It's official: Obama admin will sue Arizona

So it's official: Obama's Justice Department will announce this week that it's suing Arizona to overturn the onerous immigration law.

In case you doubt that this will revive the national yelling match over immigration, the two Republican Senators from Arizona, John McCain and Jon Kyl, are already out with a statement bashing the decision as proof that the Obama administration is weak on enforcement:

"The American people must wonder whether the Obama Administration is really committed to securing the border when it sues a state that is simply trying to protect its people by enforcing immigration law.

"Attorney General Holder speaks of the 'federal government's responsibility' to enforce immigration laws; but what are the people of Arizona left to do when the federal government fails in its responsibility?

"The Obama Administration has not done everything it can do to protect the people of Arizona from the violence and crime illegal immigration brings to our state. Until it does, the federal government should not be suing Arizona on the grounds that immigration enforcement is solely a federal responsibility."

It will be interesting to see how directly Obama takes ownership of the lawsuit, given that it's being initiated by his Justice Department, which in theory makes such decisions independently.

The White House is reported to be worried that Obama's dip in popularity among Latinos will adversely impact the 2010 and 2012 elections. Harry Reid also needs big Latino support to win reelection. Hence Obama's recent high-profile speech on immigration reform. In that speech, Obama didn't lay out any specific policies or timelines, leading many to speculate that immigration reform may not move this year.

But a major, high-profile lawsuit like this one could do nearly as much as a legislative push on the issue to excite Latino and other Dem base voters, at least in the short term. It could restart the national argument over immigration, push the issue to the forefront again, and demonstrate the Obama administration's willingness to use the power of the Federal government to defend Latinos' civil rights. Gonna get hot.

UPDATE, 2:35 p.m.: It's officially official: Here's the lawsuit [pdf] that Obama's Justice Department has now filed against Arizona.

John McCain is just a depressingly sad man. Today he said that we should deport more illegals as part of his immigration plan. He also said "no amnesty" when it comes to his plan.

I really am starting to wonder how he thinks he can pivot to the general after this. It's really pathetic.

1. The suit isn't about "defend[ing] Latino's civil rights". The AZ law would impact the Dems' attempts to gain new voters. That - and helping companies maintain a cheap labor force - are all this is about, nothing more.

I like John McCain, but he swings both ways on immigration.

The fact is, America is firmly against amnesty, mostly because we tried it before and all it got us was more than twice as many more illegal aliens.

But all these politicians want the latino vote, so it's a situation where Republicans will promise anything, but illegal immigration is not ok with Americans.

I agree with this lawsuit. SB 1070 was just a gimmick to get Jan Brewer re-elected, and it should be thrown out. She has no respect for the constitution, or for the people of Arizona. She just wants to keep her fat government paycheck at any cost.

Illegal immigration has actually decreased in Arizona, but Brewer has to make it seem like Arizona is under siege in order to distract people from her failed economic policies.

Now he won't even defned America's southern borders from massive illegal penetration....and worse he is legally attacking those that WOULD protect America. The Midterms cannot come quick enough.

Obama is losing an 80yr-old white guy who was raised Demo but has learned to vote Rep when necessary. Demos quest for more cheap future votes will lose me. It is a crux issue. I'll probably stay at home in Nov 2010 and 2012.

Woe is me and woe is the country. They're handing the country over to another George W Bush, and that will put us on an even steeper slope in our falling behind China in every way that anybody keeps score.

It's not a lock for the DOJ to win the Arizona suit since it's only about a state enforcing a federal law that the feds won't. Either way, why do both major parties remained locked in negative-thinking non-solutions to the festering U.S.-Mexico problem when they can easily unite behind the positive-thinking Megamerge Dissolution Solution of turning Mexico into the next Hawaii, only several new states not just one? The lawsuit states ‘A state may not establish its own immigration policy or enforce state laws in a manner that interferes with federal immigration laws.’
If this was true, then why does the federal government not file lawsuits against states that have legalized marijuana? The federal law does not legalize the possession or use of illegal substances.

S.B. 1070 does not interfere with federal law. The only purpose of this federal lawsuit is to appease the Latino voters. If President Obama really cared about getting comprehensive immigration reform, he would have done it when he had the sixty votes to get it passed. Obama spent over a year shoving his socialistic health care down our throats and did not mention one time anything about illegal immigration reform. For the most part, only the educated Latino’s realize this, and can see through this administration’s rhetoric. The federal government exploits them just as the companies that hire them for lower wages without benefits.

The federal lawsuit further states that ‘S.B. 1070’s mandatory enforcement will conflict with the federal government’s careful balance of immigration enforcement priorities and objectives.’ This is an outright lie. How can S.B. 1070 interfere with federal laws, when the federal laws are NOT being enforced? The Obama administration stopped funding the building of the fence, stopped ICE from investigating companies that hire illegal immigrants, and its measly offer to send the National Guard to Arizona is nowhere near the amount needed. It is a slap in the face to the governor of Arizona.

President Obama ignores his duty to protect the citizens of Arizona and the other Border States by securing our borders. His administration lies when they say the borders are more secure now.

President Obama does not even have the decency to pretend to care by visiting Arizona and seeing for himself the dangers that these citizens are exposed to by the drug cartels. While our country is in a financial crisis, Obama ignores the costs that illegal immigrants impose upon the taxpayers of the Border States which include health care, education, and the criminal justice system. President Obama is gambling on the fact that a terrorist does not cross the border with a dirty bomb or some other plan to kill Americans. When President Regan gave amnesty to millions of illegal immigrants the federal government promised to secure our borders, and to date our borders are still not secure. It is the president’s constitutional duty to secure and protect our borders, and keep our country sovereign. In regards to immigration reform, President Obama and the progressives in congress only care about the outcome of the 2010 and 2012 elections. The majority of the American voters will not allow amnesty before our borders are secure, and congress realized this after their 2006 attempt failed.

How to end the problem of illegal immigration? If you hire an illegal you go to jail. Minimum sentence five years mandatory. No ifs,ands,or buts. Anything other then that is BS. They come here to work and make money to care for their families,something we also do.And yes some are criminals,however; most just want a better life for themselves and their families.So, if you put the people that hire them in jail, you will not have that problem.

It is inarguable that no goverenment interest is more compelling than the security of this nation and its people.

The "power" or "authority" to initiate conflicts or control the escalation of conflicts resides with the EXECUTIVE BRANCH.

When the President exercises this power to protect the welfare of illegal aliens (noncitizens) over Americans (citizens), it is dereliction of his duties.

Perhaps Arizona citizens are in the same category as embryos....therefore, he doesn't need to protect them. It is also his job to uphold the law....whether he likes the law or not.

I still say.....impeach him. In the absence of our ability to do that....vote out his puppets in Congress in 2010 and then vote the man/boy out in 2012.

Where does WaPo come up with such "journalists" like Greg Sargent? As soon as I read the opening sentence of his article, saying "it's suing Arizona to overturn the onerous immigration law." That's where I stopped reading it.

Hey, Sargent, how much was the bribe you took from the Obama admin to shill for it? "Onerous," my arse. What's so goddamned onerous about defending Arizona against illegal alien invaders?

Mexican nationals have taken over three Arizona counties the size of the entire state of Delaware. Obama's duty is to PROTECT and DEFEND U.S. citizens. But what does that Commie-fool Obama do? HE ABETS THE ENEMY! And files a lawsuit to help the illegals!

Obama must GO! NOW!! Not wait till 2012 to vote him out of office. IMPEACH and PROSECUTE that TRAITOR serving foreign nationals here illegally!!!

United States Constitution, Article VI, Clause 2:

"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."

This clause asserts and establishes the Constitution, the federal laws made in pursuance of the Constitution, and treaties made by the United States with foreign nations as "the Supreme Law of the Land" (using modern capitalization). The text of Article VI, Clause 2, establishes these as the highest form of law in the American legal system, both in the Federal courts and in all of the State courts, mandating that all state judges shall uphold them, even if there are state laws or state constitutions that conflict with the powers of the Federal government. (Note that the word "shall" is used here and in the language of the law, which makes it a necessity, a compulsion.)

This law is a blatantly unconstitutional power grab on the part of Jan Brewer. The Justice Department is doing nothing more than reminding this not overly bright individual that only the FEDERAL government has the right to enforce FEDERAL laws.

The U.S. Constitution has a supremacy clause. That means that the states cannot stop the federal government from doing its job, when it is actually doing it. It does not mean that the states are to roll over and play helpless. It does not mean that while the federal government holds the ball, the states are to sit by and do nothing.


It is apparent that the problem with illegal immigration is really all about human trafficking. This is the only thing that makes any sense. It is the only conclusion that engulfs all of this insanity. It is about modern day slave-trade.


Clinton and both Bush presidents, did nothing to stop illegal immigration. And now the federal government, under Obama is attempting to stop states from protecting themselves from illegal immigrants, invading their states and harming their citizens.

There are countless rich business people, like FOX news owner, Rupert Murdoch, who are all for allowing the illegal immigrants to stay; as well as many people in congress. The Mexican president is even fighting for it, and on the floor of our U.S. Capital building.

Our own justice department is twisting the U.S. Constitution "supremacy clause" to mean that individual states no longer can defend themselves from foreign invasion, because it is the job of the federal government to protect us. Forget the fact that allowing the U.S. government to protect us, does not mean that we cannot protect ourselves. Are we to believe that if illegal immigrants break into our homes, that we cannot do a thing to protect our own homes?

Basically, the federal government wants to tie the states hands, while it sits on its own hands. The federal government believes that it is their ball and they can stand there and hold it as long as they wish to. It is time that the states all get together and sue the federal government for not doing its job, which is clearly stated in the U.S. Constitution to defend us from foreign invasion. It is time that the states all get together and toss this federal government out on its illegal rear-end!

It is all too obvious, that mega money is exchanging to bring the cheap labor to this country and to keep it here.

Did you ever ask yourself why your Administration does have the manpower and OUR money to sue ARIZONA'S Governor for stepping in to control the violence, drugs and illegals flowing into Arizona for years while your Administration refused to do its job - CONTROLLING THE BORDER - but your Administration does not have the money and manpower* to meet the citizen, political and law enforcement requests of ARIZONA for protection by controlling the border????

Speaking of counter productive and ill advised Mr. President, this is gaming all citizens and the height of hypocrisy and should gag every American voter thru to November.


*the full 520 men provided in lieu of the 3,000 requested (520 for only 2 months while the government scales up and then scales down over the full period) on a 3 shift per day 7 days a week equals 173 men on duty or roughly 1 man every 3 miles for 10 weeks and obviously a 7ell of a lot more spread out for the majority of the time!!

Aw, honesty. No trying to hide the fact that this lawsuit is purely political; purely to try to get the Hispanic vote...not to solve the immigration issue...just to get votes. How refreshing.

Comprehensive Immigration Reform simply means more amnesty - which has been done before in the 80's - what wasn't done after amnesty was the Feds to keep the promise to go after the employers and to secure the borders. This time will see no difference.....the Hispanic Vote is more important to the politicians then to secure the borders, defend the United States vulnerability on those borders and protect legal citizens of birth and naturalization.

And ain't it funny how the New Homeland Security requirements for Drivers Licenses requires proof of citizenship ...Birth Certificates, Marriage Licenses, Two proofs of residence with YOUR name on it or an affidavit by the person whose name is on the proof...but Register to Vote? No proof of citizenship required in all but TWO of our states.

Its okay to harass legal citizens who simply want a Drivers License but not okay to question someone stopped for suspicion of Crime A who appears to also be suspect for Crime B to prove THEIR legal status?

Hey Obama.....if those US Citizens you're so concerned about don't run a stop sign, make sure their car's lights work and their TAG is up to date....in other words, don't commit Crime A...they'll never be "profiled" for Crime B....LEGAL citizens have nothing to fear.........except for when its time to renew their Drivers Licenses.

Do your job. Defend the borders. Arrest and deport illegals from whatever country they have left to break our immigration laws. Stop Campaigning and do the job you were elected to do.

Where do ANY federal immigration laws say that people should be stopped if a policeman THINKS that they may be illegals?
The Republicans are against FREEDOM of all US citizens if they approve of this Arizona law.
Go ahead with the lawsuit and let the Republicans fall where they may.

So Obama is going to sue a state for enforcing a law which he is supposed to enforce but refuses to on the grounds that it is his responsiblity to enforce it and not the state's. Makes a lot of sense. Great campaign issue too. Right up there with the oil spill and his job stimulus.

WE THE PEOPLE need to take this issue into our own hands. Help fund the Arizona law suit costs. Organize a FULLY EQUIPPED border patrol with monetary donations as well as time if possible. We need to fund legal challenges against Federal government and inundate the courts with law suits. We need to organize protests in each and every state!! The illegals aren't the only one that can protest!!

Whats good for the goose is good for the gander as they say.

This is Obama's lawsuit and it has his stink all over it. His regime is the most anti-American mob this side of Argentina. I hear Obama's comrad, Hugo Chavez, has just sent him a letter of congratulations and support for his strike against America.

The Obama regime has allied itself with the Mexican government in this attempt at bullying Arizona into surrendering itself to the marauding hordes of illegal "immigrants" from south of the border.

Obama is doomed to one term, I'm sure.

If protecting our borders and handling of illegal immigrants is suppose to be a federal government job, why then is the federal government not doing the job? Why has the federal government not bothered to enforce our existing laws? Only when the states start doing something about the problem does the federal government rear its head and come crashing down on those who are attempting to take care of the problem instead of on those (illegal immigrants) who are the problem. Besides that, these immigrants don't give a hoot about voting in our elections. They are more concerned with voting for the next Mexican President. They think they are still in their home country. Mr. Obama and all you senators and representatives wake up!!!!!!!!! and do your job.

That is what AZ is doing: Requiring State and Local Law Enforcement to follow federal law and enforce the Federal Immigration Laws. You may not like the fact that the US Citizens in AZ are living in constant fear from criminals that are illegal, but, that doesn't prevent them from enforcing the Federal Laws. How about Bank Robbery; a felony. Should they not be allowed to pick them up and hold them in jail? Get Real. If you don't live along the border, then, you can't imagine what they indure. Stop with the bleeding heart stories. EVERYBODY MUST COME THROUGH THE FRONT DOOR. That is all we expect. NO AMNESTY. We gave 6MM amnesty and now what, we have 12MM here illegally. How many times must we say to you MORONS?? I have just one question for you all. When the Republicans move to other countries, who is going to be left to give you scum buckets a job?
