West Va. Secretary of State pushes for Senate special election change

West Virginia Secretary of State Natalie Tennant (D) is calling on Gov. Joe Manchin (D) and the state Legislature to decide in a special session whether West Virginia law allows for the special election to succeed the late Sen. Robert Byrd (D) to take place earlier than November 2012.

Tennant announced in a video message that while she personally supports holding a special election earlier than 2012, no election can take place before then unless the state Legislature or the Supreme Court acts.

"I personally would support any attempt by the Legislature to change the current law," Tennant said. "If the state legislature considers changing the law, my staff and I will work with the lawmakers to develop a law that works for West Virginia."

Manchin has said that he will appoint a successor to Byrd, who passed away early Monday morning, as early as this week. But in the days since Byrd's passing, some in the state Legislature have called for a special election to take place this November instead of in 2012. Manchin would still appoint a replacement but it would be for a far shorter term.

The special legislative session is set to convene on July 19 with a focus on education. Manchin would have to add the special election consideration to the docket.

If the special election date gets moved up, that might complicate things for Manchin, who is said to have been eyeing a run for the seat when his term expires in 2012. Republicans are likely to try to recruit Rep. Shelley Moore Capito to run either in 2010 or 2012.

The current succession law was passed by the state legislature in 1990 and upheld by the state Supreme Court in a 1994 ruling.

1. Featured article by Fix about Obama's standing among white voters. Theme: Obama has problems among whites. Check. Non-white voters (a demographic that, unlike angry white males, is actually growing) are left hanging in the article -- natch.

2. Told you there would be blowback in PostWorld from Dave Weigel's "separation" from the Post. Howie Hurtz pens what amounts to a defense of the Post's action against Weigel. Kurtz dismisses the idea that Weigel was fired for expressing an opinion, which, er, it would seem WAS the reason he was let go.

One really important fact buried in the Kurtz that we didn't know: the offending emails from Weigel (mainly his snarky comments about Drudge) were sent BEFORE he joined the Post. This means the de facto standard at the Post is: even PRE-employment emails by a writer/blogger that offended somebody can be grounds for discipline. So if a Post writer/blogger emailed snarky comments about, say, BHO or minorities before joining the Post....?

Only the most deluded Obama fanboys --- like the ones who believed that ObamaCare would reduce the deficit --- are buying the administration's sunny spin on the dismal June economic numbers.
"The economy is headed in the right direction," President Obama told a crowd in Racine, Wis., the other day. It's unclear whether the assembled Cheeseheads took his word for it. But it's very clear that even the most liberal bloggers did not.
Why should they believe him when his deputy, Sheriff Joe Biden, was telling people that eight million jobs are gone and they're never coming back.

But maybe massive unemployment really is good news. Nancy Pelosi says unemployment checks are the best form of stimulus there is. She'll be proven right if about 200 Democrat members of Congress and a few hundred thousand Federal bureaucrats start receiving them.

I wish I could believe we are in the early stages of a recovery, but I just don't see how it's going to happen when the private sector is being slammed with new regulatory mandates like ObamaCare, that make it much more expensive to hire new workers, when new financial regulations are going to add to the cost of making loans to business; massive tax increases slated to go into effect in 2011; and the threat of draconian environmental regulations through Cap and Trade. Not to mention Federal deficits hoovering up dollars and making them into transfer payments to bureaucrat pension funds.

Maybe I'm wrong. Maybe the supercompetent megageniuses in the Obama Regime can make socialism work this time. How much harder can running a 14 Trillion dollar economy be versus cleaning up an oil spill or running an automotive rebate program?

Outrageous behavior this weekend from the FIX BOYCOTTERS


All they have have done is DISRUPT the discussion this weekend.

First they demanded a ridiculous, off-topic complaning about someone Glen Beck put online - like somehow this would smear the entire Republican party.

Then broadwayjoe launched on his black militias fear-mongering - saying that they are all hiding in the woods.

Somehow this might indicate a paranoid delusion that broadwayjoe may have - if he is really afraid of militias coming after him.


Then the fix boycotters launched on a tirade about who should be on the board and who should not.

It should have been apparent to everyone before it ever happened. Shortage of high tech workers in the U.S.? I don't think so. But that's the reason given; of course, we all know the real reason is to depress wages. First, outsourcing and the influx of illegal immigrant labor drives blue collar wages through the floor and defangs the unions (labor is, after all, subject to the laws of supply and demand). Now the outsourcing of high tech jobs is in process coupled with continual whining to Congress to increase the number of foreign visas because qualified workers just can't be found here.

Should the middle class disappear, and the tax base along with it, how long will it be before someone discovers that immigrants who learn English can also sort and deliver the mail---and people with "life experiences" can teach children as well as the college-educated, just like in the old days. Maybe our new health care system can be staffed by immigrants who received three months of medical training in their home country. Why waste a doctors time and pay him all that money when an aid can diagnose you and dispense prescriptions?

I sometimes wonder about one other thing. Couldn't English-speaking natives of foreign countries study U.S. or California law and learn enough to pass the bar? Or at least to specialize in one or another areas of law? Since Congress is comprised mostly of lawyers, do you suppose they'd stand for a big push to import lawyers educated in Sri Lanka to fill some of the corporate positions?

As I remember it, CC banned 37th and then tried to opt out by saying, "oh it's too hard". Then other posters, and I remember Bob Sanderson in particular, saying "if it's too hard to do minimal maintenance" this blog isn't very worthwhile and will continue to disintegrate.

The Constitution does permit ex post facto laws - however election laws really do not fall under that category.


In this particular case - there is actually two provisions in West Virginia law which appear to contradict -


So a Court would defer to legislative action which would clarify that conflict.

Specifically, the law sets a July 3 date - if a vacancy occurs before that date, then the election should be held this year -


But then another provision sets up an election schedule which starts at the next primary, which would be in 2012.

So if the legislature set up a special primary for September, that would be reasonable.

The ex post facto provision doesnt really kick in - because nothing has happened yet.

In any event, the PREVAILING PROVISION would be the Constitution - which in one of the amendments say the Governor can appoint a temporary replacement UNTIL an election can be held.

So - even if the Governor appointed the replacement - and all intended it to be for a term of two years - if THEN an election was set by the legislature, the election would prevail.


I understand what you are saying though - on one level the law should be the law when the vacancy occurs - but it really does not work that way - and the democracy will always defer to an election over an appointment.

I don't complain about noa because there's nothing to complain about. Any alleged banning in his case was due to his calling out racist posts and vicious personal attacks (which, BTW, continue). Those racist posts and attacks went, for the most part, unpunished by this blog. IMO, those circumstances say more about the bannER than the bannEE.

I guess our resident black racist broadwayjoe didn't notice it, surprise, surprise, that the 3 New Black Panther militia members that were intimidating white Philly voters back during the presidential election of 2008 at a Philly voting station, were dressed in mititary uniforms and were carrying nightsticks, threatening white voters.
We'll never know what broadwayjoe's and Obama's tribal members could have had in their pockets then also to protect them from those mean and evil white people trying to vote.

Also.
Not only is the New Black Panther militia as armed as some white militias that have "formed in the woods" (according to broadwayjoe), but there are many other armed black racist gangs in most major cities that are not only by far more armed than any white militia anywhere, but unlike the white militias, actually are using these weapons in actual crimes.
And lets not forget that the 'Nation Of Islam', led by Obama's good friend Louis Farrakhan, has hundreds if not more black uniformed and armed soldiers, thugs, and gang members in most cities in America, that make the white militias look like just a bunch of Boy Scouts.

Your next post indicates that you do not support the First Amendment either.

On the face of it, it seems screwy to have an appointed replacement for over two years and then have an elected replacement for 8 weeks.

I don't suppose any librarian or archivist in WV has been asked to go back through the records to see what the intent of the legislature was in 1990. That isn't ancient history. It could be that they worded the bill poorly and the record would reveal what their intent and reasoning was.

I don't expect a Democratic governor to do something which involves the chance a Republican might take that seat. The political landscape could be different in 2012. Look what happened to Kennedy's seat.

I'm not complaining. Republicans would do everything possible to protect a Senate seat if the shoe were on the other foot. It's just politics.

Somewhat off topic, but I don't see why Blago is trying to drag Obama into his trial. He evidently didn't get anything and wasn't offered anything in return for appointing anyone to the Illinois Senate seat. I don't think it's inappropriate for Obama to show concern over his replacement and even to have a preference as long as nothing illegal was going on. So what's the problem?

1) what's the big deal for having an appointed senator for a period of time. Then (gasp!) the taxpayers won't have to spend money for their legislators to spend time to craft a new law *and* there will be no money spent for a special election (because, let's face it, there's no way they could get their act together to get it on the ballot in Nov).

House passes OBAMA'S FAKE BUDGET


Last night, as part of a procedural vote on the emergency war supplemental bill, House Democrats attached a document that "deemed as passed" a non-existent $1.12 trillion budget. The execution of the "deeming" document allows Democrats to start spending money for Fiscal Year 2011 without the pesky constraints of a budget.

The procedural vote passed 215-210 with no Republicans voting in favor and 38 Democrats crossing the aisle to vote against deeming the faux budget resolution passed.

Never before -- since the creation of the Congressional budget process -- has the House failed to pass a budget, failed to propose a budget then deemed the non-existent budget as passed as a means to avoid a direct, recorded vote on a budget, but still allow Congress to spend taxpayer money.

Clearly, this is how Martha Coakley first started getting into trouble - the democrats were seen as manipulating the election laws in their favor.

These caretaker Senators are out there - they have no seniority - practically no power to do anything - and yet they are on tv all the time, quite outspoken.


They are the Zombies of Capitol Hill - they know they are leaving - and they have extra time because they are not fundraising,


We do not need another Zombie on Capitol Hill just sitting there for two and half years trying to get on the cable networks.
