged with manslaughter and will do a few years in prison and the family of the Mohammad will get some compensation.

The DC9 staff are super friendly and really down to earth. I've made friends with several of them over the course of more than three years now (including with three of the people in this incident) and I'm at a loss for words.

This really is a tragedy and I hope our city holds off judging the situation until all the facts are in. That includes Police Chief LANIER!

Damn GoonHand, I always thought the Ethiopian community in Washington DC was pretty great and living close to "Little Ethiopia" was the best part of my neighborhood. Anyhow, The charges have been lowered to aggravated assault and the guys are being released. Where's the big press conference now Lanier? How come the media is not as interested in the story as it's unfolding and it becomes more and more evident that these guys are not murderers? I also believe that Lanier's original statements to the press were highly slanderous. Google DC9 the headlines still read man is beaten to death outside of nightclub.

So this guy throws a brick through a window. Could have hit anyone and the DC9 staff chase him down and apprehend him. And now everyone weeps for him? Give me a break. DC is being over run with Hipsters and cause heads looking for anything to cry about. Wait for the coroners report before you start calling for prison sentences.
What we do know right now is that this guy was denied admittance to the club and then threw a brick
through a gigantic glass window (felony destruction of property). This is sad. But there is a lesson to be learned. Don't act like a moron and you won't provoke security.

When the facts of this case come to light, it's going to be clear that this is really just a case of the police jumping the gun. This man had no obvious signs of trauma at the hospital, and after a full autopsy there is still no clear cause of death. The police should use more restraint before making baseless accusations of vicious assaults when the medical experts find no evidence of it. If they had simply spoken to the emergency room physician they would have known their was no evidence of any vicious assault or any obvious cause of death.
