Rep. McHenry Not Ready For Birther Status


Don't add Rep. Patrick McHenry (R-N.C.) to the short-but-colorful list of House birthers just yet. It's a club he apparently isn't quite ready to embrace.

After first suggesting at a town hall meeting in his district that he isn't convinced President Obama is a natural-born U.S. citizen, the North Carolina Republican backpedaled.

At the forum on Wednesday evening, McHenry, according to the Charlotte Observer, said, "I haven't seen evidence one way or the other" proving Obama's citizenship. He also said the issue is being addressed "in the courts."

On Thursday, McHenry released a statement clarifying his position on the president's eligibility.

"As I stated last night, I have not carefully reviewed the evidence as a jurist would," the congressman said. "However, from what I have read, I have absolutely no reason to question President Obama's citizenship. I anticipate that as a legal matter the courts will continue to come to the same conclusion."

While he may have gotten caught up in the heat of the moment at his town hall forum, what with the birther craze sweeping his state, McHenry's quick about face on the issue shows he may not want to be associated with a movement largely discounted by the Republican establishment in Washington.

Voters in North Carolina, which Obama carried by the thinnest of margins last year, however, remain skeptical of Obama's eligibility.

A poll conducted early this month found that 54 percent of North Carolina voters believe Obama was born in the United States. And only 24 percent of the state's Republican voters believe Obama is a natural-born citizen. (Keep in mind: the survey, conducted by Public Policy Polling, was an automated robo poll.)

The Congressman, one Mr. Ted Poe, that represents my district signed this stupid birthers resolution or whatever they call it. He has the nerve to ask the DULY ELECTED President of the United States to show his Birth Certificate (again). OK, I guess the people of my District are getting their money's worth.
Now here's my question. Why has he flat out refused to show his own birth certificate when asked to do so ??? Was he even born in America? Was he born in Kenya? WHAT is he hiding? Is he a Nazi? Is he the AntiChrist? Are worst yet, is he not even a Native Texan???

The terms "citizen", "native born citizen", and "natural born citizen" do not refer to equivalent concepts, and to use them interchangeably is somewhat disingenuous. If one is born on U.S. soil, one can be a "native born" citizen. However, even if one is born on U.S. soil, the establishment of "natural born" citizenship may depend on the citizenship of one's parents at the time of one's birth.

Obama's father was a British subject whose citizenship status conveyed to his children. Hence, regardless of whether he was born on U.S. soil to a U.S. citizen mother, Obama was not born solely with U.S. citizenship due to his father's status. This dual status brings into question whether he can be considered "natural born".

No one can definitively make the claim that Obama is a "natural born citizen" of the United States, since a definition of the term has never been conclusively established in a court of law when the individual in question admits to being born with dual citizenship. The Supreme Court has never fully addressed the matter.

Curiously, on Obama's FightTheSmears website, the specific language used to debunk smears about his birth certificate states that Obama is "a native citizen of the United States of America." There is no claim of being "natural born", which is, of course, the Constitutional requirement for the office of President.

But none of this will stop either side from virtual-screaming or misrepresenting the issue, if for no other reason than that the topic garners prodigious web hits.

being in McHenry's district and watching his actions during his tenure in congress, he must be an offspring of Charlie McCarthy, because he sits on the knee of every demigod mouthing their beliefs. I have yet to hear or see one original thought or action come from him.

Every court that has received a "birther" case has thrown it out, including the Supreme court refusing to take the case. Why doesn't the Congressman know this? It is not working it's way through the court, the courts have ruled. Everyone knows the birthers are at best nuts and more likely just plain old racists that can't accept a black man as president. Obama is an American citizen and he is president, by majority vote of the people and the electoral college, so live with it.

YET

You admit that the SCOTUS has not issued a ruling on the exact nature of the subject.

Doesn't the fact that the SCOTUS turned down the Berg appeal mean that your entire "the SCOTUS has not ruled" argument has an enormous hole in it?

By the way - why do you think you can make authoritative assertions about this subject? Been involved in this case in one way or another? Such as an assistant to Berg?

And as to the original topic - I say let's keep the 'birthers' on camera. Eventually the American people will see that they are nothing but fruitcakes, and since almost all of them are RepubliCANTs, it will help to doom the Party of NO! that much quicker.

Like Obama, the only birth certificate I have is a certified copy, in my case from the California Republic, AKA "the State of California."

Does this mean I can't be president? :(

It doesn't matter what his Dad was. His Mom was American. Kansan. Doesn't get much more American than that.

But I suppose the real issue for most birthers is that while she was white (ala American enough) she ruined that by going out and being impregnated by a black man.

So perhaps she wasn't American for that reason.

As for the Congressman in question, he wasn't willing to come right out and tell these morons to knock it off so we could focus on real issues. So in my book he's catering to the nutjobs for cheap political gain.

The following statement from Ted is completely incorrect:

* Citizens of Kenya were never 'British subjects.' At times, Kenya was a British protectorate, but its African residents were never citizens of the United Kingdom.

The current president of the United States of America was born in Hawaii, which became U.S. territory by annexation in 1898 and became a state of the Union in 1959.

Barack H. Obama was born in the United State of America. His live birth on U.S. soil makes him a 'natural born citizen.'

Barack H. Obama was born in the United States, at Honolulu, Hawaii. He acquired U.S. citizenship at birth. He is natural born citizen of the United States.

The citizenship of his parents is irrelevant. Although, it would be good to note that his mother was also a natural born citizen of the United States, that Barack H. Obama lived the vast majority of his life within the boundaries of the United States and that when he lived outside the boundaries of the United States, he was never of an age in which he could legally relinquish his American citizenship, which he acquired at birth.

Obama's is actually the simplest of citizenship cases. He was born within the boundaries of the United States. No special exemptions or explanations are required.

I've long believed a sanity test should be necessary for candidates for public office. Now I'm beginning to think an IQ test should be offered, too. It'd be nice to know that our elected officials have an IQ above 10.

When will members of both parties stop their childish behavior and remember that it is their job to serve us whether they like each other or not. This country needs a unified government which means that both parties work together instead of trying to knock each other down. We need solid ideas from both sides of the aisle. If the republicans don't like a proposed reform introduced by the democrats, for heavens sake, let us know what your issues are and suggest alternatives. STOP FOSTERING ANGER AMONG THOSE OF THIS NATION THAT REACT TO YOUR ANGER WITH HATRED AND THREATS. ENOUGH!

The GOP has this drill down cold, and they've applied the formula to the birther movement as well:

1. Use apocalyptic rhetoric that inspires fear, bigotry and extremism among the uneducated and intolerant.
2. Keep turning up the heat and act surprised when somebody finally heeds your calls for extreme action.
3. Be sure to say you were only speaking figuratively and you are being unfairly blamed when violence occurs.
4. Keep your celebrations behind closed doors.

Who cares? Seriously...who, with even half a brain, gives a damn about this? Is there some possibility he would be "recalled"? This is a complete and total waste of time...and meanwhile, back at the ranch (Congress) the flames climb higher as issue after issue is either ignored or is "soft-pedaled" and not acted on. To these congressmen involved in this issue, I'd say "get a job"...oh, right, they have one....well then, do your job...and chasing down "birther" rumor isn't your job. Our nation is in serious trouble and they should be working to be part of the solution, not part of the problem. "Birthers"...what a bunch of numb-skulls...sheesh!

• The children of aliens, born here in England, are, generally speaking, natural-born subjects, and entitled to all the privileges of such.
To accept one is to accept all.
The framers of the Constitution, who were born of British parents in England, or in one of Her colonies, were without doubt natural born subjects. They wanted the “Command of the American army” [2] to never be given to a foreigner; and so they made one of the requirements for the President be that “No Person except a natural born Citizen”.
(Wisely, they included the grandfather clause so that the country could have a President sooner than A.D. 1811.)

steveb777 - Our president has no need to produce anything more than what he already has- when his campaign posted a copy of his birth certificate online for all to see. Only nutjobs and racists keep demanding more. However, I'll tell you what, I'll join you in demanding more when you provide to me your "long form" birth certificate along with your social security card, present address, etc. Then perhapos I'll believe you even have a right to be asking the president for his information. After all, you might not be a natural born citizen either, kind of like that crazy russian woman that keeps getting hysterical on TV and has such a heavy accent it is hard to understand her. Being one of those naturaL born citizens myself, I just don't have much of an ear for people speaking english as a second language with heavy foreign accents. Just have a real hard time understanding what they are saying. But hey, you want to provide me with all that, (hows your credit by the way?) and I'll join you in asking our president to provide his personal information that you all keep demanding.

Among other points I could make about this report is the lunacy that only 54 percent of ALL N.C. voters think this nonsense. Thanks to WaPo for at least reporting this was done by robocall, not even reliable in an election year when polling interest is higher.
Since the hit-and-run smear job on N.C. (a blue state last year), few of those who have reported have done so.


This being a non-election year, you have to think a minute about who answers the phone when a pollster calls. It's not 46 percent of all N.C. voters who have the opinions described. It's those who 1) don't screen calls, 2) had so little to do they stayed on the line when a robot voice called at a time most people consider inconvenient, 3) didn't even hang up when said robot went on at length with such intros as "Next, I'm going to ask you about seven issues."

With all the liberal commentators who jumped at the chance to ridicule a Southern Obama state, this has to rate as one of the worst cases of blue-on-blue fratricide ever.

Excuse me, but Obama never bowed to Bush's Saudi Arabian girlfriend; he tilted his head to receive a medal. How interesting Obama is criticized for this by someone who takes no issue or offense with Bush holding hands at the White House with the same character. I, for one, was offended by the public display of their homoerotic liaison.

This birther nonsense is just that. We can solve this artificially created problem by obtaining a copy of President Obama's mother's birth certificate. If she was born in the U.S. as has been stated and most of us believe, she's a U.S. citizen. That's all that is required for him to be a U.S. Citizen. Doesn't matter if he was born in Hawaii, Kenya, or Keokuk, he's a U.S. citizen. The Republicans are making themselves appear foolish by (a) not knowing the law on citizenship, and (b) continuing to beat the inconsequential to a pulp. I fear that they are going to snatch defeat from the jaws of victory if they keep up with their infantile antics. Get busy, Republicans, focus on the REAL issues and let go of the need to be right and the need to make Obama look bad. He's doing that by himself. Now get busy and help the angry in this country. You have a golden opportunity. Please, for God's sake, don't let it slip through your fingers. Act like grownups. Take positive, constructive action. Stop beating all of those dead horses. It's not becoming!

We are at a very crucial time in the History of our country. A time when,we can no longer sit back and take things at face value. Thats what got us in this mess in the first place. In the past 20 years at best,we have seen the key figures leading our Country lead us into the darkest pit of despair,we have ever known.
Just because BO is President,he is not God,nor should we treat him in the same manner. He is to be accountable to us "WE the People" he works for us. There is every reason he should provide all that he can to prove who he is. All his records. But instead,YOU all chose to believe a piece of paper that there has been so much controvercy over,so Mr President back it up with the other documents,set the record straight,and remove any doubts from our minds. He has gone too such great lengths to keep it consealed to the tune of 800 plus thousands of dollars in legal fees, to keep us from knowing what? He could solve the issue easily once and for all,for all of us who may or may not be convinced. And in view of his record so far,which shows his popularity dropping in such a very short period of time,as a result of the Big Change's and costly decisions he's made that will undoubtly haunt all of us for years to come. Should we not question every move or decision that will in pact our future and the lives of our children? We need up front honesty,which is something that We the People have not had in many years,and the American People are finally waking up to it,and YOU out there who don't think that we should burden him with our unresolved feelings of doubts,will continue to swallow what ever is handed to you,BECAUSE

Americans are so easily fooled it is frightening. Obama has not furnished a birth certificate from Hawaii because as his grandmother said, he was born in Mombasa, Kenya at the Coast Provincial General Hospital and now we finally have a 1964 certified copy of his Mombasa birth certificate.

Wow, this has to be the craziest claim yet. Obama's mom was 14 in 1957 and hadn't yet been to Hawaii. And that would have made Pres. Obama 22 when he graduated from Punahou with the class of 1979. And everyone who went to Punahou with him would have been lying about his age. This is more fantastic and paranoid than just about all of the paranoid delusions rolled together.

I knew Pres. Obama in the early 70's and he clearly wasn't older than me, and I was born after 1957.

My comment:
The "Kenya" Birth Certificate is an obvious fake. The most telling is that Mombasa was not part of Kenya when Pres. Obama was born. In was part of Zanzibar (which is now part of Tanzania) until the end of 1963.

Resolving proof of birth ought to be simple and should have been done months ago. That it still hangs out there makes me wonder.

Screw the birth certificate nonsense.

I'm still waiting for Bush to prove that he had a brain. And an honorable discharge from the National Guard. Haven't seen either. Been waiting for over 8 years now and no sign of that proof.
