The 'might-speak-Spanish' exception
Eugene Robinson isn't mincing words on Arizona's new immigration law. It's "racist, arbitrary, oppressive, mean-spirited, unjust," he writes. "About the only hopeful thing that can be said is that the legislation, which Republican Gov. Jan Brewer signed Friday, goes so outrageously far that it may well be unconstitutional." He goes on:
Activists for Latino and immigrant rights -- and supporters of sane governance -- held weekend rallies denouncing the new law and vowing to do everything they can to overturn it. But where was the Tea Party crowd? Isn't the whole premise of the Tea Party movement that overreaching government poses a grave threat to individual freedom? It seems to me that a law allowing individuals to be detained and interrogated on a whim -- and requiring legal residents to carry identification documents, as in a police state -- would send the Tea Partyers into apoplexy. Or is there some kind of exception if the people whose freedoms are being taken away happen to have brown skin and might speak Spanish?

"One of the concrete problems with the law treating undocumented immigrants as criminals is that it gives those without papers a powerful incentive to stay as far away from police as possible. This will only make it more difficult for local police to investigate crimes and track down fugitive offenders, because no potential witness who is undocumented will come forward."
Can I get some policy, and lots of it?
Does Eugene have any evidence to support his theory?

mwhoke,
Link please?
wtfci,
I'm always in favor of evidence, as sometimes the obvious doesn't occur, but "people who can be arrested on sight will avoid the police" seems like a reasonable assumption to me.

Same thing with the Oklahoma abortion law veto that was overturned by their legislature. The tea party is all for a Govt. run theocracy. They are absolute hypocrites, or they are just lying.

Same thing with the Patriot Act. The tea partiers seem just fine with all sorts of restrictions on personal freedom. They just don't imagine that someday those particular restrictions could impinge on them.
Funny that, considering what a whopping imagination they've demonstrated in so many other areas (e.g., death panels, Obama's birthplace).

wtfci,
The Arizona Association of Chiefs of Police opposed Arizona SB 1070, and they were joined by police chiefs from around the country, who made public statements urging a veto of the law.
Now why would that be?
Obviously, if you create a law where local police are REQUIRED to arrest any person for whom they merely have a "reasonable suspicion" might be in the country illegally, such persons will be far less likely to step forward and cooperate with a police investigation if they been the victim of, or a witness to, a violent crime.

The best part for me is going to be in November, when Republicans try to use the data that Hispanics and Blacks vote disproportionately for Democrats as "evidence" that Hispanics and Blacks are prejudiced against whites rather than that, say, they're smart enough to tell the difference between a politcal party that sometimes neglects them and a political party going waaay out of its way to make their lives as miserable as possible.

Build the fence across the two thousand miles of the border as originally designed by Rep.Duncan Hunter(R-CA) You bloody idiots in Washington are to blame for this mess. They can find billions of dollars to spend on countries that hate our guts, but they refuse to appropriate however much money it costs to construct the fence correctly. It should be two separate fence spread apart with US Border Patrol tracks in between. Instead the morons brought a bunch of virtual equipment that never worked. Now the fools have the deaths of Ranchers, Patrol Agents, sheriffs and deputies on their bloody hands

I would like some help.
Perhaps some liberals could "enlighten" me as to what an acceptable legislation would look like. I would like to know under what circumstances can a country defend its own borders?
Is this becoming a nation that is so paralyzed by the fear of offending someone that national defense is not possible?
What would the legislation look like?

Some might remember a time when the "authorities" who had "reasonable suspicion" could harass people who "looked" Jewish, or had Jewish ancestors, or "Jewish-sounding" names, or who associated with Jews, or sympathized with Jews or were seen thinking silent thoughts that might have had something remotely related to something Jewish, when these "suspicious" people were forced to wear armbands, had their freedom of movement restricted, their livelihoods and personal possessions taken away, were forced to live in barricaded neighborhoods, were rounded up and put on trains that chugged away into the dark of night and a morning of H*ll.
Arizona turned back the clock to the Third Reich.

Is "sane governance" limiting visas for all nationalities except for those that come to work and live without a visa? Perhaps it's little or no governance on our borders or no identity governance. Is the "overreaching" that Robinson worries about the enforcement of existing federal law by the state? Perhaps he worries that the local police can't be trained or trusted to distinguish between whim and reasonable suspicions.

You racists cannot stop the Cha Cha. It is everywhere and it will soon be in your bedroom. Dancing in the streets means the Mexican border is coming down making Mexico the 51st state. Cuba is next. The smell of Taco is in the air and there is no fence big enough to stop the children of Montezuma from crossing over.

I don’t know but somehow this will solve it.
It has been reported Congress intends to debate legislation that will re-classify frequent fliers as a race. This bill will prevent the rampant civil rights violations and profiling at airports. No longer will the TSA be allowed to ask for identification or engage in luggage, pat down or body search without probable cause! Being in possession of an airplane ticket, a boarding pass or speaking English will no longer qualify as probable cause.
The government is finally making good on its promise to be fair to all by bestowing the same rights to its citizens it grants to 15 million illegal aliens it has labeled as the “Latino race” so to award them special rights and privileges.
The Coffee Party claims: With the new bill the frequent fliers will be the “Airo race”. It will put an end to racial discrimination, profiling, infringement of civil liberties by an unrestrained, overreaching government that employs NAZI tactics against its own citizens. It will be wonderful to finally enjoy equal rights!

I love the fact that the blame has been conveniently placed on the federal government by the right. So, when the government at the federal level fails to act (and it hasn't just been this administration, by the way), that somehow makes it okay for state legislatures to pass stupid, unconstitutional laws? Of course it was wrong for the protesters over the weekend to resort to vandalism and they should be dealt with accordingly, but this blame-shift is unbelievable to me. What people in support of the law don't seem to understand is that this isn't an issue of whether you have empathy for immigrants or not- this law targets everyone who looks hispanic, and I'm sorry but it's intellectually dishonest and naive to deny it. You tell ME what could give an officer "reasonable suspicion" to demand someone's papers? No proponent of the law has been able to answer that question yet. This law is mud on the face of our state, plain and simple.

If Mr. Robinson wants to show his bona fides - I suggest he purchase AZ border town real estate and spend his days counting the illegals dashing through his backyard.

The question that I have for Ezra Klein and Eugene Robinson is why haven't you written about and condemned the ugly violence that took place this past weekend in Phoenix, Arizona by those demonstrating against the immigration bill?
You both have written about the potentiality of violence by those associated with the Tea Party movement but any actual violence has not been revealed.
Is it allowable for those espousing progressive causes to result to violence and then the press will then ignore it?
