How Jan Brewer won (on immigration)

The debate over the rightness -- and legality -- of Arizona's immigration legislation rages on nationally but in the state the law's political impact is beyond question -- catapulting Gov. Jan Brewer (R) from also-ran to frontrunner in the fall.

Consider: Prior to Brewer signing the legislation on April 23, she was seen as a near-certain primary loser -- hamstrung by her push for a tax increase to close the state's budget and challenged by state Treasurer Dean Martin and wealthy businessman Buz Mills.

Fast forward two and a half months. Both Martin and Mills have exited the race recently, decisions forced by Brewer's hero status within the GOP base in the state; Democrats have grown increasingly pessimistic about the chances of state Attorney General Terry Goddard to oust Brewer; and, the Arizona governor has become something of a national celebrity -- offering endorsements of Oklahoma Rep. Mary Fallin and former Georgia Secretary of State Karen Handel. (Both women are running for governor this year and face primaries in the next few weeks.)

While Brewer's rise from political zero to hero is beyond question, whether it was the result of savvy strategy or simply good luck is a major point of debate.

Nick Ayers, executive director of the Republican Governors Association, not surprisingly attributed Brewer's turnaround to her own political abilities.

"People can call it luck," he said. "I call it having a steel spine. She hasn't walked into this turnaround. She's earned it."

Others were less charitable about Brewer.

"It's incredible luck that that bill came to her without her having been any part of its creation and she went from easily beatable to unstoppable," said Kim Alfano Doyle, a Republican media consultant who was working with Mills until he dropped out of the race Tuesday.

Alfano Doyle added that the aggressiveness with which President Barack Obama approached the law -- he denounced it and his Justice Department is currently pursuing legal means to stop it from being implemented -- also played right into Brewer's hands without the governor having to do a thing. "When it became her against the liberal President and illegals and everyone else who wanted to disparage Arizona -- it was gone," said Alfano Doyle.

Even Democrats acknowledge that the contest -- never easy but close to a toss up prior to Brewer's signing of the immigration law -- has grown far tougher in the intervening months.

"A tough race -- where Terry Goddard was very competitive -- flipped the moment the immigration issue exploded," said one Democratic strategist who closely monitors Arizona's politics."Immigration fell into Brewer's lap and gave her an excuse to paper over a terrible leadership record and a radical vision for the state."

In some ways the ongoing "luck vs savvy" debate is besides the point. Whatever her motives (or lack thereof), Brewer's decision to sign the immigration bill has put her on far firmer electoral ground than she stood on even a few months ago.

All of which proves -- yet again -- that in politics, as in life, timing is everything.

SB 1070 does not require police officers to accept any form of ID. If a police officer has a "reasonable suspicion" that you are illegal, he can detain you, regradless of what documents you have (driver's license, passport, birth certificate). The law does not define "reasonable suspicion."

The police officer's "reasonable suspicion" overrides any document you show him. Furthermore, there is no punishment for the officer if his "reasonable suspicion" is wrong and he detains a US citizen.

For ALL you MORONS that have forgotten what it takes to get a Driver License, PROOF of CITIZENSHIP!!!!!!!!!! Therefore a valid driver license is sufficient. I will bet my life that all those opposed to any Immigration enforcement are DEMOCRATS. Why?? Because all Democrats are MORONS!!!!!

The Arizona law will be fair ONLY when ALL people stopped by police have to prove that they are US citizens. For this, everyone would have to carry birth certificate or naturalization certificate, I guess.

Some people think Brewer is "lucky" because she didn't drive or craft this law? On the contrary, a leader's vision and tenacious support of the right strategy is his/her most critical skill. She can take 6 1/2 days a week off as far as I'm concerned. Consistently seeing the smart moves is a rare skill, and that's what can make a leader a great leader.

"stolen identities" - no evidence that illegal immigrants are disproportionally responsible.
"broken homes" - how are illegals driving up the divorce rate?
"drug problems" - no evidence that illegal immigrants are disproportionally responsible.

"But they don't go home, they are moving to other states," - perhaps (not much construction work in AZ), but you offer no proof
"to your state as well." - every state has immigrants (legal and illegal) - they go where the work is.

"Don't let them ruin your state like they did to Arizona." - is AZ "ruined". That implies it can't be fixed. I don't agree.

Immigration scare tactics have been a staple of the conservative movement in this country since the Know Nothing party lashed out against Irish immigration in the 1840's. Somehow America manged to survive my Irish ancestors and their role in building the transcontinental railroads.

* 29% (630,000) convicted illegal alien felons fill our state and Federal prisons at a cost of $1.6 billion annually


* 53% plus of all investigated burglaries reported in California, New Mexico, Nevada, Arizona and Texas are perpetrated by illegal aliens.


* 50% plus of all gang members in Los Angeles are illegal aliens

Jan Brewer...our first female President? The wilful failure of the Obama Administration to enforce the EXISTING immigration law and attacks on Brewer and the Arizona law have elevated her in the national consciousness. The lawsuits they are filing will drag on and, should she prevail, she could go mano a mano with Obama in 2012...with Brewer THE MAN.

The report from the Debt Commission should alarm every American about the future of our country, Google Debt Commission and she how the uncontrolled spending funded by massive borrowing is laying our country open to ruin. We simply cannot afford the $113,000,000,000 spent yearly taking care of Illegals in this country. Brewer simply has the interest in protecting her state and this country by enforcing Federal laws to curb the invasion and punishing businesses who take advantage of them. The Senate cannot pass a unemployment extension to help Americans due to the debt we are facing, how can they in good faith support any funding that spends our tax money supporting outsiders?

So if McCain was in office and called for amnesty for current illegals you would be OK with that, but if Obama calls for it it's bad? Good for Jan and the rest of the State of Arizona. Now it is time for our own Federal Government to take the illegal immigration issue serious. Maybe if all of the illegal immigrants had to leave the USA our economey would improve and the people that hired these immigrants for less money would suffer and have to pay taxes because they cannot pay their employee in cash.

Jan Brewer is becoming a national hero for her steely bravado in the face of the hateful, cowardly bullying by the entire Obama regime. She has the stuff from which America was made in the pioneer days. The willingness to stake out what is right and the guts to stand and fight for it.

Jan Brewer is now a national treasure, steadfast and sure. Real Americans are behind her and Arizona, 100%.

Maybe we can deport Obama in 2012.

When that happens, a national holiday must be declared.

Someday you will be old. I will be 67 in August and think Gov. Brewer's age should not be a point of derision.

I do not think Nikki Haley's photo friendly spread in "Newsweek", still a WaPo publication, although "For Sale", is a testament to Haley's leadership and political acumen.

I do not think discussion of how "good looking" a politician may be is useful. Comparing female pols on their sex appeal is especially demeaning, because of the previous history of treating women as eye candy. In fact, as the father of three daughters, now adults, it was always a fight to assure them that their self-worth was not a function of beauty in the eye of some guy. Would it have been tougher to convince them if they had not been pretty? Perhaps. But our identities are truly not in our physical appeal. Perpetuating the myth that beauty equals worth is the province of the plastic surgery industry. Avoid the trap, Mr. XCLNTCAT.

Gov. Jan Brewer, and the "patriotic people of the Sovereign State of Arizona, have spoken in favor of protecting themselves and their families, a right guaranteed to "We the People", by the Second Amendment to the Constitution of the United States of America. We are a nation of laws, not a nation of personality or men. If the Federal Government refuses to do their job of protecting the citizens of the United States of America, then the people of the Sovereign State of Arizona must protect themselves.

What you're seeing is part of a weird reformulation of the political cosmos that started around Reagan's time.  Instead of left and right extremes with totalitarianism at both ends, they have their own, in which liberalism and totalitarianism are identical, and all totalitarianism is of the left.  They say the Nazis were leftists -- no I am not making this up -- and that everything on the right is about freedm and uh, freedm.  Yeah, that's it, freedm. 
It's truly idiotic, but they have their own "scholars" to back them up.  There's a book that every one of these creeps refers to though few have read it .. it's called "Liberal Fascism" and it's the basis of the whole Coulter / Hannity / Beck / etc. premise that liberals are about telling you what to do and abridging your freedm with their collectivist notions.
Maybe these people really SHOULD be sent to reeducation camps, because they are so steeped in lies and revisionism.
Right now there are courses in phony Constitutional history being attended by thousands of these creeps, arming them with distorted history to shout down actually knowledgeable people who still know that the Nazis were Fascists, and that Fascists are totalitarians OF THE RIGHT, as first defined by Mussollini who proudly referred to his new creed as the union of state and corporate power.
The righties would take us back to the 30s, the Weimar Republic, the streets full of brutal young tough carrying bludgeons ready to knock the teeth out of Je-- er, Communists.  And maybe we should go back there ourselves when leftist dockworkers with iron pipes put more than a few Fascists in the morgue.

The personal attacks have gone wild on this blog for a long time.

To suddenly ban one person - when everyone else is still engaging in extreme comments - how is that right ?

There is antagonistic comments on this blog - but once those comments are allowed, how can you fault anyone for commenting back?

I find sterotyping the Tea Party movement offensive - and several posters have responded by continuing their silly rants - complete with sexual slurs and false charges of racism.


If you ban one, you should ban everyone who has had bad behavior.


But to respond to a PARTISAN LYNCH MOB - who are acting like children - is just ridiculout.

If these people are constantly emailing you complaining - that is wrong.

All I can say - I have complained many times about the hostile comments on this blog - and nothing was ever done about it.


Chris - if you are going to enforce rule - tell everyone WHICH rules you intend to enforce - so everyone can follow them.

But to one day suddenly say you are enforcing some rule - without addressing any of the other uncivil behavior - that is just wrong.

trying out the add on lazarus for firefox, like this blog and appreciate the effort, many moons ago there was a funny dude that trolled and some wise guy wrote a greasemonkey script that i have used and modified to exclude the 37 guy and all his non de plumes.might look for it.my take on brewer is as is, white people are pretty magnanimous about racism when it comes to african americans because they never have been more than 18 20% of the population. the tea party is the next shoe to drop because they will never allow another 12 to 15 million mexicans attain legal status because those tejanos will celebrate by having three more kids in the next five years. try adding 20 million to the demographic pit hillbillies find themselves in. granny is dying everyday by the thousands, baby boomers the largest segment of the population, and white folks like the good teabags of arizona start to see the writing on the wall. me, i was married to a mexican for ten years, love her dearly to this day. i see nothing wrong with texas being 80% latino, but boy there are some crackers down here that are really gonna go nuts when it starts to hit them in the face. brewer is just the start, in ten years you are going to have a rabid white minority demanding some kind of succession a la 1860. the teabag is dying as i said, long term political viability is not in their future but the next decade is going to be pretty rough for any kind of progressive. congrats chris- you live in interesting times.

The supreme court recently ruled out any censorship of free speech so Biden could even say his famous 4 letter words all day in here now.

SB1070 is a reolution to stand with the Federal laws of the USA, as the 48th State of the Union, and it was a declaration that pizsed off Obama and Mexico AZTLAN plans.
New Mexico is where eyes should be watching. They are quietly slipping, and not one challege to their by pass of the State Department and Congress by their Governor in granting Foreign invasion Aztlan the right to drive on our public dole paid roads here.

There is a humorous part of this . It is the Dems in the House.

That little move by the judge sets up the case to jump over the Supreme Courts powers and head to World Court to break up the USA.

The only thing this House can do is put Obama on Medical stand down for suspicion of NPD Sociopathic dual profiles today ...now. This stops all his powers, and they can open his hidden history and void all of his signatures voiding the Mexico appearance in Congress...hence placing the USA back to inaugration day.

Holder has no Standing to file anything as all of the signatures are void.

Is the Democrat house smart enough to understand they have been had by a con?

As an X dem who has been aware of this horrible idea since 1994, I would not hesitate to say no.

I think there is a false dichotomy "between savvy strategy" or "simply good luck". It is perhaps that Gov. Brewer decided to do what is best for the state of Arizona, and the United States, instead of what is best for business at this moment, and a lot of people in Arizona and the United State has recognized that. There are many that are not willing to take some economic hardship or they don't recognize that there will be many opportunities to improve the economy but perhaps only one to rescue the value of American Citizenship, but that's not all of us.

I stand 100% with Gov. Brewer because I can see the fallacy in the belief that anyone can getaway with illegal entrance to the United States territory and document forgery by branding public officers as racists. I can see that it is the constitution of the American society that is in danger here, because it is not enough to be needy or just in search of a better life to be a good citizen, and I have seen enough displays of despise of American values coming from the persons that want to become citizens by any means, to "enjoy the benefits."

The explanation of Gov. Brewer becoming a national celebrity on savvy strategy or good luck supposes that the rest of us are just brainless puppets that cannot perceive what is best for this country.

The case is not about race...it is about commerce.
This tactical ploy is underminded by this Feds trying to make the point at Arizona with unclean hands ( the colors of law interstate intrastate commerce infraction during GM and the illegal shut down of Dealerships as sole entities separate, but contracted to GM)

The Department has requested a preliminary injunction to enjoin enforcement of the law, arguing that the law’s operation will cause irreparable harm.

“Arizona impermissibly seeks to regulate immigration by creating an Arizona-specific immigration policy that is expressly designed to rival or supplant that of the federal government. As such, Arizona’s immigration policy exceeds a state’s role with respect to aliens, interferes with the federal government’s balanced administration of the immigration laws, and critically undermines U.S. foreign policy objectives. S.B. 1070 does not simply seek to provide legitimate support to the federal government’s immigration policy, but instead creates an unprecedented independent immigration scheme that exceeds constitutional boundaries,” the Department said in its brief.

Citing Conflict with Federal Law, Department of Justice Challenges Arizona Immigration Law

WASHINGTON - The Department of Justice challenged the state of Arizona’s recently passed immigration law, S.B. 1070, in federal court today.

In a brief filed in the District of Arizona, the Department said S.B. 1070 unconstitutionally interferes with the federal government’s authority to set and enforce immigration policy, explaining that “the Constitution and federal law do not permit the development of a patchwork of state and local immigration policies throughout the country.” A patchwork of state and local policies would seriously disrupt federal immigration enforcement. Having enacted its own immigration policy that conflicts with federal immigration law, Arizona “crossed a constitutional line.”

The Department’s brief said that S.B. 1070 will place significant burdens on federal agencies, diverting their resources away from high-priority targets, such as aliens implicated in terrorism, drug smuggling, and gang activity, and those with criminal records. The law’s mandates on Arizona law enforcement will also result in the harassment and detention of foreign visitors and legal immigrants, as well as U.S. citizens, who cannot readily prove their lawful status.

In declarations filed with the brief, Arizona law enforcement officials, including the Chiefs of Police of Phoenix and Tucson, said that S.B. 1070 will hamper their ability to effectively police their communities. The chiefs said that victims of or witnesses to crimes would be less likely to contact or cooperate with law enforcement officials and that implementation of the law would require them to reassign officers from critical areas such as violent crimes, property crimes, and home invasions.

The Department filed the suit after extensive consultation with Arizona officials, law enforcement officers and groups, and civil rights advocates. The suit was filed on behalf of the Department of Justice, the Department of Homeland Security, and the Department of State, which share responsibilities in administering federal immigration law.

“Arizonans are understandably frustrated with illegal immigration, and the federal government has a responsibility to comprehensively address those concerns,” Attorney General Holder said. “But diverting federal resources away from dangerous aliens such as terrorism suspects and aliens with criminal records will impact the entire country’s safety. Setting immigration policy and enforcing immigration laws is a national responsibility. Seeking to address the issue through a patchwork of state laws will only create more problems than it solves.”

Brewer protected and defended the safety and concerns of the people in her state. Their needs always came first. Unfortunately, we can not say the same of our President, who sues Americans to benefit illegals, flouting the law of the land. What kind of President does that? There is something seriously out of whack with Obama.

Gov Brewer won on this issue because she is on the right side of it. It is as simple as that. One only has to examine the polls to see that almost 80% of the American public supports enforcing the law. If only Obama was for enforcing laws instead of ignoring them and shredding the Constitution he wouldn't be a failed president destined for private life in 2012.

I support this law, but the article is spot on: Jan Brewer's timing is incredible. I wonder how many other politicians have taken notice, and will adjust their own "timing"?

as amended by HB2162 only changed the title of the bill...It was Immigration, Enforcement and Safe Neighborhoods.

so they changed the words around.

The entire SB 1070 encourages racial profiling even if they don't type the words. It "alludes" to it big time.
And coppers are now mixing up people of Hispanic background with Native Americans of our state, Asian Americans......

I would venture to say that this law is not only Hispanic in nature, from folks of Mexico or Hispanic descent, it is for all odd looking "foreigners".

So along with the desire to SEAL the border, Brewer made it okay to go after any foreign looking person. We have a large population of Russians ya know. Wonder if Arapio and ICE will go after them for their passports or green cards.

I see the train wreck and it's not pretty.
I see police brutality starting on July 29 if this law doesn't get held back.
And AZ is great at "police brutality". Oh yeah. It's the wild wild west and they let you know it.

The Governor had no choice but beg for protection and then expose the ATLAN America plan of attack in a war that even Obama apparently has as Laraza MECHa Aztlan in his shadow government waging on 10 USA States.

The returning Vets are all used to defending a border, and at least this new one they really really really do want.

The open borders with Mexico in absolute Chaos is finding millions of unemployed Americans heading down without papers to lay claim with USA flags to BAJA Sur for a California annex.

Sonora attached to Arizona, granting them a beach and a new County.

Chihuahua attached to New Mexico as a new County.

Coahuila and Tamaulipas annex to texas as 2 Countys. Rumor has it that Nuevo Leon was to join the USA also.


The returning Veterans without job hope are the ones people flock around as their law enforcement in their little USA flag communities abandonded by Aztlan builders up here.

Unemployment within the black community is extraordinarily high.

I would hope that the NAACP call upon the Obama administration to enforce the immigration laws of the United States and demand that employers be required to check the legality of potential employees.

If the laws were enforced then employers would hire individuals from the black community who are citizens of the United States.

AZ doesn't get alot of invaders at one time. They are 4 to 5 at a time, with backpacks. A family who tries it. They die in the heat and we have to clean up. Some get across the desert but Arapio and ICE are all over them in Tucson. And we have alot of reservation land. The Tribes ....well if they get on reservation land, the illegals won't get any sympathy.

It's the ones that are illegally here (THE UNDOCUMENTEDS) already that have to be dealt with.

The bill is actually called "Safe Neighborhoods, Immigration, Enforcement Act".
It has become a "sealing of the border issue" It should lean more to the creation of the infamous "pathway to citizenship" by the ones who want to come over legally, and the ones here but undocumented.

To seal a border is a big thing. Now that has diplomatic consequences. And Brewer wants to SEAL.

And as many may think, it is, also, not securing the border, or protecting the border. That has been going on for awhile.
Minute Men first....then National Guard who built the titanium fence and part of the pedestrian fence......
Don't believe that the fence hasn't been built. Sections have. Troops were pulled off the fence to go to Iraq.

and AZ was just granted 1200 more National Guardsmen (I think that's the number) and some other perks by the Obama Administration. Money (which AZ will squander on other things).

That's pretty nice of the Administration to do before they take it to court. Whiney Brewer got some of her wish when Obama actually
didn't have to do a darn thing for her or the state.

There is a far larger issue here than Jan Brewer's political future: The whole question of how does this country feel about immigration in general and illegal immigration in particular. We know that in the past 10 years congress had ducked immigration reform and the Obama administration promise to pass immigration in the first year did not in fact happen. Why? They ducked it. Why? Could it be that they looked around and found something very profound out: the actual views of the great American public. Does the great American public support the the elites views of legalization? This may well be what Jan Brewer stumbled upon and why the elites are ducking immigration reform.

As a liberal D (check my other comments), I couldn't support the Arizona law more.

The country has nearly 10% official unemployment (higher if you count people who have left the work force or are underemployed).

Why give jobs to millions of illegal immigrants in that context?

The mad scramble in Arizona now for Republican candidates is to see who can come up with the most outlandish and racist laws. You have Barry Wong running for the Arizona Corporation Commission, promising to turn off utilities to any household with an "illegal." Russell Pearce wants to have hospitals deny birth certificates to babies whose parents can't immediately prove they are U.S. citizens (how many people carry their birth certificates and passports to the hospital when their baby is being delivered?).

I have been a resident of Arizona for 22 years and I have never seen the amount of pure racism and hatred being promoted in this state. In 22 years I have met perhaps 3 or 4 individuals who were in the United States without legal paperwork. Neither myself or my friends have ever had a crime committed against us by an immigrant.

Mexico is Arizona's biggest trading partner. If Jan Brewer and her compatriots continued to push on this issue, the state is going to suffer even greater economic problems than we already have.

In fact, the immigration law itself - Federal code - gives law enforcement in ALL THE STATES to enforce federal immigration law.

Scuttlebutt has it that she cannot stop bragging about her "30 minutes in the Oval Office".

She was Secretary of State before she waltzed into the Governor's Office (Napilanto left). Secretary of State's office during her tenure was crooked as all get out. Secretary of State's office down here writes the AAC (AZ Administrative Code) - and boy was the code messed up. Circumventing not only state law, but federal law.

And as far as this falling in her lap...
heck, it's easy to find one paragraph in the Code as a loophole and to run with it.
She did--- Title 8, Chapter 12, SubChapter 2, Part IX, Section 1323(c)
----ONE PARAGRAPH of USCODE and the state passes this law. Whether it will go in affect, jury is still out. But police brutality is in. Brewer better read all of Title 8 of the USCode.

BTW CHRIS...thank you dedicating an entire column in the FIX about Arizona. Arizona hasn't been mentioned alot in the Fix since I've been accessing. Once or twice.

I hope Governor Brewer doesn't merely defend the lawsuit.

I hope she initiates a strong counter claim against the Administration.

Article IV SEction 4 of the US Constitution says that the Federal Government "shall protect each [of the States]against invasion." The word "shall" doesn't mean the Feds can decide to protect or not protect as they please. "Shall" requires protection.

Since Mexico actively supports its people entering the US illgally (they print brochures about how to sneak across the border and what to do when people get here), Arizona should seek an injunction ordering the Obama Administration to fight the invasion. Arizona should also seek damages for failure to protect against invasion as required by Article IV Section 4.

If the Administration claims there is no "invasion," Arizona should request discovery of all documents relating to the question of whether an invasion is occurring and what actions are being taken to defend agaist the invasion.

That will put the Obama Administration on the defensive.

Likewise, the definition of Treason is levying war against the states, or adhering to their enemies, giving them Aid and Comfort. Arizona should seek treason charges against all Federal officials giving Mexico aid and comfort. Have any Federal officials been dining with Mexican officials lately or plotting legal strategy with Mexico against Arizona?

Yes, timing is everything. But timing alone is hardly an adequate explanation for Brewer's increasingly solid electoral status. She didn't just sign a controversial bill. She has become an ardent and very public advocate for it. Whether this strategy was political genius or political suicide was less about timing, and more about tangible facts and perceptions on the ground about illegal immigration issue in Arizona. If the perception in Arizona was that this bill was a ridiculous and/or dangerous overreach and overresponse to the border problem, she's be deader than dead politically. She's riding high (at the moment) because the perception seems to be that the controversial law is not only needed, but proportional in its response to the problem.

It is also undoubtedly true that the liberal response to the law at the federal level has greatly helped Brewer politically. For politicians and cabinet members in DC to trash the law without having read it, and to file suit against the law without any recent visits to Arizona or any substantive discussions with Arizona authorities about the extent of the problem greatly amped up the feeling in Arizona that the arrogance of the Feds was the real overreach in this whole tempest. Real or imagined, the perception that the Feds are out to lunch and don't want to do what's necessary to secure the border is real, tangible, and potent. Politically at least, I think Obama and his people have seriously been outdone by Brewer up to this point. And that's gotta hurt.

The Arizona law SB1070, AMENDED BY HB2162, doesn't compete with the federal laws, it employs the state and local police to act as "force multipliers" for the federal law. Too bad if Obama is worried the efforts in states will increase the processing load for ICE, (and decrease Democrat votes)because that is not a concern of states victimized by a lackadaisical federal government. Besides, the numbers of illegals the local cops will "stumble" upon, will be few considered the numbers illegally occupying our United States. There may be an uncomfortable flow at first, but as the illegals begin to realize how uncomfortable the new enforcement climate makes them feel, there will be fewer illegals to be caught. As for "racial profiling", the Latino community should accept they will feel the impact of SB1070/HB2162, in proportion to their contribution to the problem. Problem solved? Perhaps, but let's try to fix the problem, instead of fighting over the tools.

Now if the rest of the Republican Party would just pay attention! Stop listening to the likes of Karl Rove and the Bush family and their "Hispanics are the Future" nonsense and run on a PRO-AMERICAN platform.

But, they aren't called The Stupid Party for nothing. GOP elites will continue to pander to foreigners and import millions more larval Democrats.
