Va. inmate suit says they were unfairly denied parole

The Virginia Parole Board is asking a federal judge to throw out a lawsuit filed by 11 inmates.

The lawsuit, which was the subject of a Post story, claims the board has unfairly denied parole to thousands of inmates who were imprisoned before the state abolished parole in 1995.

According to the complaint, board members have ignored a state law requiring them to thoroughly investigate whether inmates have been rehabilitated and should be released.

The state denies that inmates' due process rights have been violated.

A hearing on the state's motion to dismiss the lawsuit is set for Tuesday in U.S. District Court in Richmond.
