The Sheriff's Raid

The ongoing saga about the police raid on the home of the Berwyn Heights, Md., mayor as part of a marijuana smuggling investigation has attracted a large number of comments that suggest our readers are not favorably impressed with Prince George's County's police and sheriff's departments. During the raid, officers broke down the door and fatally shot the family's two black Labrador retrievers.

As Rosalind S. Helderman and Aaron C. Davis report today, police said they have arrested a deliveryman and another man who they say are involved in the scheme to smuggle marijuana by shipping packages addressed to unsuspecting recipients, in this case Trinity Tomsic, the wife of Mayor Cheye Calvo. They have not arrested Tomsic or Calvo, but also have explicitly declined to rule out their possible involvement in smuggling plot, although Police Chief Melvin C. High said, "Most likely, they were innocent victims."

The story has received national attention if for no other reason than an elected mayor's home was targeted by police and doubtless in part because of the shooting of the two dogs, who have strong reader advocates. As a Post editorial said this morning, "...even a cursory investigation prior to the raid might have given the authorities pause about kicking in the door and entering with guns blazing."

Our readers endorse this point; several suggest that Prince George's County will face lawsuits, and others propose that officials should be removed.

We'll start with Berdickersonc, who wrote, "Wow, what that poor family went through... For nothing. Absolutely nothing. I really don't know how I'd ever get over that."

staticphoto said, "I'm glad that the truth appears to have been discovered. I'm sorry that Calvo and family were subjected to both the raid and merciless suspicion---including my own suspicion."

Gidgmom wrote, "I would never forgive those jerk cops for killing my dogs, scaring me and my family half to death or for the bullets flying around the house that they illegally busted into...The cops, their supervisors and the Chief of Police should all suffer some serious consequences. They are lucky they only killed the dogs..."

angelos_peter [I suspect this posting is not really from the famed Baltimore trial lawyer] wrote, "Maybe Calvo should be permitted to break down the door of each PG SWAT team member, tie up all members of the member's family, shoot their family pets, then offer a perfunctory apology."

jimmy_mac said, "...they have cleared all the other folks whose names and addresses were used as sham addresses, but not this mayor and his spouse. If it is the right thing to do for the others, why not for them? Perhaps the county police administration has a hidden agenda which should be explored..."

But nallcando wrote, "Not acknowledging a mistake does not make the department look weak. The kicking down the door and killing of the Calvo's dogs, does! What a bunch of Keystone cops!"

ghokee wrote, "The Sheriff and whoever led that SWAT team should lose their jobs, plain and simple. Good for them, there happens to be an opening for a delivery driver."

Midnight713 asked, "...No one could figure out this was the home of the MAYOR? An elected official? That fact alone should result in a mass firing of the police department."

I wonder if the police raided the Fed Ex Driver's house and shot his dogs??? There were a lot of ways to handle this short of the routine use of massive use of force employed by PG County. If you give boys big toys they will use them unless kept in check.

walkleftstandright complained about the Post, saying, "...if the mayor's wife's last name is Tomsic, it is incorrect (and disrespectful to her) to refer to them as "the Calvos". Surely it should be "Calvo and Tomsic"..."

Taxpayer4 asked, "Didn't the police intercept the package before it was delivered to the house? An undercover police officer then delivered the package to the house. So technically did the police plant the package so they could obtain a search warrent?"

We'll close with halifar59, who wrote, "The Calvo's should have known that whenever you receive a piece of misdelivered mail you should first contract a security company to escort you, your family and pets to a safehouse, hire an attorney, contact the ACLU, place the package back on the doorstep, and then dial 911. If they had followed this simple procedure, none of this would have happened."

As Scott began to lower his arm, one deputy later said, he ‘‘kinda’’ pointed his gun – which he initially was holding by the cylinder, not the handle grip – at deputy Spencer who, in fear for his life, killed him.
Despite a subsequent search of Scott’s ranch using helicopters, dogs, searchers on foot, and a high-tech Jet Propulsion Laboratory device for detecting trace amounts of sinsemilla, no marijuana –or any other illegal drug – was ever found. According to Ventura County District Attorney Michael Bradbury, the purpose of the raid was to seize Scott’s ranch under asset forfeiture laws and then divide the proceeds with participating agencies, such as the National Park Service, which had put Scott’s ranch on a list of property it would one day like to acquire, and the Los Angeles Sheriff’s Department, which heavily relied on assets seized in drug raids to supplement its otherwise inadequate budget.
Scott’s widow subsequently filed a $100 million wrongful death suit against the county and federal government. For eight years the case dragged on, until attorneys for Los Angeles County and the federal government finally agreed to settle with Scott’s heirs and estate.

There had better be some justice at the end of this tunnel. If prosecutors continue to refuse to prosecute these "thugs in blue" then people are going to take things into their own hands. Personally, I wouldn't mind seeing some of these cops swinging by their necks over this.

Jay, Your somewhat realistic scenario you laid out was fine, except in using the standard of "clear thinking people." Police need to be held at a standard much higher than that. "Clear thinking people" can often be easily deceived, tricked, etc. When you're a pro, clear thinking is just a basic requirement and entry-level skill. It appears that minimally, the police involved, MAY have been clear thinking, but they didn't seem to apply even a shred of investigative technique to this case, or have clear situational awareness.

Sorry to tell you but a signed warrant does not give you a carte blanche to bust down doors and shoot anything that moves. The officers can be held liable if they violated dept procedures much less State and Federal law. This is still America!

We need to put on a very fast track the cases against the District regarding their ignoring the Supreme Court ruling on our 2nd Amendment rights.

I would like to purchase at least one gun for every member of my family (now we only have a couple of weapons). We will not go quietly in a similar situation.

Anonymous -- sorry for your situation. Those of us who have lived or currently live in PG County definitely sympathize. Not saying it's right, but at least the issue is being brought to the attention of authorities.

That being said, while not a gun advocate, I will concur with someone else's comments... If the public were to arm themselves and start shooting back, maybe this non-sense will stop. Folks used to arm themselves to protect against criminals -- now we need to arm to protect ourselves from local law enforcement. We must continue to stand up for our rights.

I think we should have t-shirts made that say "F#*K PG COUNTY" with, "Criminals: Jack Johnson; Melvin High; Michael Jackson; PG County Police; PG County Sheriffs Office" and "We support Calvo & Tomsic" on the back. Love the 1st Amendment...

Support your local sheriff. If that doesn't work, don't shoot the deputy. The last I checked our old sheriff was under house arrest and now the new sheriff is busy with sheriffs sales to toss the good people of the county to the curb. We aren't sure who will buy all the empty houses. The whole thing is worse than it looks. Too many people, too little livestock.

This happens all of the time in Prince George's County. In fact it happened to me last August. The police raided my home, tied my mom and dad up and pointed shotguns at their heads. I had just returned from a 9 hour drive from Toronto, when I saw a big fat police officer blocking off my street. I asked him what was going on, and that I lived in that house on the right. He asked, which one, the one with the red bricks? I replied yes. Then he took out a gun and pointed it at me and told me to get out of the car. I complied, then he handcuffed me. He told me that I fit the description of a criminal that they had been looking for (how many times have us innocent black people heard this one), and that he lived in my house. He thought that I was my cousin, who is a criminal, but had been removed from our house since May. I was stunned, then he walked me to my home and sat me down as I watched my parents lay on the ground in handcuffs. They ramsacked the home, busted the door down that we had to fix at our own cost. They found no drugs, no guns, no anything, because my cousin who is now serving 20+ years in prison for murder, had been kicked out the home months ago.

People, this happens all of the time here, and I am happy that finally someone is listening and that it has finally hit National news. The amount of innocent people the police in this county have affected negatively is insourmountable. They do not understand that all blacks are not criminals. But they are brainwashed by their Uncle Tom superiors, and white superiors who train them to think otherwise.

Yet, we are all different. Of the 40 million blacks in the U.S., there are 2 million in prison, so what about the 38 million who are abiding by the rules and are family oriented individuals with positive attitudes towards the world. They never look at that in this country, because the 38 million not in prison, is really Black in America, and not the fools that they showed on that weak documentary showed on CNN 2 weeks ago. We are not all criminals, even though police in PG County treat us as though we are. And the irony in it all is that they are Black sherrifs and Black Swat team members busting down their own Black people's door. For years we have complained about this, but no one paid us any mind. It took a White Mayor to have his door busted down, before anyone would pay it any mind. Go Figure!

No conclusive evidence one way or the other regarding the guilt or innocence of the mayor and his wife has yet been presented, and thus they are innocent until proven guilty. I'm willing to give the benefit of doubt to law enforcement in such a case. However, the lack of even elementary policing in this case is evident, from the news reports thus far. The simplest profiling performed by even a cadet could quickly have determined that the mayor and his wife were not likely suspects requiring excessive force in securing the possible scene of the alleged crime. That law enforcement in this case had taken the time to observe the mayor's home and environment and should therefore have been able to make an informed decision as to the need for excessive force only highlights the lack of elementary policing. Whether or not the mayor and his wife are guilty as suspected... is immaterial: the excessive force, lack of fundamental police practice, contradictory statements by law enforcement agencies, and - most damning - the lack of authority for entering the residence as occurred raise significant concerns about not only the officers involved directly in this raid, but also senior police leadership authorizing this raid. I do hope that the mayor proceeds immediately with a multimillion dollar lawsuit and criminal charges - it will be the only way in which county leadership will take this incident seriously.

Lets see. Some postal employee in Arizona suspects that a large package contains drugs. He calls the police and they bring a dog and the dog alerts to the probability in the package. The package is opened and the marijuana is found. The package is sealed and sent on its way to the addressee which happens to to be the wife of this mayor. The police in Arizona alert the police in PG County. Now it is very easy to criticize because of the outcome but when presented with this fairly easy puzzle most clear thinking people would suspect that the occupants of the house were involved in trafficking drugs. The police-haters would not admit that but put in the position of the police they would suspect the same thing.

So how do you proceed? Stroll over to the house and ask the major if he is involved in drugs? Ignore the whole situation because this guy is an elected official? Let the guy bring the package inside and later conduct an investigation?

This kind of situation happens hundreds of times across the country every day and you never hear about it and the drug guy is locked up. The only reason that you ever heard about this is because two dogs were killed. Had that not happened you wouldn't have heard about it.

The search warrant shouldn't have even been signed, because a package of marijuana addressed to a home, isn't probable cause to believe there is marijuana at the house. Period. With no other factors, no prior involvement, marijuana addressed to a house doesn't imply that marijuana or other contraband is there. Maybe you'd offer your address to posters, so that we could send you some ganja and call the po-po, maybe get your dog, you, or maybe your kids shot?

Two points:

1. If the PG County prosecutor has any guts, he will charge them as you recommend. The warrant was NOT "no knock." Therefore, the way the SWAT team behaved meets the legal definition of "breaking and entering," as well as "assault with a deadly weapon."

2. Because the prosecutor is usually quite chummy with high-ups in the police department, the chances of the prosecutor criminally charging anyone connected to the raid is between slim and none.

Calvo and Tomsic need to lawyer-up with someone who can successfully bring a multi-million dollar lawsuit against PG.

The indifference to life shown by the police in this case is sickening. That no people were killed by the reckless behavior is amazing indeed. I cannot think of words that adequately express my anger over this incident.

And in Easton, MD you can get arrested if you take your shirt off in public. There must be something in the Maryland water.

The incompetence of this police action is only exceeded by the statements, arrogance, and excuses made by the PG Police Chief. I hope this family can gain solace and peace through the thought that others share their grief and anger at what happened. Unless the sheriffs department conducts a completely unbiased review, makes true changes so this doesn't happen again, and severely punishes those who perpertrated this, PG county law enforcement will continue to maintain the lousy reputation they have. As a former Prince Georges County resident, good luck to current residents with this so called police force.

Odd how the Montgomery County police can enter a house full of actual weapons and potential explosives (as they did in Bethesda) without having to break down the door or shoot the family dog, while PG County cops are afraid of a small-town mayor with no known record of crime or violence.

Several years ago, a Fairfax County SWAT team invaded the property of an optometrist who was to be arrested for illegal betting. He had no prior record. A member of the SWAT team bumped his weapon as he got out of his vehicle and the gun went off, killing the unarmed suspect. I guess this Maryland family should somehow feel relieved that ONLY the family dogs were shot to death.

Let's not forget that this is a common scam. People have been sending drugs addressed to innocent third parties for a delivery guy to intercept for quite some time. Most police officers know this. Apparently, though, those in PG county either didn't know or didn't care.

Frank, a civil suit does not require "criminal intent". It can be proven that the officers did not properly execute the warrant or failed in their duty to conduct minimal due diligence. Officers have often punished or let go based on actions that don't rise to criminal.

I would say frank and jay are probably corrupt law enforcement officers - i notice that with this type the laws are always for someone else...

these law enforcement officers could have gotten a no knock warrant and thus been acting semi legally... sounds like they must bend the rules a lot.... as it turned out and they did not have such warrant they are acting in a criminal manner. pure and simple.

otherwise they could have done some actual detective work and solved the crime without such needless destruction...

Hopefully this absurd bit of policing gone bad will be featured in debate on HR 5843, Rep Barney Frank's (D MA) bill which would eliminate all federal penalties for possession of less than 100 grams of marijuana and the not-for-profit transfer of one ounce or less. The "War on Drugs" has for may years distorted law enforcement's view of its reason for being. In too many instances, drug busts are providing a profit center for police agencies at all levels, with asset seizures providing a major part of their annual budgets. It's easy to see why police want the phony War to continue, but cases like this one are proof that it needs to end. I hope the Post will continue to give this the coverage it deserves.

Frank and Jay -- way off base... Maybe you were part of the "tough guy" SWAT team -- who knows... I suggest you and your families be harassed in a similar way and see how you feel then. I guess you'll tell me that you're not drug dealers... This could have happened to any innocent person or family.

They will be held liable -- I'm certain. They claimed to have one kind of warrant when in fact they did not -- period. Facts are facts... And to shoot the dogs in the back suggest the dogs were running from them.

I have no idea how ignorance and common sense got lost in translation. You are right -- this drop ship scheme happens everyday in the US. I'm sure it happens quite a bit in PG (Predominantly Ghetto) County on a regular basis. That being said, the authorities actions were over the top.

And I echo "Context" comments as this hits a lot of nerves on many topics.

I have sent a letter to PG County's leaders suggesting they all resign immediately. Glad I "escaped" the County when I did...

The news conference at 2PM today should be interesting to say the least. I'm certain that the County's ghetto leaders will be the cowards they are and in hiding. In the meantime, feel free to have a look at Calvo's lawyer's response:

As a lifelong area resident I have always warned my visiting African-American friends to be very careful if stopped by the PG police because of their dreadful decades long reputation for ignoring civil rights laws. The only lesson I draw from this is they have become equal opportunity door-kicking thugs. Good to know.

Aside from the most obvious reasons for reader horror over the raid, the incident hit all kinds of emotional hot buttons:

Pets shot dead
War on Drugs
Marijuana laws
SWAT teams/police use of force
Sanctity of home
Sense of powerlessness in a gun-toting world

I'm sure the comprehensive list is longer than this one. But these are, I think, reasons why this story seems to have resonated nationally as well as locally.

Being a cop in Prince George's County is a tough and dangerous job. But when police guns are pulled from holsters, they have just got to do better than this.

I pity the people who live in Prince George's County. It has long been apparent they have almost as much to fear from their own law enforcement officers than they do from criminals. Police in the county are out of control. County residents need someone to protect them from their "protectors."
