Bring On the Swift Boats

Dear Stumped,
Shouldn't candidates this election be held responsible for Swift Boat-like 527's that engage in negative campaigning on their behalf? I mean, if a subordinate of mine goes around engaging in unethical behavior at work on my behalf, I can't really shrug my shoulders and say it has nothing to do with me.

Dear Mr. Barbaro,
Short answer: no. Medium answer: not necessarily. And my legalistic answer is: absolutely not.
Well-intentioned but ultimately perverse campaign finance laws, the capstone of which bears the name of one of this year's presidential candidates, ban the "coordination" of activities between candidates and supportive groups that are not subject to the "hard money" contribution limits campaigns face. (You can give John McCain only $2,300 per election cycle, but you can give a lot more to your favorite 527 group, so named for section of the tax code that gives them their exempt status.)
There has been some self-congratulatory talk lately that McCain and Barack Obama, who promote themselves as reformers who are above old-school smutty campaigning, have been able to put the lid on horrendous shadow campaigning akin to the 2004 Swift Boaters for Truth. Some independent groups that had been gearing up to launch negative ad campaigns are biding their time, being careful not to antagonize their side's candidate.
Don't expect that to last. The trouble is, old-school smutty campaigning has a proven track record, and both parties have well-funded interest groups eager to engage in it -- and will tell you that the stakes are so high this election (aren't they always?) that the ends justify the means. The gloves will come off once it is clear that we are in general-election season. And you can expect McCain and Obama to spend a lot of time trying to distance themselves from some of their more exuberant partisans and pointing to the other side to say, "Your friends are dirtier!" or "You started it!"
Regardless of how much smut gets out there, the notion that the two campaigns should regulate all electoral discourse makes me a bit queasy. I don't want to live in a country where political speech is overregulated, say by disallowing third-party campaigning, or by prescribing an official "cooling down" period before balloting, when campaigning and polling must cease. Some of the original provisions of the 2002 McCain-Feingold campaign-reform law -- especially the restrictions struck down by the Supreme Court last year on campaign-issue ads by independent groups - made me feel that I was living in such a country. The dinosaurios of the PRI of Mexico (where I grew up, near the end of that party's seven-decade engagement) would have been proud of McCain-Feingold.
There are two distinct issues in conflict here. One is the legitimate concern about actual campaign surrogates creating ostensibly independent "527" groups in order to: a) engage in dirtier politics than a campaign would feel comfortable with; and b) circumvent lower campaign contribution limits (too low, in my view) that campaigns must abide by. This is admittedly a problem, and it is hard to police legal bans on "coordination" between candidates and their allies' campaigns. There is a lot of wink-wink going on, preserving all-important plausible deniability.
But as so often the case when it comes to the First Amendment, the impulse to make things right by tempering or limiting some offensive speech leads down a dangerous path.
The countervailing principle to the above concern is our shared ownership over this election. McCain and Obama do not have licenses to determine what this race is about, or to referee what arguments are made on their behalf or against their opponents. McCain-Feingold, with its overreaching regulations against "electioneering" by third parties within a certain time frame before an election, came too close to licensing candidates to engage in speech that you or I may not be able to engage in.
Too much of this debate is about the tone of campaigns and nasty advertising, for understandable reasons. But Americans have a right to come together to attack a candidate, regardless of what his opponent feels about the attack (again, assuming there is no underhanded coordination). Even more significant, Americans have a right to speak up and identify the issues they care most about in an election season, regardless of whether that message is convenient or not to candidates they may or may not support.
You can imagine countless examples. A left-leaning group that thinks gay marriage is the defining issue of this election could prove inconvenient to the Obama campaign if it fills the airwaves with calls for timid Democrats to support legalization. A conservative group could run over-the-top intolerant ads on the same issue that McCain might not like for being too divisive. Or a pro-Obama group, acting on its concern that McCain might nuke Iran on Day One, could buy wacky ads questioning the temperament of someone who was a POW. Or a pro-McCain group could raise kooky questions about a candidate who spent part of his childhood in Indonesia.
You get the picture. It can get awfully messy awfully quickly. But that's democracy. And the candidates themselves should not be allowed to censor political speech, either for tactical advantage or as arbiters of good taste.
So, if you and your buddies in your stamp club/fantasy baseball league/bowling league/book group/you-name-it have something to say about this year's election and what it should be about, create one of those notorious 527s -- and exercise your First Amendment right with pride!

Preparations are things you might do to get ready for an event. Learn how to say "Hello" in the head of states own language, or memorize a list of terrorist attacks attributed to that countries proxies.
Preconditions are something they have to do in order to win the right to speak to you. Putting preconditions on negotiations is just another way to kill the negotiations, it's a suckers trick that allows you to "win" an argument before the argument even begins.
That's why nobody puts preconditions on negotiations, the conditions are what your negotiating, it doesn't make much sense. Unless you're a republican president who wants to invade and is trying to build a case that your erstwhile opponent is "refusing" to negotiate.
If you call up your mortgage company and tell them "I'll negotiate payment on the unpaid balance of my loan with you, but first you have to knock three points off the mortgage rate to show me you are negotiating in good faith." you'll find that nobody, in reality (that old GOP Boogey-man) accepts pre-conditions on negotiations.
It's a farce that's part of a larger comic opera the Whitehouse and Republican party are staging to give them a pretext to kill more brown people. It's what they do.

Dear Stumped,
Shouldn't candidates this election be held responsible for Swift Boat-like 527's that engage in negative campaigning on their behalf? I mean, if a subordinate of mine goes around engaging in unethical behavior at work on my behalf, I can't really shrug my shoulders and say it has nothing to do with me.

Dear Mr. Barbaro,
Short answer: no. Medium answer: not necessarily. And my legalistic answer is: absolutely not.
Well-intentioned but ultimately perverse campaign finance laws, the capstone of which bears the name of one of this year's presidential candidates, ban the "coordination" of activities between candidates and supportive groups that are not subject to the "hard money" contribution limits campaigns face. (You can give John McCain only $2,300 per election cycle, but you can give a lot more to your favorite 527 group, so named for section of the tax code that gives them their exempt status.)
There has been some self-congratulatory talk lately that McCain and Barack Obama, who promote themselves as reformers who are above old-school smutty campaigning, have been able to put the lid on horrendous shadow campaigning akin to the 2004 Swift Boaters for Truth. Some independent groups that had been gearing up to launch negative ad campaigns are biding their time, being careful not to antagonize their side's candidate.
Don't expect that to last. The trouble is, old-school smutty campaigning has a proven track record, and both parties have well-funded interest groups eager to engage in it -- and will tell you that the stakes are so high this election (aren't they always?) that the ends justify the means. The gloves will come off once it is clear that we are in general-election season. And you can expect McCain and Obama to spend a lot of time trying to distance themselves from some of their more exuberant partisans and pointing to the other side to say, "Your friends are dirtier!" or "You started it!"
Regardless of how much smut gets out there, the notion that the two campaigns should regulate all electoral discourse makes me a bit queasy. I don't want to live in a country where political speech is overregulated, say by disallowing third-party campaigning, or by prescribing an official "cooling down" period before balloting, when campaigning and polling must cease. Some of the original provisions of the 2002 McCain-Feingold campaign-reform law -- especially the restrictions struck down by the Supreme Court last year on campaign-issue ads by independent groups - made me feel that I was living in such a country. The dinosaurios of the PRI of Mexico (where I grew up, near the end of that party's seven-decade engagement) would have been proud of McCain-Feingold.
There are two distinct issues in conflict here. One is the legitimate concern about actual campaign surrogates creating ostensibly independent "527" groups in order to: a) engage in dirtier politics than a campaign would feel comfortable with; and b) circumvent lower campaign contribution limits (too low, in my view) that campaigns must abide by. This is admittedly a problem, and it is hard to police legal bans on "coordination" between candidates and their allies' campaigns. There is a lot of wink-wink going on, preserving all-important plausible deniability.
But as so often the case when it comes to the First Amendment, the impulse to make things right by tempering or limiting some offensive speech leads down a dangerous path.
The countervailing principle to the above concern is our shared ownership over this election. McCain and Obama do not have licenses to determine what this race is about, or to referee what arguments are

Preparations are things you might do to get ready for an event. Learn how to say "Hello" in the head of states own language, or memorize a list of terrorist attacks attributed to that countries proxies.
Preconditions are something they have to do in order to win the right to speak to you. Putting preconditions on negotiations is just another way to kill the negotiations, it's a suckers trick that allows you to "win" an argument before the argument even begins.
That's why nobody puts preconditions on negotiations, the conditions are what your negotiating, it doesn't make much sense. Unless you're a republican president who wants to invade and is trying to build a case that your erstwhile opponent is "refusing" to negotiate.
If you call up your mortgage company and tell them "I'll negotiate payment on the unpaid balance of my loan with you, but first you have to knock three points off the mortgage rate to show me you are negotiating in good faith." you'll find that nobody, in reality (that old GOP Boogey-man) accepts pre-conditions on negotiations.
It's a farce that's part of a larger comic opera the Whitehouse and Republican party are staging to give them a pretext to kill more brown people. It's what they do.

Yes, consistent after everyone jumped all over his ridiculous statement.. whta is a Preparation versus a precondition? can you or he explain it?
I haven't heard what one is.
Also, to say that he is 41st in 2007, that may be because he either voted "Present" or was not there at all to vote.. How many votes did he miss? how many (percentage-wise) has he actually voted yes/no to in his few years in the senate?

So far the 527s have had a good ride on Obama. The question now is what 527s that support Obama will be developing for the fall. I have no doubt that they can deliver messages that will be just as damaging to McCain. After the too long delay in responding to the Swift Boaters in the last election I would bet that there will be a far faster response this year.

Feminism is not about the right of a woman to have an abortion, you have grossly disregarded a hundred years of the feminist movement in favor of something that traditional feminism doesn't necessarily agree with.
Yes, they agree with abortion in principle, but feminism at its heart.. (TRUE FEMINISTS) would tell you it is a man and woman together who created the child and should make choices together.
Also, feminism is based on the concept that women are and should be treated equally, never that women should be coddled and laws should be made to help women move ahead. The idea of affirmative action would probably be unattractive to traditional feminists, because while it may have helped to get to where they wanted to go, it is still in essence patronizing and the opposite of what they were trying to achieve.

As usual you try to avoid the facts as Kerry has.
What we want to see for the purple hearts is the background information and who signed the various parts of the form. HOW can you get 3 purple heats and NOT miss a day of action.
For the silver & bronze stars the after action reports & how they compare with the after action reports of those around him.
And why can't we see why Kerry could not receive an honorable discharge until Carter pardoned everyone in 78.
Those are some of the facts that I want to see.
Tell Kerry to release ALL of his records!

And as far as being the "most liberal senator"... If you look at all the Senate votes Obama participated in compared with all the Senators' votes, you'll find that he ranks 41st in 2007, more conservative than Hillary, at 29th. If you look at his lifetime voting record he ranks 25th, a solid, middle of the road moderate Democrat, still more conservative that Hillary.
So, the next time you hear the lie, challenge it with...um...fact. Check it out for yourself.

As for Clinton...the agreed metric of victory in this nominating contest was ALWAYS the number of pledged and unpledged delegates, counting BOTH caucuses and primaries. It's not the electoral college and never has been. This isn't a general election. If a candidate is unsatisfied with the process, bring it up BEFORE the contest begins.
Do any of you sincerely believe that Clinton would be so upset about the caucus votes if SHE had won them? I sure as heck don't. Mark Penn put it in her head that caucus states didn't matter and now she's paying the price for listening to him.

My production company has six McCain attack ads in post-production as I type this.
It's a great way to break into the government sector and show off our abilities to reduce nuance to talking points.
Our goal is to impact blue-collar voters in Appalachia using the mining accidents as a backdrop to how Republicans have ignored the US worker.
Great powerful stuff. We hope to get some propaganda jobs from it.

The Swift Boaters formed after watching Kerry's performance at the Democratic National Convention, and realizing that what Kerry said was not what they remembered about John Kerry.
Look at it logically: Kerry never released his war records. The Swift Boat Veterans claimed Kerry's records did not match Kerry's story. There are thus only two possibilities for the Kerry war records, they would either:
A) Prove Kerry right and the Swift Boat Veterans wrong, or
B) Prove Kerry wrong and the Swift Boat Veterans right.
If the records supported Kerry (option A), then Kerry would have released them, discredited the Swift Boat Veterans' accusations, and won the election. If they supported him, what logical reason would he have to suppress them? He did not release them. So, tell me why Kerry wouldn't release the records? There is only one logical conclusion as to why he wouldn't. They didn't support his story. That is why people believed the Swift Boat Veterans.

What a naive article. It assumes that the parties/candidates are in charge of campaigns and the danger is that 527s will coordinate with them. Well, folks, the same people who fund the 527s are the same people who fund the parties and candidates. It is the Richard Mellon Scaifes who determine political direction and tactics.

McCain's campaign finance reform is a farce. He passed a rule saying candidates must pay full charter rates for the use of company jets - just as his wife was buying a corporate jet.
So now McCain pays charter rates to himself (he even skimps on those, apparently).
So the real purpose of the law is that all politicians who can't afford their own private jet are at a gross disadvantage against John McCain.

It should be the job of journalists to expose and debunk the hearsay torpoedoes rather than promote them and give them free airtime. An ethical candidate would disavow such tactics and ask the practitioners to cease and desist. I'd like the FCC to regulate some of this. TV Commericals spreading disinformation and bias do not strengthen our democracy and, call me an elitist, but the general population is extraordinarily susceptible to the emotional arguments some of these groups and candidates traffic in. Fox News should not be allowed to call itself news. What is taught in journalism class and public schools these days? How to deposit the paid propaganda checks? The fourth estate is in sad disarray.

You keep insisting that there is something wrong with swiftboating because it isn't about "facts." OF COURSE it isn't about facts. A fact in a swiftboating campaign is like a virgin in a brothel. She's in the wrong place and she won't emerge the same.
There are two ways to wreck someone with swiftboating techniques. You don't want facts anywhere near these things because a fact can be proven or disproved. Swiftboating isn't about proof. It's about IMPRESSIONS. I don't want to state anything that can be argued with in a swiftboating campaign. I just want to convey an impression, and I use two simple techniques:
1. Negative images. George Bush ducked his military service. John Kerry is a decorated veteran. That's a hard fight to win just with facts so I dump facts and show two images: one of Bush in a crisp flight suit being saluted and cheered by pilots on the deck of a carrier; and Kerry in ratty fatigues somewhere in the jungle during a war we lost. Guess which image people like better?
2. The "some people" dodge. I never come out and say that Kerry is a liar, because he isn't. That would be libel and slander and I can't afford that. Instead, I say, "John Kerry is a Silver Star war veteran...so he says. However, SOME PEOPLE say he spent his military career shooting civilians. SOME PEOPLE say he sold his swift boat to the enemy. SOME PEOPLE say he got rich dealing heroin in the Golden Triangle and his real name is Ho Chin Kwong, and that he's the secret leader of global organized crime." It doesn't matter how insane the charge is--but SOME PEOPLE say it so who knows, it might be true. Of course, it's not libel because I am SOME PEOPLE so I'm saying this, and so it's a fact that some people say it...
Does this work? You better believe it does. You people who still have any integrity can't fight impressions with facts, but you still spend time trying. Face it, facts are boring. They make you think. I want to make you FEEL regardless of the facts. My devoted followers all enjoy the pleasure of getting angry, so I feed them what they want. What's really funny is that they all congratulate themselves for their command of "facts" and "logic" (see l_martin here; he's good at this) while they have none at all of either. Even the president uses these techniques. Every chance he gets, he castigates "some" people for wanting the terrorists to win or "some" people for wanting to give our free abortions or some other completely absurd thing, and his devoted followers never ask, what people? They just load their guns and start looking for those "some" people.
You darn liberals. Still stuck in facts and logic. You're a lot harder to own. With the conservatives, all I need to do is feed them this swill and they come whenever I ring the dinner bell.

Issue-based campaigns would do well to impose a ban on scurrilous ads a week before the general. The problem is not free speech, it's speech relevant to the actual existence of taxpayers. We need to balance the rights of Americans to have campaigns that matter versus white noise levels of "free speech" composed entirely of fictional crap. Since no one can function as an effective arbiter of what is and what isn't true, limit the last week of a campaign to statements by the candidates and their respective campaigns.

There is an unsettling truth here: Although negative campaigning has always been with us, the reaction to it has changed dramatically. It used to be that stories like the Swift Boat ads in 2004 against John Kerry would be treated with contempt and derision and would rarely be given any degree of legitimacy by putting them on the front pages of the nations premier newspapers or having them aired on the nightly news on television. But today, we have a media that seems to think its number one job is providing "balance". Thus, it plays up both sides of a story thus legitimizing a stroy where in fact, there is no story at all.
I submit that the number on priority of journalism is printing all the news that is fit to print. That means that journalistic standards on truth must be observed. You cannot balance an untruth. I hold the editors entirely responsible for the proliferation of all of the swiftbaoat-like stories because they seem more dedicated to ratings and profit than to truth.

l_martin can get away with demanding facts all the time simply because to the neocons there is no such thing as a fact. They can look right at one and pretend it isn't there, or that the wrong people created it, or that it depends on your point of view. If it serves them they'll be glad to use it and then forget it ever existed, Classic doublethinkers whose some objective isn't to create a better reality, but instead, to live in an impregnable fantasy. Facts and logic are just words they use to help them stay there.

Negative campaigning and fear-mongering have been successful because there is no truth presented. One of the biggest problems revealed by the Swift Boat campaign and the lead-up to Iraq is the reduction of journalists to stenographers, who repeat any and all information presented to the them regardless of the reliability of the source without doing their journalistic duty, treating blatant or even subtle untruths as just one side of the story instead of the lies they are. The media has been abdicating this job for years now.

Those who feel that there is too much (or incorrect) information about a candidate can provide their own commentary in blogs, or merely change the channel.

So much easier than actually trying to respond to the post in a meaningful way. My guess is that your inability to do so points to a lack of actual knowledege about the case. My guess is that you are one of the bleating sheep who just laps up whatever liberal pundits are ranting because you are too lazy to do your own research. As a result, you can't make a logical argument based on facts, so you fall back on ad hominem attacks.

The question is about ethical/political responsibility, but your response is entirely about legal restrictions. The correct response to smear campaigns like Swift Boat is to vote against the parties that run them. Republicans led the way in this kind of thing and now they are paying the price (side note to downer1 - keep up the good work, every post like yours is a few more votes lost to the GOP).
In the event of attack ads that the "benefitting" candidate dislikes, voters should be able to tell the difference between a genuine repudiation and Pilate-like handwashing

The Karl Rove propaganda campaign was illegal because it was a campaign of burglary. Bush's brain can not simply become Karl Rove. All the Rovehos put together learn only one thing from their guru -- steal, steal steal.
John Kerry did not stand up for the leading democrats who were burglarized. Failure to confront and prosecute the criminals cost him the election. Nixon was felled by a burglary. But under Bush, crime pays.

Look, enough. It is time to get serious here. This country is on the verge of collapse across all fronts - economically, morally, ethically, across the board. The time for frivolity is done. The lies that sank John Kerry campaign were lies and they have never been addressed with enough media coverage so that every last Conservative who actually believed them has acknowledged them to be untrue. And, yes, this does matter. Oe need only look at the results. Those lies sunk John Kerry's candidacy and we got four years more of Bush, four destructive years from the worst president in US history. There is not an intelligent person alive who would not acknowledge that John Kerry would have been an infinitely better choice for president in 2004 but those lies prevented that from happening. So, for this election, enough, no more lies, no more emphasis on the wearing of flag pins from the mentally challenged who only get their news from the biggest lie of all - Fox News. As I said, this country is on this precipace. And this election is too important to be determined by either humor or smot or lies. Enough.

So far the 527s have had a good ride on Obama. The question now is what 527s that support Obama will be developing for the fall. I have no doubt that they can deliver messages that will be just as damaging to McCain. After the too long delay in responding to the Swift Boaters in the last election I would bet that there will be a far faster response this year.
