Guandique to be sentenced Friday

The man convicted of killing former federal intern Chandra Levy will be sentenced Friday morning in D.C. Superior Court, putting an end to one of Washington's most sensational murder cases.

Ingmar Guandique, 29, an illegal immigrant from El Salvador, was convicted on November of two counts of first-degree felony murder, one related to Levy's kidnapping and the other related to an attempted robbery.

But in a one-page letter written to a Washington Post reporter and dated Jan. 22, Guandique said he was innocent. The letter, handwritten in Spanish, said the evidence presented by the government and authorities "was false."

"Everything about this case was a stupid, comedic farce that the detectives and prosecutors have engaged in," Guandique wrote. "I know there are people who believe in my innocence and to those people who believe in my innocence I say you are not mistaken, because I am innocent." Guandique said he was a scapegoat.

Prosecutors have asked Judge Gerald I. Fisher to sentence Guandique to life in prison without parole.

Prosecutors wrote in a sentencing memo to Fisher that Guandique "demonstrated predatory behavior that seems incapable of rehabilitation" and that Guandique "posed a grave danger" to the community.

The memo described events prosecutors say involved Guandique and other women -- examples that were not in evidence at trial. Prosecutors said Guandique had numerous improper encounters with women including attacking a woman at knifepoint in El Salvador before migrating to the U.S. when he was 19.

While in prison, prosecutors said Guandique also wrote graphic letters with drawings to female insurance agents and masturbated in front of a female prison guard.

Guandique's lawyers did not make their memo public.

Before issuing his sentence, Fisher is expected to hear arguments from the defense that Guandique deserves a new trial.

Guandique's attorneys from the District's Public Defender Service argued that there was juror misconduct during deliberations. They cited a Washington Post article quoting a juror saying that the panel shared their notes during deliberations because one juror did not take any.

Guandique's attorneys also argued that Assistant U.S. Attorney Amanda Haines focused on prior acts by Guandique in her closing arguments that were not in evidence at trial.
Levy, 24, disappeared May 1, 2001, and the case immediately generated worldwide interest.

Levy was having an affair at the time with Gary A. Condit, the married congressman from her California home town, who was 30 years her senior, and Condit was the first suspect in Levy's disappearance.

Levy was in Washington after having completed an internship as part of her master's degree studies at the University of Southern California.

More than a month after her disappearance, police searched Rock Creek Park for any signs of Levy, but did not find anything. A year later, a man walking his dog in the park found Levy's skull.

Police located more of her remains and some of her belongings, including her sports bra, black tights and T-shirt. But by then, valuable DNA evidence had long since eroded. What little DNA they found on the items belonged to an unknown person and not to Guandique - points made by the defense through the trial.

Without any forensic evidence, prosecutors based their case on two primary pillars. First, they argued, that Guandique preyed on women in Rock Creek Park and that the attack on Levy was part of a pattern. Guandique was convicted in 2002 of attacking two female joggers in the park about the same time Levy disappeared, and those joggers testified at the trial.

The second pillar was the testimony of one of Guandique's former cellmates, who was housed with Guandique when he was serving time for the jogger attacks. The inmate told jurors that Guandique admitted to him in 2006 that he killed Levy.

That testimony was the only evidence during more than three weeks of trial that directly linked Guandique to Levy's slaying.

Someone please explain why our esteemed "leaders" condone the murder of Americans at the hands of illegals.

Don't claim they don't. They protect these society killing leaches by ignoring our immigration laws and also by SUING states which try to enforce our immigration laws.

I thought the new "P C / Change" mob banned any use of the phrase, " illegal immigrant."

How can we get the poor innocents to feel at home if we are not nice to them?

We should feel ashamed for making this poor young man feel so persecuted. Perhaps we can pay reparations to his relatives for ruining his life.

Okay how many different ways and different languages must we speak that says this man is innocent! I understand Guandique has a history of attacking woman but America is supposed to be a land of justice, freedom and equilibrium. Let's hold this man accountable for what he has done, not something that he hasn't. I don't favor illegal immigrants, especially those that commit crimes but I'm also not in favor of those being forced to take the blame for our corrupt congressmen. I hope true justice finds this man, regardless of his past!

All you Bush haters who want to prosecute him as a war criminal might think about whether or not to prosecute Obama for violating the Constitution.

This is a joke -- no DNA evidence? This is absurd. Chandra Levy was more than likely Mossad, hence her association with Condit. The Mossad likes to call female agents like Chandra "swallows" -- cute, eh? Think of Monica Lewinsky. Israeli spying in the US is a big deal and nearly completely unreported by the MSM. This dirty looking convict probably didn't murder Chandra. But he's taking the rap for it. Shameful.

I am all in favor for guilty criminals to face judgement and be punished for their crime(s). But, according to this article, the only "direct" evidence linked to Guandique is that he told an inmate that he had killed Levy?? There is no DNA evidence, no "trophy" at his home, no fingerprint evidence. I know Levy's remains weren't discovered until 1 year later, and any DNA evidence may have been destroyed, but, STILL!! You can NOT convict someone based upon what they SAID!!!

Poor Chandra Levy's family since she has died she has been nothing more then a tool for proselytizing. Agenda's which I am sure would not be loved or encouraged by any of the people directly involved. Maybe one day one of you will lose a loved one that you can turn into a bully pulpit. I just hope you don't get that opportunity.

Wow, no DNA evidence?! I'm leaning towards believing the man; he was set up and is being used as a scapegoat. It's far more likely that the married politician at least hired him to do it to attempt to cover up the scandal.

This is a farce of the justice system. The "two" pillars which is the base of the charges are insane! I came to this country as an immigrant and now US citizen, I have been through this kind of injustice many times. If I had money and US citizenship at the time of the trial, the outcome would have been different. He maybe violent, illegal and may have committed million crimes, but this "murder" charge should be irrefutably "proved" in this age of science and "CSI", especially when he is in custody and we watch so many versions of "CSI" on TV !!!! period !!!!

Did not intend to post twice, sorry. The police can not find their butt with both hands and prove that every time we have one of these cases. They searched that park several times. Or the woman that just recently was found in the very field the police searched in after wandering away from a car crash! Then the body always shows up in the very same place years later? But they can find drug dealers! There is money in that. One hundred for evidence one hundred for me. Leagalize drugs and put police back to police work. Like walking a beat and protecting We The People!

Please help:

The link that brought me here from Google News read that the convicted is getting "TK TK TK". A comment or two here also mentions this mysterious "TK TK TK". The article never stated what the hell that meant. So, I ask the readers:

What is this "TK TK TK"? Nothing I can think of makes sense as something you would get at a conviction or sentencing: Tommy Kildare, Total Kramer, Technical Knock (no "-out" since this isn't "TKO"), Tepid Kaisers.... I don't understand why we can't just write out the words? Then I wouldn't have to waste my time with this comment, and you all would have communicated clearly.

I haven't followed this case closely, but if the only evidence against this guy is the evidence presented in this article, then I think the case against this guy is VERY weak. This guy could very well be innocent.

It sounds to me like the cops tried very hard to come up with anyone just to take the heat off of themselves. This guy is an illegal and a crook, but it does not mean he committed this crime. No DNA evidence? I think the Levy's should think really hard if putting this guy away will give them peace of mind.
