$1.5M suit after Va. police shooting
The family of a man killed by Portsmouth police is suing the city and its police department for $1.5 million.
The lawsuit filed by 60-year-old Marshall Franklin Sr.’s sister alleges negligence and indifference to Franklin and his mental disabilities, including post-traumatic stress disorder and paranoid schizophrenia.
Two months after the February 2009 shooting, Commonwealth’s Attorney Earle Mobley said police acted appropriately in returning fire after Franklin shot two officers.
