Anti-HOT Lane Petition Online

A commuter from Prince William County wrote in to advise us that opponents of the process Virginia is following to create express toll lanes along I-95/395 have a petition online. I'll discuss that in an upcoming Dr. Gridlock column, but I thought some of you might like to hear about it now and have an online link.

Dear Dr. Gridlock:

The citizens of the Commonwealth of Virginia are tired of the secretive nature of the study regarding the conversion of the High Occupancy Vehicle lanes to Hight Occupancy or Toll lanes on I-95.

The Virginia Department of Transportation and Fluor Daniels, the contractor, have had numerous "public" meetings at which they tell the citizens of Virginia how this system will work, but they refuse to hold an open forum to allow direct questions from the citizens of Northern Virginia and provide answers to those questions.

It appears that the conversion decision has already been made and these public meetings are merely a method by which our elected representatives can say that the public had numerous opportunities to comment.

Therefore, an online petition has been created in an effort to send a message to our elected representatives that this public-private partnership process and the conversion of HOV to toll lanes must be stopped until the process becomes more public and less private. Citizens concerned about the secretive nature of the process, can register their concern at www.petitiononline.com/NOTsoHOT/petition.html.

I went to last month's VDOT forum in Woodbridge and thought Dennis Morrison, who was about to retire as VDOT's regional administrator, did a good job of addressing as many commuter questions as he possibly could. But there are some important questions that he acknowleded he could not answer, such as how the new system would distinguish between solo drivers who have paid the toll and cheaters. And even though the plan calls for free access to carpoolers, what exactly locks that guarantee into the deal?

So I think there are plenty of questions that commuters should expect to have answered -- in public -- before Virginia proceeds.

I was in Texas, and they built a freeway in Houston where you have to have an EZ Pass to be on the freeway -- you can't pay cash. That would solve the problem of "cheaters" vs "non-cheaters". Traffic keeps moving at the entrances/exits by use of the EZ Pass.

Falls Church is about to start morning and afternoon closures of one lane of Route 7 in each direction, for utility work that will go on until December. Thousands of cars and several Metrobus routes will be affected.

I don't mean to tell you your job, but I think it would be valuable to see some reporting on this work. How does Metro intend to adjust to the delays? What alternate routes are available? Are the nearby neighborhoods prepared to deal with a lot of cut-through traffic?

Finally, you might look into the reasons for this project. Basically, it's being done for aesthetic reasons. Falls Church is burying the utility lines outside a new condo complex. Interestingly, though, this new condo complex has been unable to pre-sell its units and is on the verge of failing before it ever opens. Is this really the best use of our transportation dollars?

See? I've been saying this since the first day of these discussions. EVERY time there is any construction project - road, residential, commercial, or anything at all - the "public hearings" are a farce. By the time the proceedings get to the "public hearings" stage, it's ALWAYS, without fail, already a done deal. The politicians have already rammed it through, despite the so-called "public hearings."

But I do have another question for the people out there. People don't want HOT lanes. People don't want abusive driver fees. If the politicians said they were raising taxes, there'd be a huge public outcry. Obviously, nobody wants to pay for road improvements.

What suggestions do you have for our elected officials in order to improve the road system that does NOT involve money? Please do not answer with something like "Any solution is going to cost money." It's obvious that every solution in which people must part with their money is going to cause a public outcry. What solution does anybody have that will NOT have anything to do with money, thereby gaining the approval of the public?

There are several ways to do HOT lane enforcement. All methods have to distinguish between three groups 1) violators, 2) Tolled 1 and 2 occupant vehicles, 3) 3+ occupant vehicles who don't pay anything.

Most HOT systems use one of two methods. The "Denver" method is in use on the HOT lanes on I-25 between Denver and Boulder. Here HOV and tolled traffic seperates into different lanes approaching the toll collection point. The tolled lane works just like a standard E-ZPass lane in that it deducts the appropriate toll from your account if you have a tag and snaps a pic and mails you a bill/fine if you don't have a tag. HOV people are free to go through this lane if they are stupid...since they will either have to pay the toll and/or a fine when they shouldn't have to pay anything. But that's their problem. The HOV lane is just a bypass of the toll lane where you do not get charged. This lane will have a built in parking slot for a couple of police cars and they will be there often doing enforcement checks. If they see 3 people, then they leave you be. If they see less than 3 people, they will pull you over....since you are not HOV, and you did not pay a toll, you are a violator. This method is the simplist to enforce, since police only have to check some of the cars for HOV compliance. But there are 2 big problems. 1) It can cause traffic jams if the HOT lanes are near capacity and the ratio of HOV to tolled cars isn't quite 1 to 1. Even if it is one to one, some disturbances to traffic flow can occur since cars need to "sort" themselves. The other problem is that it is very easy for a toll vehicle with less than 3 people to swerve into the HOV lane and not pay the toll if they see there is no cop manning the HOV portion.

The second way to do it is the "San Diego" method. Here, everyone passes under the same toll collection point, and there is no "sorting" of traffic. If you are a solo driver or have one passanger, you drive under the toll collection gantry and the toll is deducted from your E-ZPass account. As you pass the toll collection point, a green light flashes to alert police enforcement people that you have paid the toll. If you have 3 or more people in the vehicle, you (better yet, your front seat passanger) "bag the tag", meaning you remove the E-ZPass tag from its velcro strips and place it in the read protect bag you got when you joined E-ZPass. When you pass under the toll collection point, your tag is not read and no toll is charged since the tag cannot be read. But since there are many valid users who do not pay the toll, there is no automatic violation enforcement system to take a picture of your car and mail you a bill. All that happens is a red light flashes when you pass under the toll collection point (no, the driver does not see this red signal). The police on enforcement duty, upon seeing the red signal flash, will then count the number of occupants. If they see 3 or more, then they know you did not pay the toll because you were HOV. If they see 1 or 2, they can pull you over. This method does not introduce complications to traffic flow due to "sorting", and it is much harder to cheat and not pay the toll if you see there are no officers at the toll plaza (how fast can you take your tag off and put it in the bag and fold the bag closed?). Enforcement is a little trickier though, since officers have only a short amount of time to count upon receiving a signal that no toll was paid.

All enforcement systems can also use police with handheld computers downstream from the toll collection point. The handheld computers will read the E-ZPass tag on an approaching vehicle and determine if a toll was paid using that tag within the last few minutes. If no toll was paid, or if no tag is mounted on the vehicle, then the officers count. If they see less than 3, they pull you over. These checks can be done anywhere downstream from the collection point.

Putting aside my lengthy description of enforcement, my opinion is that HOT lanes on I-95 are a bad idea, however they might work elsewhere, like on the Beltway. Most HOT lanes are conversions of existing underutilized HOV lanes, where politicians let non-HOV's purchase unused capacity in the lanes rather than let the lanes sit idle. In the case of I-95, the HOV lanes are not underutilized by any stretch of the imagination. There is no spare capacity.

I don't think the HOT lanes are a good idea because traffic flow is already smooth on 395 compared to the rest of the region. This project, with all the construction, will only make things worse before better (as if it really could get better than it already is).

Anyway, on a lighter note, I may have found a prospective job. Now I just need to find a place to live, and I can be out of here by next March, or no later than June.

Interesting post, "Woodley Park." Thanks for that. I've been wondering about this issue for a while because it seems to me that photo-based enforcement would be highly impractical given that the camera may not be able to pick up the presence of kids in the back seat. I initially thought to myself that maybe an infrared system might work, but then I realized that the engine and exhaust system make that impractical.

Regarding kids in the HOV....I recall that one of the most spirited discussions under the previous Dr. Gridlock (Ron Shaffer) came back in the days of "Project Hero" (the system where you called in to rat on HOV violators and they got sent a letter) when some turkey wrote in that his carpool always had reported, and would continue to report, people who were carrying kids, regardless of the law, because in his view carrying kids does nothing to relieve congestion. If that issue were to come up again in the blog era this site might get overloaded!

BTW, forgot to mention, I also am wary of HOT on I-95/395, but for a different reason. I don't like the idea of narrowing the lanes and taking away one of the shoulders.

Woodley Park, Now that you've explained the two different ways to enforce HOT lanes, I've realized that I've seen both methods in real time, one in Denver and the other in Souther California. Some of the Orange County toll roads use the same method of enforcement as San Diego does per your earlier comment. I think you are correct in that the San Diego method works better because there is less "sorting" of traffic. Sorting of traffic complicates matters and slows traffic, particularly if there are alot of out-of-towners driving along the route. And on I-95 in VA, there are TONS of long distance drivers on most any day.

I don't really have an informed opinion but I'd have to say that I probably stand slightly for" HOT lanes overall for one reason. I think they'll add additional road capacity on I-95, something that is so desperately needed. If this HOT lane proposal down to Fredericksburg falls through completely, we may never get to see the new lanes built south of their current endpoint near Route 234 Dumfries. That said the additional of HOT lanes doesn't effect me all that greatly so I'm not sure how much of an informed opinion I have.

I don't understand why folks are apprehensive about them for the reason that the shoulders will be eliminated. I realize that car breakdowns are inevitable but with a good force of VDOT trucks patrolling for breakdowns and other incidents, one can quickly remove disabled vehicles from the travel lanes.

Overall, I think road capacity could be increased on nearly every major interstate in this area if we reduced/eliminated certain shoulders. All in all, this would be a great asset to traffic flow. Coming from the west coast where shoulders are smaller to non-existent, its always amazed me how much space is alloted for shoulders on DC area roads. (The largest shoulders I have ever seen though are on I-695 on the northwest side of Baltimore; they could easily add TWO more lanes in each direction given how wide the shoulders are.)

Actually, you might be surprised just how advanced automatic "vehicle occupancy counters" are. I'm not sure what technology they use...I'm assuming some combination of infrared and artificial intelligence, but supposidly the things' accuracy rates are well into the 90% range. Of course, still not good enough to use for automated enforcement, but probably good enough to "assist" live officers.

About shoulders...these are important safety features. A full 12-foot ridge shoulder is required on 2-lane interstates, and both sides for wider highways (exceptions can be granted by FHWA for small segments). The FHWA is not very keen on allowing them to be converted to travel lanes. One only needs to look at how much better traffic has been on the Wilson Bridge when a vehicle becomes disabled to see why. Sure, you could send out a tow truck, but even if it takes 5 minutes for the truck to get there, that could still cause a major traffic disruption during rush hour. Therefore, commutes might be better than now 85% of the time, but be far worse than now the other 15% of the time. In general, people don't like that much unpredictability in their commutes. It should be noted that a special FHWA waiver was required to allow use of the I-66 (and likewise, I-264 in Virginia Beach) shoulders during rush hours. The waiver was granted when VDOT certified that using the shoulder was only "temporary" until they could widen the road. FHWA is a little upset with VDOT for taking their sweet time on I-66 improvements, and are therefore not likely to grant any special waivers to Virginia for interstate shoulder use anytime soon.

Like Metro riders, HOV users are a spoiled, whiney group whose sense of entitlement never ceases to amaze.

Already a "priviledged character" group, they feel actually entitled to the exclusive use of a right-of-way built and paid for by ALL taxpayers as payment for for their "choice" and want to cry and whine at the thought of (horrors!) actually havng to share it with a group of taxpayers who would be willing to pay extra. Who do they think they are?

What is REALLY needed is a petition to end HOV. HOV has been rendered obsolete by scattered workplaces and flexible work hours - only a minority go to work in the same place at the same time. Give EVERYONE who PAYS for the HOV lanes the right to use them and send these whining self-entilted crybabies packing

The HOT lanes will just create more jams on the parallel local roads. People who can afford to use the HOT lanes will further jam the regular lanes and that will cause overflow on to the local roads - US 1 in VA will be a perfect example. If you want to see what will happen try it on any Thursday night/Fri during the summer. The regular lanes are at capacity, reducing traffic on the HOV to accommodate only LEXUS lane traffic is counter-productive.

I wonder if you'd hear the sample complaints about HOV/HOT/Congestion Pricing if you were in Europe or another country. I think our culture still has the me-first attitude and doesn't think about the greater good for society, the environment, or even just your neighbor!

Wow. People are upset over other HOV drivers who are transporting kids? That is absurd - the law is 3 people, if you have 3 people you are in compliance. Seems pretty cut and dry to me.

I've never understood why, in the discussion about having HOT lanes, the assumption is that carpools should not have to pay the toll. It seems to me that having a toll is itself an incentive to have a carpool- so you can split the toll up among them riders, and each pays less than they would if they were driving alone. Why not just let this incentive work on its own merits, rather than implementing some kind of complex car-occupant-counting system?

Think about it- if the toll is $1, and you have 4 people in the carpool, if the system allows you to avoid the toll because you have more people in the car, you're only saving each person an extra 25 cents.

If the carpools don't have to pay, then "HOT" is the wrong term (it means "high-occupancy toll"). I believe so-called "express toll" lanes are in use in some places and are what Maryland has in mind, i.e., lanes where if you want to use them, you pay regardless of the number of people.

Virginia simply prefers the HOT model. I don't know what went into the analysis.

Everyone who pays for the HOV lane can use it. Just stop by a slug lot and pick up a passanger or two and you can use it, for free!

Studies have shown that the HOV-3 lanes move more people during rush hour than the regular lanes. Transportation systems are for moving people, not cars. It therefore makes sense to let the cars with the most people have unimpeded access to priority lanes, since they not only take cars off of I-95 but all the local connecting roads as well, and they also relieve pressure on parking lots and garages in DC and Arlington. Any other solution, whether it is allowing single occupied vehicles (driven by the rich upper class) to buy the right to skip the trip to the slug lot, or opening up the lanes to all traffic, will mean the total number of cars on I-95, local roads and DC garages will significantly increase.

So quit complaining and pick up some slugs...or ditch your car and get a free ride!

Great concept on enforcement in every other place excpet here. However, the biggest difference in Northern Virginia is these HOT lanes on I-95 will have NUMEROUS entry/exit points. Are you suggesting they put police at every entry point 24 hours a day/365 days a year? If the police are overwhelmed now trying to enforce HOV-3 now, why do you think they will have a better enforcement with toll lanes. And since this toll lane is owned by a private contractor, why is it the Commonwealth has to provide the enforcement method.

HOT Lanes are a bad idea on many levels. First off, there is no incentive to use mass transit. Second, the proposed plan increased greenhouse gases through promotion of SOV. Third, there is no hybrid exemption, the only viable personal vehicle that cuts emissions over conventional vehicles by at least 80% (yes, Dr. Gridlock, you got it wrong in your column when you wrote that hybrids were HOV exempt because of fuel economy - it would be nice if you corrected it).

The underlying problem with the HOT proposal is that there is no opportunity for a public forum with questions and answers until mid-2008, only 2 months before planned constuction. There is insufficient time to apply public concern.

Taking publicly paid for roadways and turning them over to private firms some years down the road (pun intended) is not what the original taxpayers had in mind when their wallets were pried open the first time. Now their children's piggybanks are going to be raided just in order to pay for their hard working parents to be able to commute to their place of work. This is a double dip on the American taxpayer's wallet, and might end up being a third dip, if it ever comes to bailing out the private firm.

It is time to toss some tea into the harbor and rebel against this high-handed maneuver by VDOT on the citizens of the Commonwealth of Virginia!!!

The enforcement could probably be set up with a minimum number of toll collection points. For example, one toll collection point between the Lorton exit and the Beltway interchange would serve anything and everything south of there. Lets say you are heading north, regardless of where you get on in Dumfries, Dale City, or Lorton, you cannot get back off until you get to the Beltway flyover ramp exit. Now lets say you enter at Dale City. As you enter, an E-ZPass reader is positioned over the ramp. That reader does not collect a toll, it simply informs the system that you entered at Dale City. This way, when you arrive at the toll collection point, the readers there know where you got on and how much toll to charge you. If you don't have your tag mounted at the Dale City on-ramp, then you would probably get charged the max toll at the toll collection point, which is your own problem. At the toll collection point, regardless of how much you get charged, that is the one point where checks can occur since everyone is either paying or is HOV-3 at that point. Another collection point would be between Shirlington and the Pentagon.

You evidently have not seen the proposal by the private contractor Fluor. In order to sell this load to the Commonwealth, Fluor has proposed a multitude of on-ramps and off-ramps to facilitate the greatest number of paying customers as well as buses. IT IS NOT ONE ENTRY AND ONE EXIT. With this configuration, if you have state troopers at one entry point, the cheaters will simply continue on to the next entry not manned by state troopers and get on there. Enforcement is the one question both the contractor and VDOT cannot or will not answer and yet both are still moving forward with implementation. ANSWER THE QUESTION BEFORE THE CONTRACT IS SIGNED. Instead, Fluor and VDOT simply put the citizens of Nothern Virginia off by saying that technical advances will assist in enforcement and until then police will enforce useage. This hasn't worked on the existing HOV lanes and WILL NOT WORK on the toll lanes. This is exactly why the HOV-3 community is demadning answers BEFORE the contract is signed. Otherwise, once a contract is signed, Flour will acknowledge enforcement is too technically difficult and move to eliminiate HOV-3 and slugging. The resulting grid lock will be dramatic but there will be nothing we can do about it because Fluor has a contact to operate for the next 60+ years. Also be aware that this toll will be charged 24 hours a day, 365 days a year, not just during rush hour. If you want to use the existing HOV lanes on Saturday morning, you will pay. Also, these lanes will be PRIVATELY OWNED. If there is an accident on I-95, the Commonwealth cannot simply open them up to relieve congestion. If you want out of the congestion, you will pay and pay big. This conversion can be disastrous to the traffic of Northern Virginia and the General Assembly will not be able to unring the bell and go back to HOV and slugging. We only have one opportunity to get this right. Let's not find out we didn't get it right after a legal contract is signed and the taxpayers of Northern Virginia will pay to get out of it, if at all.

The toll calculation method "Woodley Park" describes would surely work from a technical standpoint in determining distance driven, since it's basically the same method used when you use E-ZPass on a "closed system" toll road, that is, a road that uses the "ticket system" for cash-payers (New York Thruway, New Jersey Turnpike, Pennsylvania Turnpike, Massachusetts Turnpike, Maine Turnpike, etc.).

The point the anonymous responder makes regarding enforcement (setting aside all the rhetoric) is valid as well. There has to be some relatively fool-proof mechanism to ensure that an entering vehicle either has three people or pays the toll, and it sure seems like we don't have such a mechanism at the present time.

I was under the impression, however, that exits and entrances would not be added to the existing express lanes inside the Beltway (indeed, it would seem that there is no room to do this and that it would be unsafe). From a practical standpoint, though, it makes sense to me that as you extend the lanes further south you have to have more exits and entrances to make the lanes a viable proposition--if you get on at Exit 130 (VA-3), for example, and you can't get off until Springfield (40 miles later), you've massively limited the utility of those lanes. Compare this to getting on in Occoquan (Exit 160) and exiting in Springfield (10 miles later). While it's useful to restrict the capacity of these lanes to some degree, it's self-defeating to restrict it by too much.

A question that comes to my mind is how they intend to sign these lanes. Virginia isn't known for good signage that is helpful to people not from the area.

To all discussing the cost of tolling and the number of toll collection points, understand that this is dynamic tolling, and sections of the proposed HOT lanes will have rates ever changing depending on demand. Suggesting a toll of $1 split among a carpool of 4 sure makes a 25 cent trip seem "cheap" but the reality is the estimated cost of a one-way trip could be as high as $40 during rush hour.

Even if you don't use the lanes, as a citizen of the Commonwealth, you should get informed and pay attention to what is going on here. VDOT is fundamentally changing the way it's managing transportation with this public/private partnership. As someone who has been going to meetings/hearings for 2 years now, there are still key issues that VDOT doesn't have answers for, and yet publicly state intentions for a 2008 start.

I do not have confidence in VDOT's ability to make the contractual agreement that will protect the interest and wallets of the citizens of Virginia. A contract with a 60 YEAR term???!!!! This will cost the citizens MORE (everyone in this entire Commonwealth) in tax dollars to bail out a failed venture.

Where is the public disclosure here? Here is a quote from the online petition (my input to putting the petition together) that makes my point as to my concern for the lack of information made available to the public:

"The information should also contain details for understanding the implications to all citizens, financial or other, should this Private-Public partnership not meet the requirements of either party. Without terms of agreement, details, and the opportunity to vote on potential financial repercussions of a failed partnership, we question whether VDOT is acting in the best interest for all citizens of Virginia."

This HOT lane issue doesn't pertain only to those in Northern Virginia and those that use the lanes --- this is a Commonwealth issue.

If you want to give free access to carpoolers in a system where transponders (ie SmartTag) is used to pay the toll, you could do this by:

1. Forcing all persons (carpools and non-carpools) to pay the toll by placing SmartTag transponder readers over the toll lane at multiple locations
2. Having a manned tollbooth for carpoolers along the route where a VDOT person would verify that X passengers are in the car and refunding the cost of the toll to their SmartTag account

-Violators would be caught by placing pressure sensors at points along the road and photographing vehicles that don't have valid SmartTags

Maybe the writer from Montclair has something here. Why is everyone except VDOT writing in to give suggestions on how this company can collect tolls from the HOV-3 vehicle from the single driver? Isn't this something that the contractor and VDOT should already have a solution for and can explain fully right now if they are implementing in 2008? Why implement in 2008 if they can't explain how they will do it right now? Is it a secret covered under a non-disclosure clause Fluor makes VDOT employees sign?

There are several things VDOT has not told you about this plan. They havn't told you that the tolls will be in effect 24 hours a day, seven days a week. They haven't told you that they will identify the number of people in the cars by photographing them. They haven't told you of the risk that the lanes will become more congested as a result of dumping individuals who previously slugged onto I 95. Here is a simple suggestion on how to raise the funds to improve the roads in VA. Increase the gas tax by 10 cents a gallon and put all the money towards improving our roads and public transit systems. When gas was under a dollar a gallon not that long ago an additional 10 cents was a fairly big deal. When it fluctuates by 30 cents a week, most of us will never even notice it. Increasing the tax by a nominal and applying ALL OF IT to improving our roads and public transit systems will eliminate the need for hairbrained schemes like the HOT lanes.

Oh, they'll raise the gas tax alright. And every cent raised in Northern Virginia will go straigt to Richmond and we might see a few cents on the dollar returned to Northern Virginia to help on transportation. The vast majority of it will go to pave every dirt cow trail in the southern and western part of the Commonwealth. And this toll road is just another tax on Northern Virginian that will end up going to everyone else in Virginia except us. I think a new gas tax that was the intent by the General Assembly when they passed the abusive drivers fees. They knew that no one supported a gas tax increase, so they foisted the drivers fees on everyone. Now everyone is up in arms, so the General Assembly will now suggest a 2 or 3 cent increase in the gas tax to replace the abuse drivers fees and everyone will suddenly be all for it. The day the General Assembly says we can raise the gas tax and every red cent will stay here in Northern Virginia, then I'll wholeheartedly support it. Until then, the thieves from Richmond can keep their grubby little hands off my money. I'm tired of it all going everywhere except here in Northern Virginia where it belongs.

Hot lanes are not a good idea for No VA. The slug lines have been working for 30 years moving a great deal of people into and out of DC. Adding HOT to the HOV lanes is not going to improve traffic and will only add to the congestion and pollution in the No VA area. For drivers who can afford to pay the toll, the slug system will be greatly impacted, riders will be unwilling to wait a long time for a ride and then face a longer commute on teh HOV lanes because of the addition of single drivers paying a tol. The end result will be the riders will abandon the slug line, start driving and add more cars to the regular lanes.

Hallo! Es hat sich doch gezeigt, dass die 301 Umleitung einer minus-31 Domain nichts bringt weil die Seite auf die umgeleitet wird auch auf Platz 31 landet. Wenn nun jemand seine -31 Domain auf meine Domain umleiten wurde um mich als Konkurrenten zu argern, gabe es fur mich keine Moglichkeit diese Manipulation herauszufinden.
