Cracking Down on Hidden Fees
A bill that would allow merchants to negotiate interchange fees directly with credit card companies cleared a hurdle this week. In a 19 to 16 vote, the House Judiciary Committee approved the Credit Card Fair Fee Act of 2008.
And what exactly are interchange fees? You may not know this but every time you use your credit card to buy something, the merchant has to pay a fee to your card company. That fee is non-negotiable. You, the consumer, end up incurring the cost of that fee because retailers include them in their prices. Supporters of the proposal say it ended up costing Americans $42 billion last year.
The bill has many more hurdles to clear. There is also a Senate version of it pending. But yesterday, the Merchants Payment Coalition, a group of retailers, supermarkets, drug stores, convenience stores, fuel stations, on-line merchants and other businesses, claimed victory.
"We are encouraged by this momentum and effort by lawmakers to create transparency in the credit card marketplace and bring disclosure to everyone," the group said in a written statement. "We look forward to the Senate joining the House soon and to a strong floor vote on behalf of America's merchants and consumers."
The credit card industry, under scrutiny in recent months because of the credit crunch, is none too happy.
The American Bankers Association "is very disappointed that the House Judiciary Committee voted today to move forward with legislation that is anti-competitive and interferes with the smoothly functioning electronic payment system that currently works to the benefit of consumers, businesses and the broader economy," said Edward L. Yingling, president and chief executive of the ABA.
He added: "Merchants that choose to accept payment cards get more satisfied customers, guaranteed payment, fewer losses from bad checks and cash thefts, and improved operational efficiency. Interchange revenue is necessary to reimburse banks of all sizes - whether they are global financial institutions or small community banks - for the enormous costs of making these benefits available.
The committee did strike a provision that would have created a three-judge panel to mediate disputes between merchants and card companies. But critics of the bill insist the proposed legislation would set price controls.
Rep. John Conyers, Jr. (D-Mich.), disputed that.
"Encouraging two parties to voluntarily negotiate is not regulation," he said. "The aim of the bill is to supply retailers a seat at the table that they currently do not have."

I've read because of these fees a lot of service stations will not accept credit or debit cards anymore or if they do they put a hold on them.

It is becoming obvious that banks have become more greedy than anyone can imagine. We understand the need to serve the customer and make a profit, but the complex agreements and ever increasing fees do nothing but screw the customer at every turn. The only way to use a credit card for everyday purchases is simple, pay it off every month! If you don't, there is a spider web of usurious interest charges, late fees and worst of all, sharing info about your status with other card issuers. All of us should be aware that merchants consider credit card acceptance is a form of accounts receivable factoring, that is, they get the money right away, but only 97% of face value, sometimes less. Any store that takes credit cards is prohibited from giving a discount for cash, its in the contract. As a customer, why should I pay cash, knowing the store prices have been raised to compensate for the credit card skim. This whole thing is a racket which evolved over time and almost impossible to eradicate.

This bill is going to screw us over big time. I have a friend who lives in Australia and they did a bill similar to this one. When it passed, the credit card rates almost doubled and so did the annual fees. And you know what the big retailers like Wal-Mart did with their extra money? They kept it. Prices even went up.
Oh, and Bill is wrong, you can charge more for credit than cash. I run a coffee bar and there is nothing in the contract about not charging more for credit card purchases than for cash. I charge a fifty cent fee for any credit card purchases under $10, which is a lot of them. There are still some gas stations that charge ten cents a gallon more for credit payments.
He is right that it's a form of factoring. But I get 98.4% of the face value, not 97%. He needs to negotiate a better contract.

This has nothing to do with banks, per se. Interchange fees are set by the card associations (such as Visa and MasterCard). The banks are members of these associations for the purpose of being able to issue cards under a particular label to the retail market. Retailers usually deal with card processors (sometimes banks, but in many cases not) that process the transactions. Those are the folks who collect the interchange fees on behalf of Visa/MasterCard.

Not always true if you're talking about the U.S. It depends on state law. Anyway, merchants cannot discriminate against customers based on payment methods. However, merchants can offer an incentive to people who pay in cash rather than by credit or debit card.

Doesn't this run a risk of being highly unfair to smaller merchants? Walmart ends up more or less able to dictate terms to Visa/Mastercard, while Joe's Five and Dime has to pay what the card companies demand or not accept cards (and take a big sales hit).
