Washington City Paper responds on conflict with Daniel Snyder

Redskins owner Daniel Snyder has filed suit against the Washington City Paper and its parent company, The Post's Paul Farhi reports.

The Washington City Paper released a letter to its readers late Wednesday afternoon that details Daniel Snyder's threat to sue the publication and said it stands by its critical story of the Redskins owner.

The paper's publisher, Amy Austin, said Redskins General Counsel David Donovan complained about the story (see link below) in a letter to Atalaya Capital Management, an investment company that owns Creative Loafing Inc., the parent company of Washington City Paper.

"After identifying certain items that Snyder contends were incorrect, the letter to Atalaya accused City Paper and McKenna of 'character assassination' and stated that Snyder was considering all of his options, including litigation," Austin wrote.

She said Donovan's letter suggested that "defending such litigation would not be a rational strategy for an investment fund such as [Atalaya]. Indeed the cost of litigation would presumably quickly outstrip the asset value of the Washington City Paper."

Austin wrote that the City Paper offered Snyder a guest column to respond to the story and proposed a meeting between him and the paper's editor to discuss his concerns. However, the paper rejected a suggestion that it stop reporting on Snyder or prohibit columnist Dave McKenna from covering the Redskins or the team's owner.

The City Paper said it declined to correct anything in the story. "We believe we have the facts right," Austin wrote.

The Simon Wiesenthal Center, a leading Jewish human rights organization, called on the Washington City Paper Wednesday to apologize to Redskins owner Daniel Snyder for a November photo that depicted him with devil's horns.

"Public figures, including an owner of an NFL team, are fair game for criticism and even derision," said Rabbi Abraham Cooper, associate dean of the Wiesenthal Center. "However it is inappropriate and unacceptable when a symbol like this--associated with virulent anti-Semitism going back to the Middle Ages, deployed by the genocidal Nazi regime, by Soviet propagandists and even in 2011 by those who still seek to demonize Jews today--is used on the front cover of a publication in our Nation's Capital against a member of the Jewish community."

The statement is the latest development in a conflict between Snyder and the newspaper over an unflattering November story that included the photo illustration. Snyder has threatened to sue the Washington City Paper for allegedly defaming him.

Cooper urged Washington City Paper publishers to "apologize for their error in judgment."

Oh so now it comes out. Snyder wasn't torked about what was said, which had been said before, in some cases many times, but about the implied anti-semtic barb of having horns drawn on his head, something we used to do to as kids when we saw someone's ugly mug posted on a telephone pole or a bulletin board. I guess being puerile, while sometimes a mark of distinction on this blog, can get you in trouble in the adult world. Sort of like what happened, but not as bad, when them Danes drew cartoons of Mohammed.

Dude - ain't you never heard of Snyder and Six Flags? How much skin did the dude lose in that game? BTW, one of the charges that McKenna leveled against Snyder in his article was that after Snyder took over Six Flags they started using heavy racial stereotyping in their commercials with some Asian dude screaming in a distinct accent "More Flags, More Fun!" Heh, heh. Dan - what's good for the goose ain't good for the gander?

Actually, when you think about it, with owners like Jerrah Jones and "Morning Wood" Johnson it prob would be much better overall if owners just sort of blended in with the woodwork.

So where was this leading Jewish organization 3 months ago when the story was written?

Do you think Mr. Donor / Mr. Snyder made a call today?

Jewish people have bigger problems to worry about, unfortunately. But now they are a tool in the lame Redskins PR machine.

If they were named the JewSkins, they would get crucified BTW. But good thing they are using the equivalent of the n-word for native americans, who have no political clout.

Snyder is beyond absurd. We're gonna be a laughingstock as long as he owns our team. Joe brought back some respectability during his second stint, but this thing is rotten from the top.

Just can't help but shake my head that Snyder and his henchmen are playing the anti-Semitic card. I love the response from the City Paper.......most of the writers and editors - including those who worked on that article - are Jewish. Maybe Dave Chappelle can write a Clayton Bixby-type skit for this one, entitled "The Proudly Jewish, Anti-Semitic Journalists".

Finally read the original article and it was quite entertaining.

My advice to the city paper: Stick to your guns and give him the finger.

Courts do not like people f_cking with the 1st Amendment and this will be humiliating for Snyder.

As a journalism major I see nothing wrong with the article.

Snyder has to prove this guy is wrong and that's going to be difficult.

As far as the horns drawn onto his face.

That's not because he's Jewish. It's because he's ruined and destroyed one of the greatest football franchises.

Snyder is lucky to have fans like us, that year in and year out root for the team, buy tickets, jerseys and $8.00 beers.

So yeah, first and foremost, don't f_ck with the Redskins. If you start to win, suddenly your little transgressions aren't such a big deal. But mess with the team we love and this is what happens.

We're not going away and we're not going to shut up.

Way to go City Paper, shove the 1st Amendment up his ass sideways.

I love love looooooove this. The story is getting worse and worse for Snyder, and he caused all of it. All of it. Just desserts, baby.

Anybody else suspicious of the timing of the Wiesenthal Center's criticism? It's so unbecoming of them, given their admirable mission, to get caught up -- as it appears they have -- in Danny Snyder's ham-fisted attempt at going full court press against the City Paper.

Here's the thing: Because of his public figure status Snyder has to prove that he DID NOT forge anything.

Example, if I were to say Joe Blow(famous guy) likes to do it with baboons.

Then Joe Blow has to produce evidence showing that he absolutely DOES NOT do it with baboons.

Aside from that there are about 3 other criteria that need to be met to successfully sue as a public figure.

Trust me, the newspaper almost always wins.

Donovan could only come up with 2 factual inaccuracies on Lavar show today:

1) Dan Snyder was not 'tossed out' as director of 6 flags:

Nine people, including Snyder's handpicked Six Flags chief executive, Mark Shapiro, were named directors as part of a bankruptcy reorganization plan submitted by the company's junior bondholders, according to a filing submitted Friday in U.S. bankruptcy court in Delaware.

Under the reorganization plan, Snyder could not be reappointed to the board without the consent of those junior bondholders. A spokesman for Snyder released a statement Friday that said he would not seek reappointment.

VERDICT: No chance of them winning this in a court of law. They resigned because they had been de facto fired. As a bankruptcy lawyer, I can tell you that enumerating who cannot be on the board is quite unusual.

2) Snyder forged telemarketers' signatures

Verdict: Snyder Communications definitely participated in slamming (by the way, so did everyone else in the industry, they were just more aggressive). SO: Snyder lawsuit has zero percent chance. But I think we knew that already.

Not necessarily the point of the lawsuit. The point is that Snyder is prepared to pay whatever it takes and The Washington City Paper doesn't have the funds to do such.

Snyder is essentially bulling the WCP to retract the story/fire McKenna/etc....or the legal fees will bankrupt the paper.

Subscription newspapers don't make any money in this country anymore. Snyder is actually threatening to sue a FREE newspaper. Nothing will come of it. It's so ludicrous it's beyond belief.

The City Paper is a gem. The fact that McKenna presented the despicable Snyder history in alphabetical order is priceless.

Its stuff like that which gets people in trouble. Usually, it gets said off the record. Not sure what the legal term for it is ... but its the sort of stuff that usually backfires. If Snyder loses this case and there is a countersuit, he'd get hit up big time. I really doubt Danny's partners that own the Skins have any interest in creating this liability for themselves.

Don't know how much credence to place in the Senior bowl.... it's d-bags playing against other d-bags.

You're right.

The Senior Bowl is so useless for assessing talent that the entire NFL coaching fraternity comes yearly just to watch a battle of the 'doosh bags'.

11 first rounders played in last year's Senior Bowl, so I guess those guys suck, too.

Again: C Ponder may not have an arm for the deep ball, but since dink-n-dunk passing is the style that sustains drives, any guy who can do it accurately is desriable.

And he's certainly not a 'doosh bag'.

I say both parties are guilty of unsportsmanlike conduct! Snyder has a propensity of doing so, and City Paper, well, it only rises to the level of defamation if aspects of the story are unfounded or misrepresented.

If Snyder has no prima facie case and no sound defense, his only motive would indeed be to bankrupt the defendant. Is he that conniving, spiteful and lowdown?

If Snyder wants to correct the record then he should take the City Paper's offer to do an op-ed. But the fact that he wants to sue, betting that they will cave instead of paying for the lawsuit, tells me he's got nothing to say.

I think today is the day i finally give up. I have been living in denial for eighteen years. I will give a pass for 1992 to 1999--- I think we were actually trying. The guy has to go. I turned down tickets to go this year and will until this guy is gone. We are a joke. I listened to and criticized Lazar and Dukes, the Sports Junkies ------- I think I have been wrong. Either sell or move the team. We have suffered enough. This is the last straw.

He (Ponder) doesn't have to have a cannon to be affective.

Analogy time: The NBA center without hops who good at knowing when to go up for a rebound outjumps the leaper who processes info slowly.

Ponder acquired a degree in finance in 2 years: he has the smarts.

And if he can make decisions a split second or two faster than, say, Jason Campbell, Rex Grossman, or Donovan McNabb, he completes passes without arm strength because he throws the ball sooner.

Too, the 'smarts' would seem to mean he won't be afraid of a playbook.

It ain't like these City Paper dudes are a bunch of schlubs that did something and then looked at each other and said "He's suing us? How could that be?"

1. They could have liability insurance to cover this.

2. All this attention will certainly jack up their circ #s and make them 1st amendment heroes.

3. Stuff could be going on behind the scenes that we don't know about. Like some investor somewhere that Snyder once screwed over wants a pound of his flesh.

4. He hasn't sued the paper yet. They could be thinking that he will blink first because were he to actually sue them he would suffer bad and so would the NFL. It would be a new experience for the NFL. Instead of the usual low brow DUI, domestic violence, dog killing, aggravatged sexual assault, bird flipping shti it would be a first amendment transgression which has a legal cachet that them others certainly don't.

C'mon guy, listen to what you are saying.

So the players don't determine an outcome on the field? It's the owner?

If anything the Redskins need better talent evaluators. We can't identify and often let talent leave our roster. And we aren't too successful in the draft either.

We hit on a guy like London Fletcher. He's been a terrific player his entire career over the span of at least 4 coaches I can think of and three different owners. If we could pick out the London Fletchers in free agency instead of the Albert Haynesworths, we'd be a better team.

Ok, so if I(Snyder) hire a well respected scout with a decent resume of prospects. And say he fails to work hard enough, I don't know maybe it was tougher than he thought or he underestimated the amount of time needed to properly evaluate a player or maybe he develops a habit of smoking trees and gets a little content.

This is pitiful; The original article was published back in November - is The Danny that slow a reader that it took him until now to catch up with this?

If the sole basis of the litigation is 'character assissination', I'd think that an apology by the Washington City paper for running the Snyder 'devil-sketch' alongside with the article would deflate most of that. McKenna's article was just a summation of Snyder's dumb moves over the last 10 years, and was a good read when originally published.

Many writers besides McKenna have been publishing articles questioning Snyder's competency in both business & sports team ownership over the last ten years; Why does he lash out now?

The NFL's AntiTrust Exemption allows the "Snyders" of the NFL to survive market forces. Time for the FTC and FCC to recognize the illegality of this exemption and end it.

Dan Snyder filed the lawsuit.

Even worse, he had David Donovan, the Skins general counsel write the threatening letter. As bad as the lawsuit is, using Redskins staff to address his PERSONAL legal concerns is something the Redskins board of directors/shareholders ought to be extremely angry at.

The article I read had 62 comments at last check. Exactly ZERO supported Danny.

So, Snyder has the legal horsepower to crush the paper and the investment fund that owns them. Is that going to stop the shots taken at his image? Nope. It's going to accelerate them. This all just seems so stupid on the part of Snyder. How can he win? Using his might to have a Jewish Human Rights center stand up for him doesn't smack of "oh, they did him wrong", either. Even if Snyder wins this, he loses. Maybe the best thing he could do is agree to have his side of the story printed - maybe in the paper at issue or maybe at another paper if he feels it would only contribute to their profitability.

Moving forward he needs to realize that everyone is going to take their shots at him. Being a big business man in this day and age means you aggravate some people. It is unavoidable. You just can't let the media see that it gets to you. You can't dignify any of it with your comments, or you validate it. I thought a smart guy like Snyder would realize this.

all we ask of $nyder is to step aside and let football peeps run the football side of the team. on the business side, pay the electric bill, but don't embarrass your fan base in front of the league and the rest of the world. one thing $nyder has proven to me over the years is money can't buy you happiness, or a winning team.

Seriously. Dan Snyder may be one of the worst corporate leaders in American history. He certainly is a study in how to scramble the golden egg. I've been losing interest in the Redskins steadily for a decade but my dedication was so high (I've been the kind of mark who built Redskins shrines in every house I've lived in) that it's only now that I'm actually feeling compelled to finally say goodbye and find a new team to root for, and invest in, simply because while I can handle losing, I can not abide rooting for a man such as Dan Snyder. The forgery claim is not saying that Dan Snyder personally forged contracts. It was proven that his Snyder Communications Co did forge customer agreements while they were "Slamming" customers back around 2000-2001. The now completely illegal practice of switching someones long distance service without them knowing it. That is how he made his money.

Check out "Constantine's Sword" -- book or DVD. There is a long-standing history of European attempts to demonize Jews. Thus I understand how/why the Jewish community would take offense. That said, the burden of proof is still on Snyder's legal team to prove that 1) the reporter was aware of his Jewish heritage, and 2) the horns, etc was a direct correlation/defamation of that heritage. Perhaps the drawing is just a drawing, and the paper and the reporter think Mr. Daniel Snyder -- regardless of ethnicity, race, politics, shoe-size, height, or other demographic assignment -- is evil. Just saying...

That picture of Snyder with the horns and beard looked just like the ones we used to draw on all kinds of sports figures, politicians, etc. when I was a kid.
